ǒबहार पुनग[ठन अͬधǓनयम, 2000 कȧ धारा-85 ɮवारा Ĥदƣ शिÈतयो का Ĥयोग करते हुए
झारखÖड के राÏयपाल आदेश देते है ͩक इससे उपाबɮध अनुसूची मɅ उिãलͨखत अͬधǓनयम, जहाँ
तक के भारत के संͪवधान के Ĥावधानɉ से असंगत न हो, आवæयक कंͫडका(2) मɅ उिãलͨखत
पǐरवत[न सǑहत, संपूण[ झारखÖड राÏय मɅ लागु होगी |
2. ǒबहार संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा अͬधǓनयम, 95 को आवæयक पǐरवत[नɉ के साथ
झारखÖड संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा अͬधǓनयम 1995 के सğ मɅ अंगीकार ͩकया जाता है|
(1) ǒबहार संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा अͬधǓनयम,1995 यथासंशोͬधत झारखÖड संयुÈत Ĥवेश
ĤǓतयोͬगता परȣ¢ा अͬधǓनयम,1995
झारखÖड राÏयपाल के आदेश से,
सरकार के अवर सͬचव
£ापांक / रांची, Ǒदनांक –
ĤǓतͧलͪप:- अधी¢क, राजकȧय मुġाणालय झारखÖड रांची को सूचनाथ[ एवं आवæयक कार[वाई हेतु

राÏय के ͪवæवͪवɮयालयɉ, महाͪवɮयालयɉ एवं संèथानɉ मɅ èनातक èतर के åयवसाǓयक
पाɫयĐमɉ मɅ Ĥवेश हेतु संयुÈत ĤǓतयोͬगता परȣ¢ा का उपबंध करने के ͧलए अͬधǓनयम |
भारत गणराÏय के ǓछयाͧलसवɅ वष[ मɅ ǒबहार राÏय ͪवधान मंडल ɮवारा Ǔनàनͧलͨखत Ǿप
मɅ यह अͬधǓनयम हो :-
1. संͯ¢प नाम, ͪवèतार और Ĥारàभ- (1) यह अͬधǓनयम ǒबहार संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा
अͬधǓनयम, 1995 कहा जा सकेगा|
(2) यह उस Ǔतͬथ से Ĥवृत होगा जो राÏय सरकार ǒबहार राजपğ मɅ अͬधसूचना ɮवारा
Ǔनयत करे |
(3) इसका ͪवèतार सàपूण[ ǒबहार राÏय मɅ होगा |
2. पǐरभाषाएं – इस अͬधǓनयम मɅ अबतक अÛयथा अपेͯ¢त न हो –
(क) “ अͬधǓनयम’’ से अͧभĤेत है ǒबहार संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा अͬधǓनयम, 1995,
(ख) “ ͪवभाग’’ से अͧभĤेत है ǒबहार काय[पाͧलका Ǔनयमवालȣ, 1979 कȧ Ĥथम अनुसूͬचत
मɅ ǓनǑद[çट ͪवभाग,
(ग) “åयवसाǓयक पाɫयĐम’’ से अͧभĤेत है, अͧभयंता, ͬचͩक×सा ͪव£ान, दÛत ͬचͩक×सा,
फामɏसी, पशु ͬचͩक×सा ͪव£ान, कृͪष ͪव£ान, म×èय, डेयरȣ, वाǓनकȧ मɅ èनातक èतर का
पाɫयĐम तथा इसमɅ शाͧमल है सामान ĤकृǓत का कोई अÛय पाɫयĐम ,
(घ) “ͪवæवͪवɮयालय, महाͪवɮयालय एवं संèथान’’ से अͧभĤेत है, राÏय सरकार ɮवारा
संचाͧलत तथा संपोͪषत ͪवæवͪवɮयालय, महाͪवɮयालय एवं संèथान,
(ड) ''पष[द'' से अͧभĤेत है अͬधǓनयम के अधीन गǑठत ǒबहार संयुÈत Ĥवेश ĤǓतयोͬगता
परȣ¢ा पष[द,
च) “अÚय¢’’ से अͧभĤेत है, अͬधǓनयम के अधीन गǑठत ǒबहार संयुÈत Ĥवेश ĤǓतयोͬगता
परȣ¢ा पष[द का अÚय¢,

(छ) “ परȣ¢ा Ǔनयंğक’’ से अͧभĤेत है, अͬधǓनयम के अधीन ǓनयुिÈत परȣ¢ा Ǔनयंğक,
(ज) “ गुणागुण सूची’’ से अͧभĤेत है, अͬधǓनयम के अंतग[त तैयार कȧ गई गुणागुण सूची,
(झ) “Ĥवेश’’ से अͧभĤेत है, गुणागुण सूची से योÊयता-सह-ͪवकãप के आधार पर
ͪवæवͪवɮयालयɉ, महाͪवɮयालयɉ एवं संèथानɉ के åयावसाǓयक पाɫयĐम मɅ Ĥेवश|
3. åयावसाǓयक पाɫयĐम मɅ Ĥेवश- ͩकसी Ûयायालय के Ǔनण[य, ͫडĐȧ, आदेश अथवा ͩकसी
अͬधǓनयम, Ǔनयम या पǐरपğ मɅ अंतͪव[çट ͩकसी बात के ĤǓतकूल होते हुए भी अͧभयंğण,
ͬचͩक×सा ͪव£ान, दÛत ͬचͩक×सा, फामɏसी, कृͪष ͪव£ान, पशु ͬचͩक×सा ͪव£ान, म×èय, डेयरȣ,
वाǓनकȧ के èनातक èतर के पाɫयĐमɉ तथा सामान ĤकृǓत के अÛय पाɫयĐमɉ के Ĥथम वष[ मɅ
Ĥवेश संयुÈत ĤǓतयोͬगता परȣ¢ा के आधार पर ͩकया जायेगा|
(2) राÏय एवं राÏय के बाहर के ͪवæवͪवɮयालयɉ, महाͪवɮयालयɉ एवं संèथानɉ मɅ Ĥवेश के
ͧलए जहाँ राÏय सरकार से मनोनयन कȧ अपे¢ा हो, ऐसा मनोनयन संयुÈत Ĥवेश ĤǓतयोͬगता
परȣ¢ा के आधार पर ͩकया जायेगा |
4. पष[द – ǒबहार संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा पष[द एक Ǔनगͧमत Ǔनकाय होगा िजसका
शाæवत उतराͬधकार होगा, िजसकȧ एक सामाÛय मुहर होगी, और िजसे चल और अचल संपͪƣ
अिज[त करने का अͬधकार होगा तथा वह अपने नाम से वाद चला सकेगा और उस पर वाद चलाया
जा सकेगा|
5. संयुÈत Ĥेवश ĤǓतयोͬगता परȣ¢ा पष[द का गठन – संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा पष[द
का गठन राÏय सरकार ɮवारा समय– समय पर Ǔनàनͧलखत रȣǓत से ͩकया जा सकेगा|
(i) सदèय, राजèव पष[द, ǒबहार ........ अÚय¢
(ii) èवाèØय, ͬचͩक×सा ͧश¢ा एवं पǐरवार कãयाण ͪवभाग, कृͪष ͪवभाग, ͪव£ान एवं
Ĥावैͬधकȧ ͪवभाग, पशु एवं म×èय पालन ͪवभाग तथा वन एवं पया[वरण ͪवभाग मɅ से राÏय
सरकार ɮवारा Ǒहंदȣ वण[ Đमानुसार नाम Ǔनदȶͧशत आयुÈत एवं सͬचव / सͬचव èतर के
अͬधकतम दो पदाͬधकारȣ ....... सदèय

(iii) èवाèØय, ͬचͩक×सा ͧश¢ा एवं पǐरवार कãयाण ͪवभाग, कृͪष ͪवभाग, पशु एवं म×èय
पालन ͪवभाग तथा वन एवं पया[वरण ͪवभाग मɅ से राÏय सरकार ɮवारा Ǒहंदȣ वण[
Đमानुसार नाम Ǔनदȶͧशत अͬधकतम दो राÏय èतरȣय ͪवभागाÚय¢ ....... सदèय
(iv) ͬचͩक×सा महाͪवɮयालयɉ मɅ से राÏय सरकार ɮवारा Ǒहंदȣ वण[ Đमानुसार नाम Ǔनदȶͧशत
एक Ĥाचाय[ ....... सदèय
(v) राजकȧय अͧभयंğण महाͪवɮयालयɉ मɅ से राÏय सरकार ɮवारा Ǒहंदȣ वण[ Đमानुसार नाम
Ǔनदȶͧशत एक Ĥाचाय[ ....... सदèय
(vi)कृͪष, म×èय, पशु ͬचͩक×सा एवं पशुपालन, कृͪष अͧभयंğण एवं वाǓनकȧ महाͪवɮयालयɉ
के Ĥाचाय[ तथा संजय गाँधी गåय Ĥाɮयोͬगकȧ संèथान के Ǔनदेशक मɅ से राÏय सरकार
ɮवारा Ǒहंदȣ वण[ Đमानुसार नाम Ǔनदȶͧशत एक Ĥाचाय[/ Ǔनदेशक ..... सदèय
(vii) Ǔनदेशक, ͪव£ान एवं Ĥावैͬधकȧ ͪवभाग ....... सदèय-सͬचव
6. पष[द कȧ शिÈतयɉ एवं कत[åय – पष[द कȧ Ǔनàनͧलͨखत शिÈतयां कत[åय हɉगे :-
(i) ǒबहार संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा का संचालन कराना,
(ii) अͬधǓनयम के Ĥावधानɉ के काया[Ûवयन के ͧलये आवæयक Ǔनण[य लेना,
(iii) अͬधǓनयम के Ĥावधानɉ के काया[Ûवयन हेतु राÏय सरकार कȧ पूवा[नुमǓत
से ͪवǓनयम बनाना,
(iv) पष[द मɅ पदाͬधकाǐरयɉ एवं कम[चाǐरयɉ कȧ ǓनयुिÈत तथा ĤǓत ǓनयुिÈत करना,
(v) पष[द कȧ Ǔनͬध, लेखा और अंके¢ण से संबंͬधत सभी काय[ करना,
(vi) पाɫयĐम संबंधी ͪववरण पुिèतका एवं आवेदन-पğɉ के ͪवĐय मूãय तथा
परȣ¢ा शुãक से संबंधी काय[,
(vii) परȣ¢ा के ͧलये पाɫयĐम ͪवǑहत करना,
(viii) उƣर पुिèतकाओ के कूटबÚद करने (कोͫडंग) एवं कूट खोलने (ͫडकोͫडंग)
संबंधी काय[,
(ix) अͬधǓनयम के Ĥावधानɉ के काया[Ûवयन के ͧलए परȣ¢ा Ǔनयंğक को माग[दश[न देना एवं
उनके कायȾ का सामाÛय पय[वे¢ण एवं Ǔनयंğण |

7. परȣ¢ा Ǔनयंğक कȧ ǓनयुिÈत – (1) राÏय सरकार, भारतीय ĤशासǓनक सेवा के वरȣय
वेतनमान अथवा उÈत सेवा के ऊपर के वेतनमान के पदाͬधकारȣ कȧ ǓनयुिÈत संयुÈत Ĥवेश
ĤǓतयोͬगता परȣ¢ा के परȣ¢ा Ǔनयंğक के Ǿप मɅ कर सकेगी|
(2) परȣ¢ा Ǔनयंğक का काय[काल सामाÛयत: कम-से-कम एक वष[ का होगा|
8. परȣ¢ा Ǔनयंğक के काय[ – परȣ¢ा Ǔनयंğक के Ǔनàनͧलͨखत काय[ हɉगे :-
(क) Ĥæनɉ पğɉ का चयन एवं Ĥæन पğɉ तथा उƣर पुिèतकाओ का मुġण ;
(ख) परȣ¢ा केÛġɉ का चयन ;
(ग) परȣ¢ा का èवÍछ संचालन ;
(घ) Ĥæन पğɉ / उƣर पुिèतकाओ को परȣ¢ा केÛġɉ पर भेजना एवं वापस लाना, कूटबÚद
(कोͫडंग) करना एवं कूट खोलना (ͫडकोͫडंग) ;
(ड) उƣर पुिèतकाओ का मुãयांकन;
(च) परȣ¢ाफल कȧ घोषणा ;
(छ) Ĥवेश हेतु ͪवæवͪवɮयालयɉ, महाͪवɮयालयɉ एवं संèथानɉ को अनुशंसा भेजना ;
(ज) उƣर पुिèतकाओ को सुरͯ¢त रखना ;
(झ) (क), (ख), (ग), (घ), (ड), (च), (छ) एवं (ज) मɅ उãलेͨखत कायȾ के संपादन हेतु
आवæयक åयय कȧ èवीकृǓत एवं भुगतान संबंधी काय[ |
9. èथानɉ कȧ सूचना – परȣ¢ा Ǔनयंğक ɮवारा ͪवæवͪवɮयालयɉ, महाͪवɮयालयɉ एवं संèथानɉ मɅ
ͪवͧभÛन संकाय एवं ͪवषय मɅ संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा के माÚयम से Ĥवेश हेतु उपलÞध
èथानɉ कȧ सूचना Ĥ×येक वष[ ĤाÜत कȧ जायगी |
10. गुणागुण सूची –परȣ¢ा Ǔनयंğक राÏय मɅ लागू आर¢ण Ǔनयमो का अनुसरण करते हुए
ͪवǑहत रȣǓत से अßयͬथ[यɉ कȧ गुणागुण सूची तैयार करेगा|
11. Ĥवेश– åयावसाǓयक पाठयĐम के ͪवͧभÛन संकायɉ एवं ͪवषयɉ मɅ Ĥवेश, योÊयता-सह-ͪवकãप
के आधार पर गुणागुण सूची से ͩकया जायेगा|
12. अßयͬथ[यɉ कȧ èवाèØय परȣ¢ा– (1) गुणागुण सूची के अßयͬथ[यɉ कȧ èवाèØय परȣ¢ा ͪवǑहत
रȣǓत से पष[द करा सके गा अथवा ऐसे अßयͬथ[यɉ से अͬधकृत ͬचͩक×सक का Ĥमाण-पğ Ĥèतुत
करने कȧ अपे¢ा, जैसा वह उͬचत समझे, कर सके गा|
(2) परȣ¢ा Ǔनयंğक ɮवारा èवाèØय परȣ¢ा मɅ योÊय पाये गये अßयͬथ[यɉ के Ĥवेश हेतु
अनुशंसा कȧ जा सके गी|

13. Ǔनͬध और लेखा – (1)ǒबहार संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा पष[द कȧ एक Ǔनͬध होगी
िजसमɅ Ǔनàनͧलͨखत राͧश जमा कȧ जायेगी :-
(i) पाɫयĐम, आवेदन-पğ एवं अÛय सामͬĒयɉ कȧ ͪवĐȧ से ĤाÜत राͧश ;
(ii) ͪवͧभÛन शुãकɉ से ĤाÜत राͧश ;
(iii) राÏय सरकार, कɅ ġ सरकार तथा अÛय İोतɉ से समय-समय पर ĤाÜत अनुदान ;
(iv) अÛय ĤǓतयाँ ;
(2) पष[द अपनी Ǔनͬध ͩकसी राçĚȣयकृत या सहकारȣ बɇक मɅ रखेगा|
(3) पष[द राÏय सरकार को ऐसे ͪववरण, लेखा, ĤǓतवेदन और अÛय Þयोरे उपलÞध करायेगा
िजनका राÏय सरकार अपे¢ा करे |
(4) पष[द अपने उɮदेæयɉ कȧ पूǓत[ के ͧलये कɅ ġ सरकार, ͩकसी राÏय सरकार अथवा क़ानूनी
Ǔनकाय से अनुदान, ǒबÛयास और सदान èवीकार कर सकेगा|
(5) राÏय सरकार के èवाèØय, ͬचͩक×सा ͧश¢ा एवं पǐरवार कãयाण ͪवभाग, पशु एवं
म×èय पालन ͪवभाग तथा ͪव£ान एवं Ĥावैͬधकȧ ͪवभाग ɮवारा पूव[ संचाͧलत परȣ¢ाओ कȧ
अवशेष Ǔनͬध अͬधǓनयम के Ĥभावी होने कȧ Ǔतͬथ से ǒबहार संयुÈत Ĥवेश ĤǓतयोͬगता
परȣ¢ा पष[द को हèतांतǐरत हो जायेगी |
14. लेखा का अंके¢ण –(1) पष[द ĤǓत वष[ अपनी Ǔनͬध आय-åयय एवं लेखा का महालेखाकार,
ǒबहार या राÏय सरकार के अंके¢कɉ या ͩकसी चाट[ड[ एकाउंटɅट ɮवारा अंके¢ण कारयेगा|
(2) अंके¢ण के खच[ का भुगतान पष[द अपनी Ǔनͬध से करेगा|
(3) राÏय सरकार, जैसे वह उͬचत समझे, पष[द कȧ Ǔनͬध, आय-åयय एवं लेखा का अंके¢ण
महालेखाकार, ǒबहार अथवा अÛय अͧभकरण से करा सकेगी |
15. लेखा पदाͬधकारȣ – (1) पष[द का एक लेखा पदाͬधकारȣ होगा, िजनकȧ ǓनयुिÈत पष[द ɮवारा
राÏय सरकार के पूवा[नुमोदन से कȧ जायेगी |
(2) लेखा पदाͬधकारȣ पष[द का बजट तैयार करने तथा लेखा के संधारण हेतु उƣरदायी होगा|
(3) लेखा पदाͬधकारȣ अͬधǓनयम कȧ धारा 8 के अंतग[त परȣ¢ा Ǔनयंğक ɮवारा èवीकृत
सभी राͧश का भुगतान करेगा |
16. उƣर पुिèतका का सुरͯ¢त रखा जाना – संयुÈत Ĥवेश ĤǓतयोͬगता परȣ¢ा से संबंͬधत उƣर
पुिèतका परȣ¢ाफल घोͪषत होने कȧ Ǔतͬथ से एक वष[ तक सुरͯ¢त रखी जायेगी ;
परÛतु यह ͩक यǑद परȣ¢ा से संबÚद कोई वाद Ûयायालय मɅ ͪवचाराधीन हो तो
उÈत परȣ¢ा कȧ उƣर पुिèतकायɅ वाद के Ǔनçपादन तक सुरͯ¢त रखी जायेगी |

17. शिÈत का Ĥ×यायोजन – पष[द इस अͬधǓनयम के अधीन Ĥदƣ कोई शिÈत पष[द के ͩकसी
पदाͬधकारȣ या Ĥाͬधकार कȧ ऐसे Ǔनबɍधनो एवं शतȾ के अÚयधीन Ĥ×यायोिजत कर सकेगा, जैसा वह
उͬचत समझे |
18. Ǔनयम बनाने कȧ शिÈत – राÏय सरकार इस अͬधǓनयम के उपबंधो को काया[िÛवत करने के
ͧलये शासकȧय गजट मɅ अͬधसूचना जारȣ कर Ǔनयमावलȣ बना सकेगा|
19. कǑठनाइयाँ दूर करना – इस अͬधǓनयम के उपबंधो को काया[िÛवत करने मɅ उ×पÛन ͩकसी
कǑठनाई को दूर करने के ͧलये राÏय सरकार ऐसा आदेश कर सकेगी जो इस अͬधǓनयम के
उपबंधो से असंगत न हो |

Ǔनàनͧलͨखत अंĒजी अनुवाद ǒबहार राÏयपाल के Ĥͬधकार से इसके ɮवारा Ĥकाͧशत ͩकया जाता है,
िजसे भारतीय संͪवधान के अनुÍछेद 348 के खंड (3) अधीन उÈत अͬधǓनयम का अंĒजी भाषा मɅ
उसका Ĥाͬधकृत पाठ समझा जायगा |

THE BIHAR COMBINED ENTRANCE COMPETITIVE
EXAMINATION ACT, 1995.
AN
ACT
To Provide for Combined Competitive Examination for entrance in
graduate level vocational course of the Universities, Colleges and Institutions in the
State.
Be it enacted by the legislature of the State of Bihar in the forty sixth
year of the Republic of India as follow:-
1. Short title, extent and commencement.- (1) This Act may be called the Bihar
Combined Entrance Competitive Examination Act. 1995.
(2) It shall come into force from the date as the State Government by
notification in the Bihar Gazette may appoint.
(3) It shall extend to the whole of the State of Bihar.
2. Definitions.-In this Act unless otherwise required in the context:-
(a) "Act" means the Bihar Combined Entrance Competitive Examination Act, 1995;
(b) "Department" means the department referred to in the first schedule of the
Rules of Executive Business, Bihar, 1979;
(c) "Vocational Course" means a course in engineering, medical science, dentistry,
pharmacy, veterinary science, agriculture science, fishery, dairy, forestry of
the graduate standard and includes any other course of the same nature;
(d) "University, college and institute" means any University, college and institute
managed and maintained by the State Government;
(e) "Board" means the Bihar Combined Entrance Competitive Examination Board
constituted under the Act:

(f) "Chairman" means a Chairman of the Bihar Combined Entrance Competitive
Examination Board constituted under Act;
(g) "Controller of Examination" means Controller of Examination appointed
under the Act;
(h) "Merit list" means a merit list prepared under the Act;
(i) "Entrance" means entrance in vocational course of the Universities, College
and Institutions on the basis of merit- cum- option from the merit list.
3. Admission in Vocational Courses.- (1) Not withstanding anything to the
contrary contained in any decision, decree, order of any court or in any Act,
rule or circular, the admission in the first year of the graduate standard of
Engineering, Medical Science, Dentistry, Pharmacy, Veterinary Science,
Agriculture Science, Fisheries, Dairy, Forestry and other courses of same
nature shall be made on the basis of the combined Entrance Competitive
Examination.
(2) Nomination for the admission in the Universities, Colleges and Institutes
within the state and outside the state where such nomination is required to
be made by the State Government, shall be made on the basis of the
Combined Entrance Competitive Examination.
4. The Board .- The Bihar Combined Entrance Competitive Examination Board
shall be a body corporate which shall have a perpetual succession and a
common seal and it shall have the right to acquire the movable and
immovable properties and may sue and be sued in its name.
5. Constitution of Combined Entrance Competitive Examination Board- The
State Government shall constitution the Combined Entrance Competitive
Examination Board from time to time in the following manner:-
(i) Member , Board of Revenue, Bihar - Chairman.
(ii) Maximum two officers of the rank of Commissioner and Secretary to be
nominated by the State Government in Hindi alphabetical order from
amongst Health, Medical Education and Family Welfare Department,
Agriculture Department, Science and Technology Department, Animal
Husbandry and Fisheries Department and Forestry and Environment
Department - Member.

(iii) Maximum two State level Head of the Department to be nominated by the
State Government in Hindi alphabetical order from amongst Health , Medical
Education Family Welfare Department, Agriculture Department, Animal
Husbandry and Fisheries Department and Forest and Environment
Department -Member .
(iv) A Principal to be nominated by the State Government in Hindi alphabetical
order from the Medical Colleges - Member.
(v) A Principal to be nominated by the State Government in Hindi alphabetical
order from the Government Engineering Colleges - Member.
(vi) A Principal/ Director to be nominated by the State Government in Hindi
alphabetical order from the Principals of Colleges of Agriculture , Fisheries,
Veterinary and Animal Husbandry, Agricultural Engineering and Forestry and
the Director of the Institute of Sanjay Gandhi Dairy Technology - Member.
(vii) Director, Department of Science & Technology - Member Secretary
6. Powers and duties of the Board - The following shall be the powers and duties
of the Board;
(i) To conduct the Bihar Combined Entrance Competitive Examination;
(ii) To take necessary decisions for the implementations of the provision of the
Act;
(iii) To make regulation, with the prior permission of the State Government for
the implementation of the provisions of the Act;

(iv) To make appointments and deputation of officer and employees in the Board;
(v) To perform all functions relating to the fund, account and audit of the board;
(vi) To fix the sale price of the prospectus and application from and
determination of the Examination fees;
(vii) To prescribe Courses of studies for the examination;
(viii) Works relating to coding and decoding of Answer Books;
(ix) To issue guidelines to the Controller of Examinations for the implementation
of the provision of the Act and to have General Supervision and Control over
his work.
7. Appointment of Controller of Examination. - (1) The State Government shall
appoint an Officer of Indian Administrative Service in the Senior pay scale or
higher pay scale as the Controller of Examination for the Combined Entrance
Competitive Examination.
(2) The Tenure of the Controller of Examination shall be normally of one year
minimum.
8. Function of the Controller of Examination - The function of the Controller of
Examination shall be the following :-
(a) The setting of the question papers and printing of the question papers and
answer books;
(b) Selection of the Examination Centres;
(c) Fair conduct of the Examination;
(d) Dispatch and receipt of question papers/answer books to and from the
examination centres and their coding and decoding;
(e) Evaluation of answer books;
(f) Declaration of result of the Examination;
(g) Sending recommendation for admission to Universities, Colleges and Institutes;
(h) Safe custody of answer books;
(i) Sanction and payment of expenditure for the works mentioned above in (a),
(b), (c), (d), (e), (f), (g), and (h).

9. Information of Seats.- The Controller of Examination Shall obtain information
every year regarding the available seats in different faculties and subjects in
Universities, Colleges and Institutes to be filled by the Combined Entrance
Competitive Examination.
10. Merit list.- The Controller of Examination shall prepare a merit list of candidates
in the prescribed manner accordance with reservation policy of the State
Government.
11. Admission. - Admission in different faculties and subjects of vocational course
shall be taken from the merit list on the basis of merit- cum- option.
12. Medical Examination of the Candidates: -(1) The Board may, as it thinks proper,
require the Medical Examination of candidates from merit list to be done in the
prescribed manner or require for the production of medical certificate of such
candidates from the authorised practitioner.
(2) The Controller of Examination shall recommend for admission of the
candidates found fit in the medical test.
13. Funds and Accounts.- (1) The Bihar Combined Entrance Competitive
Examination Board shall have fund in which the following shall be deposited-
(i) The Sale - proceeds of prospectus, Application Form and other materials;
(ii) The amount collected from different fees;
(iii) The Grants received from time to time from the State Government the
Central Government and other sources;
(iv) Other receipts.
(2) The Board shall deposit its fund in any Nationalised or Co-operative Bank.
(3) The Board shall furnish such statements, Accounts, Reports and other details as
required by the State Government.
(4) The Board may accept the grants, funds and aid from Central Government, any
State Government or Statutory body to fulfil its aims and objects.

(5) The balance fund of examination conducted previously by the Health, Medical
Education and Family Welfare Department, Animal Husbandry and Fisheries
Department and Science and Technology Department of the State Government shall
stand transferred to the Bihar Combined Entrance Competitive Examinations Board
from the date of the Act comes into force.
14. Audit of Accounts. - (1) Every year the Board shall cause its fund, Income
expenditure and Accounts audited by the Accountant- General , Bihar or Auditors of
the State Government or any Chartered Accountant.
(2) The Board shall pay the cost of audit from its own fund.
(3) The State Government, as it may deemed fit, cause the funds, Income
Expenditure and Accounts of the Board to be audited by the Accountant- General,
Bihar or any other agency.
15. Account Officer.- (1) There shall be an Accounts officer of the Board, who shall
be appointed by the Board with the prior approval of the State Government.
(2) The Accounts Officer shall be responsible for preparation of the Budget and for
maintenance of Accounts of the Board.
(3) Accounts Officer shall make all the payments of amounts sanctioned by the
Controller of Examination under section 8 of the Act.
16 . Safe Custody of Answer Books.-The answer books of the Combined Entrance
Competitive Examinations shall be kept in safe custody for a period of one year from
the date of the declaration of the result:
Provided that if a case relating the Examination is pending in a court, the
answer book of the said Examination shall be kept in safe custody till the disposal of
the case.

17. Delegation of Powers.- The Board may delegate any of its powers,
conferred under the Act to any officer of the Board or authority subject to such
terms and conditions as it may deem fit.
18. Power to make rules. – The State Government may by notification in the
official Gazette, make rules to carry out the provisions of the Act.
19. Removal of Difficulties. – For the removal of any difficulty arising in the
implementation of the provisions of this Act the State Government may pass such
orders as are not inconsistent with the provisions of this Act.
