THE UTTAR PRADESH MUNICIPALITIES, NOTIFIED AREAS AND
TOWN AREAS (ALPAKALIK VYAVISTHA) ADHINIYAM, 1994
[U.P. Act No. 8 of 1994]
AN
ACT
to provide for certain temporary arrangements for the administration of certain
Municipalities, Notified Area and Town Areas of the State
It is hereby enacted in the Forty-fifth Year of the Republic of India as follows:-
Short title 1. (1) This Act may be called the Uttar Pradesh Municipalities, Notified Areas and
Town Areas (Alpakalik Vyavastha) Adhiniyam, 1994.
(2) It shall be deemed to have come into force on January, 1994.

2. (1) With effect from the 19 th day of January, 199 4, the provisions of the U.P.
Municipalities Act, 1916 (U.P. Act No. 2 of 1916) hereinafter in this section
referred to as the said Act, shall until May 31, 1994 or until the reconstitution
of the Municipal Boards under the provisions of the said Act, whichever is
earlier, have effect in relation to the Munici palities specified in Schedule 1
subject to the following provisions, namely:-
(a) notwithstanding anything in the said Act, all members of the
Municipal Board including the president shall cease to hold their respective
offices;
(b) all powers, functions and duti es of the Municipal Board, its President
and committees shall be vested in and be exercised, performed and discharged
by the District Magistrate, and the District Magistrate [including the person or
authority to whom the District Magistrate delegates his p owers under sub -
section (2) of section 4] shall be deemed to be the Municipal Board, its
President or the committee concerned, as the occasion may require.
(2) With effect from the 19 th day of January, 1994, the provisions of the said Act
shall until May 31, 1994 or until the reconstitution of the Notified Area
committee under the provisions of the said Act, whichever is earlier, have
effect in relation to each of the Notified Areas subject to the following
provisions; namely:-
(a) notwithstanding anything i n the said Act, the President and all
members of the Notified Area committee shall cease to hold their respective
offices;
(b) all powers, functions and duties of the Notified Area Committee
and its president shall be vested in and be exercised, performed and
discharged by the District Magistrate, and the District Magistrate [including
the person or authority to whom the District Magistrate delegates his powers
under sub-section (2) of section 4] shall be deemed to be the Notified Area
Committee or its Chairman, as the occasion may require.

Temporary

Town Areas Act, 1914 (U. P. Act No. 2 of 1994) , hereinafter in this section

of the town Area Committees under the provisions of the sai d Act whichever
is earlier, have effect in relation to the Town Area subject to the following
provisions, namely:-
(a) notwithstanding anything in the said Act, the Chairman and all members of
the Town Area Committee shall cease to hold their respective offices;
(b) all powers, functions and duties of the Town Area Committee and its
Chairman shall be vested in and be exercised, performed and discharged by
the District Magistrate and the District Magistrate [including the person or
authority to whom the District M agistrate delegates his powers under sub -
section (2) of section 4] shall be deemed to be Town Area Committee or its
Chairman as the occasion may require.
Additional
Provisions
4. (1) The provisions of this Act shall also apply where a Municipal Board, Notif ied
Area Committee or Town Area Committee had already been dissolved or
superseded under any other provisions of the relevant Act and such
dissolution or supersession was in force immediately before the 19 th day of
January 1994.
(2) Subject to any general or s pecial orders of the State Government, the District
Magistrate may in respect of all or any of the powers conferred on him by
clause (b) of sub-section (1) or clause (b) of sub-section (2) of section 2, or by
clause (b) of section 3 delegate, subject to such conditions as he may think fit,
to impose, the powers so conferred, to any one or more person or authority to
be specified by him in that behalf.
(3) The State Government may from time to time by notification make such
incidental and consequential order fo r the removal of any difficulty as may
appear to it to be necessary or desirable for any of the foregoing and
connected purposes.
(4) Every notification issued under sub -section (3) shall, as soon as may be after
it is issued, be laid before each House of the State Legislature while it is in
session, for a total period of not less than thirty days extending in its one
session or more than one successive sessions, and shall unless some later date
is appointed, take effect from the date of its publication in the Gazette, subject
to such modifications or annulments as the two Houses of the Legislature may
during the said period agree to make so, however, that any such modification
or annulment shall be without prejudice to the validity of anything previously
done thereunder.
Repeal and
savings
5. (1) The Uttar Pradesh Municipalities, Notified Areas and Town Areas (Alpakalik
Vyavastha) Adhiniyam, 1977 and the Uttar Pradesh Municipalities, Notified
Areas and Town Areas (Alpakalik Vyavastha)) Adhyadesh , 1994 are hereb y
repealed.
(2) Notwithstanding such repeal anything done or any action taken under the said
Adhyadesh shall be deemed to have been done or taken under this Act as if
