[Published in the Nagaland Gazette-Extraordinary, Dated the 30th March, 1964.] An Act to determine the salaries and allowances of the Ministers, Ministers of State, Deputy Ministers, and Parliamentary Secretaries. Preamble.- WHEREAS it is expedient to determine the salaries and allowances of the Ministers, Ministers of State, Deputy Ministers, and Parliamentary Secretaries ; It is hereby enacted in the Fifteenth Year of the Republic of India as follows :- Short title and commencement.-1. (1) This Act may be called the Nagaland Ministers’ Salaries and Allowances Act, 1964. (2) It shall be deemed to have come into force with effect from 25th January, 1964. Definition- In this Act, unless the context otherwise requires, a “Minister” means the Chief Minister, a Minister, a Minister of State, a Deputy Minister, and a Parliamentary Secretary. Salaries of Ministers.-2. There shall be paid : (a) to the Chief Minister, a salary of rupees one thousand and five hundred per mensem. (b) to each Minister, a salary of rupees one thousand per mensem. (c) to each Minister of State, a salary of rupees eight hundred per mensem. (d) to each Deputy Minister, a salary of rupees seven hundred and fifty per mensem. (e) to each Parliamentary Secretary, a salary of rupees six hundred per mensem. Residence of Ministers- 3. (1) Every Minister shall be provided with a free-furnished residence with grounds appurtenant thereto, in Kohima throughout the year, and also at any other place which the State Government may, from time to time, for the purpose of this Act declare to be the headquarters of Government, for so long as each such declaration remains in force. (2) Such residence and the grounds appurtenant thereto, shall be maintained at the public expense which shall not exceed the amount prescribed by rules : Provided that if the Chief Minister, a Minister, Minister of State, Deputy Minister, Parliamentary Secretary, does not occupy the free furnished residence provided by the Government, a house rent allowance at the rate of rupees two hundred and fifty per mensem in the case of Chief Minister, at the rate of rupees two hundred and fifty per mensem in te cae of a Minister and Minister of State, at the rate of rupees two hundred per mensem in case of a Deputy Minister and at the rate of rupees one hundred and fifty per mensem in the case of a Parliamentary Secretary and such service allowances as may be prescribed by rules shall be paid in lieu of such residence. Explanation.- For the purpose of this section the expression “the public expense” shall include such expenses as may be prescribed by rules. Conveyance and conveyance allowances for Ministers.- 4.(1) The State Government may, from time to time, purchase and provide suitable conveyances for the use of every Minister and may by rule provide for their maintenance and repair. (2) The Chief Minister, every Minister, Minister of State and Deputy Minister shall further be entitled to a conveyance allowance of rupees two hundred and fifty per mensem and every Parliamentary Secretary shall be entitled to a conveyance allowance of rupees [two hundred only per mensem]1 : Provided that if any person so entitled hereinbefore chooses to maintain his own car such person shall be entitled to a conveyance allowance of rupees three hundred per mensem. 1. Substituted vide Nagaland Act 11 of 1969 w.e.f. 1-9-69. Prohibition against practicing any profession or drawing salary as member during the tenure of the office as Minister- 5. A minister shall not during the tenure of his office for which he draws salary and allowances – (a) practice any profession or engage in any trade or undertake for remuneration any employment other than his duties as Minster ; or (b) be entitled to any salary or allowances as a member of the Legislative Assembly. Use of free-furnished residence and Government conveyance on relinquishing office. – 6. A Minister shall be entitled to the privilege of the use of the free furnished residence and Government conveyance on his ceasing to hold office for such period as prescribed by rules. Travelling and daily allowances.-7. Every Minister shall be entitled, while touring on public business, to traveling and daily allowances at such rates and on such conditions as may be prescribed by rules. Medical attendance and treatment.-8. A Minister shall be entitled free of charge to accommodation in hospitals maintained or approved in this behalf by the Government and also to free medical treatment. Explanation.- For the purpose of this section, a ‘Minister’ shall include his wife, his children, step-children, minor brother and parents wholly dependent on him. Entertainment allowance.- 9. The Chief Minister shall be entitled to an entertainment allowance of rupees five hundred per mensem, a Minister and Minister of State to an entertainment allowance of rupees three hundred and fifty per mensem, a Deputy Minister to an entertainment allowance of rupees two hundred and fifty per mensem and a Parliamentary Secretary to an entertainment allowance or rupees one hundred and fifty per mensem. Power to make rules.- 10. (1) The State Government may, by notification in the Official Gazette, make rules for carrying out the purpose of this Act. (2) All rules made under this Act shall be laid before the Nagaland Legislative Assembly, as soon as may be, after they are made and shall be subject to such modifications as the Legislative Assembly may make.
