The University and its Obiects
The Sponsor shall have the right to establish the Universily in accordance with the
orovisions ot this Act.

Governmont to be fulfilled befor€ the establishment oi the University.
(1) Wherethe State Government, aftersuch inquiry as it may deem necessary,
is satistied that the Sponsor has futfilted the conditions ;pecified in sub"
section (2) of Section 3, it may direct the Sponsor, to establish an
endowmenl Ilrnd-
(2) After the establishment of lhe endowmeni lund, the State Government may,
by notification in the Oifjcial Gazette, accord sanction for eslablishment;
the Universiiy.
(3) The headquarters oi University shall be in Sikkim and it may have campuses, or Flegional Cenkes, Siudy Centres anywhere in lndia and abroad with
_ approval ol the Board ot Governors.
(1) The Chanceltor, the Vice-Chancellor, membsrs of the Board of Governors,' members of the Board of L4anagement and the Academic Council for the
time being holding otfice as such irl the University so established, shalconstitute a body corporate and can sue and be sued in the name oJ the. University. '
(5) On the establishmeni of the Univetsity under sub_seciion (2), the tand andother movable and immovable properiies acquired, creaied,' arran ged orbuilt by the University'ror the purpose of the University in the btate o'i Sikkimshall vest in the Universitv

Teachers' Training programs and Law Education Program tespectively Jor

As regards other programs on technicat educalion the relevant laws, rules,
reguiations etc. in the rnatterofobtaining approval/recognition or majntaining
standards shall apply io the Universily.

11. The following shall be ihe ofticers of the University, namely t-

(b)The Vice-Chancetlor;

(e)Such other offices as may be declared bythe Statutes to be of{icers ofthe Universiiy.
12. (1) The covernor of Sikkim will be the Visitor of the lJniversity.
(2) Ihe Visiior shall, when present, preside aithe convocation oi the University for.
conferring 0egrees, Diplomas, Charters, Designations and Cenificates.
(3) Ihe Visitor shal{ have the fo owing powels, namety :.
(a) To calt lor any paper or information relaling to fie affajrs of the University.
(b) On the basis ofthe information received by lhe Visitor, if he is satisfied that
any order, proceeding, or decision taken by any authority otthe University is
. nolin conformity with lheAct, Regulations, or Rules, he_ mayissuesuch,
directions as he may deem fit in lhe iriterest of the University and tho
directions so issued shalt be complied with by all concerned.
13. (1) The Sponsor shall, whh the prior aoprovat ot the Visjtor, appoint a person su:tabte
to be appointed as the chanceltor of.the university.
(2) The Chancettor so appointBd sha[ hold the office ior a period of flve years.
(3) The Chancelior shall be the head of the Universiiy.
(4) ThB Chanqellor shall preside at the mdeting of the Board ol Governors and shall,
when lhe Visitor is not present, prestde at the convocation ofthe University for
conferring degrees, diplomas, Charters, Designaiions or Certificates.

14.(1) The Vice-Chance or shall be appointed on such terms and conditions as mav be
prescribed by ihe Statutes for a term of lour years by the Chancellor.
(2) The Vice-Chancellor shail be appojnted by the Chancellor jrom a panel of lhree
persons recommended bythe'Board of Governors and shallhold oifice for a term of
lour years :
Providedthal, afier expiration of the tern of four years, the vice-chancelrorshal be
eligible for re-appointment ior another tern not exceeding iour years.

Provided that il in the opjnion of the concerned authority such action sho!ld nothave been taken by the Vice_Chancellor,then s!ch case sha be reierred to theChancellor, whose decision thereon sha| be linal.

49. Every Statute or rules made under this Act shall, as soon as may be after it is rnade,
be laid before ihe Staie Legislature.
50. (1) lf any diificulty arises ln giving eflect to the provisions of this Act, the State
' Government may, by a notification orolder, make such provisions, not lnconsistent
wilh the provisions ol this Act, as appear to it to be necessary or expedient, for
removing the diiliculty :
Provided that no notification, order under sub_section (1) shall be made alter the
explration of a period oi ihree years irom the commencement of this Act
(2) Every order made under sub'section (1) shall, as soon as may be atter ii is made,
be aid betore the State Legislature.
