Open in Lexace · Ask the AI about this actNAGALAND ACT 3 OF 1964 [THE NAGALAND CONTINGENCY FUND ACT, 1964] Received the assent of the Governor on the 4th April, 1964 [Published in the Nagaland Gazette-Extraordinary, Dated 24th April, 1964.] An Act to establish a Contingency Fund of the State of Nagaland and to provide for advances to be made out of it for the purpose of meeting unforeseen expenditure Preamble:- WHEREAS it is expedient to establish a Contingency Fund of the State of Nagaland in the nature of an imprest to be placed at the disposal of Governor to enable advances to be made by him out of this Fund for the purpose of meeting unforeseen expenditure pending authorization of such expenditure by the Legislature by law under Articles 205 and 206 of the Constitution of India ; It is hereby enacted in the Fifteenth Year of the Republic of India as follows :- Short Title, extent and commencement.-1. (1) This Act may be called the Nagaland Contingency Fund Act, 1964. (2) It extends to the whole of Nagaland. (3) It shall come into force from 1st April, 1964. Establishment of a Contingency Fund.-2. (1) A Contingency Fund in the nature of an imprest shall be established and shall be entitled the Contingency Fund of the State of Nagaland hereinafter called the Contingency Fund. (2) The Fund shall be held on behalf of the Governor by the Secretary to the Government of Nagaland in the Finance Department, and no advance shall be made out of such Fund except for the purpose of meeting unforeseen expenditure pending authorization of such expenditure by the Legislature under appropriations made by law. Payment into the Contingency Fund.-3. There shall be paid by the State Government into the Contingency Fund, a sum of Rupees thirty-five lakhs out of the Revenues of the State for the financial year 1964-65. Expenditure met from Contingency Fund to be paid before Legislature for authorization.-4. All expenditure met out of advances from the Fund made in the aforesaid manner shall be laid before the Legislature for authorization within the financial year in which such advances are made. Power to make Rules.-5. (1) The State Government may make rules to carry out the purpose of this Act. (2) All rules made under this Act shall be paid before the Nagaland Legislative Assembly, as soon as may be, after they are made and shall be subject to such modifications as the Nagaland Legislative Assembly may make.
