(Act No. 2 of 2017) (Received the assent of the Governor of Mizoram on the 23rd March, 2017) VOL - XLVI Aizawl, Wednesday 5.4.2017 Chaitra 15, S.E. 1939, Issue No. 154 THE MIZORAM (LAND ACQUISITION, REHABILITA TION AND RESETTLEMENT) (AMENDMENT) ACT, 2017. AN ACT to amend the Mizoram (Land Acquisition, Rehabilitation and Resettlement) Act, 2016 (Act No. 5 of 2016). It is enacted by the Legislative Assembly of Mizoram in the Sixty-Eight year of the Republic of India as follows, namely : 1. Short title, extent : (1) This Act may be called the Mizoram (Land Acquisition, Rehabilitation and commencement and Resettlement) (Amendment) Act, 2017. (2) It shall have the like extent as the Principal Act. (3) It shall commence from the date of its publication in the Mizoram Gazette. 2. Amendment of : In section 3 of the Principal Act, after clause (f) of sub-section (1), new Section 3 provisos shall be inserted, as follows, namely :- - 2 -Ex-154/2017 βProvided that the Government may also acquire land for the aforementioned purposes by negotiation with the land holder, subject to the provisions of this Act and rules made thereunder. Provided further that on every instance of purchase of land under this sub- section, the terms and condition of the negotiation shall invariably cover all costs of the land and properties therein including claim or disclaim for rehabilitation and resettlement. Provided also that the sale deed executed under this section shall not be necessary for registration under the Registration Act, 1908.β 3. Amendment of : Section 9 of the Principal Act shall be amended as follows, namely :- Section 9 β9. Exemption from Social Impact Assessment. βWhere land is proposed to be purchased under sub-section (1) of section 3 and the rehabilitation and resettlement entitlement is disclaimed by the land holder, or acquired invoking the urgency provisions under section 40, the Government may exempt undertaking of the Social Impact Assessment Study.β Secretary, Law & Judicial Department, Govt. of Mizoram.
