AMENDING ACT

[12th April', 1954)
An Act to provide for the supply of unclaimed bodies of deceased persons to
hospitals and medical and teaching institutions for the purpose of anatomical
examination and dissection.
Whereas it is expedient to provide for the supply of unclaimed bodies of deceased
persons to hospitals and medical and teaching institutions for the purpose of anatomical
examination and dissection;
It is hereby enacted as follows: * . - *
Statement of Objects and Reasons.—For the teaching o f medicine and surgery,
dissection and postmortem examination of dead bodies are essential. It is, therefore,
necessary that medical institutions are ensured an adequate supply of dead bodies. But
in the absence of some legal sanction, the utilization by medical institutions of dead
bodies even in cases in which there are no known relatives, is attended with risk. The
Bill is designed to remove the difficulty. ,

(2) It extends to the whole of .'[Madhya Pradesh],
2 t(3) It shall be in force in all such areas of Madhya Pradesh in which it was in
force Immediately before the commencement of the Madhya Pradesh Extension of Laws
Act, 1958 (23 of 1958) and shall come into force in such Other areas and on such
dates? as the State Government may, by notification in the official Gazcriev direct].

2. Dpfipitlons.—In this Act, unless there is anything repugnant in the subject or
context,—
(a) “approved institution*’ means a hospital or a medical of teaching
institution appro vetTby the State Government ttTearry on anatomical

(b) “authorized officer” means an officer authorized by the State
Government to perform the functions of an unauthorized officer under
this Act;
(c) “prescribed” means prescribed by rules and under *his Act;
(d) “unclaimed body" means the body of a deceased person which is not
claimed by any of his near relatives or by any person of his caste,
creed and religion within such time as may be prescribed,

3, Doubt or dispute as to unclaimed bbdy to be referred to officer appointed
by State Government.—If any doubt or dispute arises, whether the body of any
deceased person is an unclaimed body, the matter shall be referred to such officer as
the State Government may, by notification, appoint for any area in this behalf'and the
decision of such officer shall be final and conclusive.
4. Power of State Government to authorize officers to act under Section 5.—
The State Government may, by notification authorize for the area or any part, thereof
In which this Act comes into force one or more officers to whom a report shall be
made under Section 5 and who shall be competent to Act under the said section.
^ 5* Unclaimed bodies to be used for anatomical examination.—(l ) Where a
person under, treatment in a hospital whether established by or vesting in, or maintained
by the State Government or any local authority, dies in such hospital and his body is
unclaimed, the authorities in charge of such hospital shall with the least practicable
delay report the fact to the authorized officer ad such officer shall then hantTogcr Jt}tv

(2) Where a person dies at a hospital other than a hospital referred to in
v ;a*section (1) or in a person and his body is unclaimed, the authorities in charge of
■ v /.'fh ' hospital or person shall with the least practicable delay report the- fact to the
. thorized officer and the said officer shall hand-over the unclaimed body to the authorities
charge of an^upproved institution for the purpose specified in sub-section (1).

(3) Where a person having no permanent place of residence in th e* , area where
V'i death has taken place dies in any public place in such afea and -Jiis body is
Claimed, the authorized officer-shall take possession of tht body and shall hand it
er to the authorities in charge of an approved institution for the purpose specified
:sab-section (1). -
6. Penalty.—Whoever disposes of, or abets the disposal of, an unclaimed body
vc as permitted by this Act or obstructs any authority in charge of an approved
iiitution or an authorized officer from handing over, taking possession of? removing
using, such body for the purpose specified in the Act, shall, on conviction be
wished with fine which may extend to five hundred rupees.

7. Dutyof police arid oth er officers to assist in obtaining possession of
icl&imed bodies.—Aii officers of the Depatments of Police and Public-Health and
i officers in the employ of a local authority and all village officers shall; be bound
■take all reasonable measures to assist any authority or officer authorizetfunder this
tl to obtain the possession of an unclaimed body. .
8. Protection of persons acting under Act.—No suit, prosecution or^other legal
oceedings shall be against any person for anything which is in good faith done or
tended to be done under this Act. ,
9. Officers to be public servants.—All officers appointed or authorized to act.
■ ider this Act shall be deemed to be public servants within the meaning of
xtion 21 of the Indian Penal Code (XLV of 1860).
10. Rules.—(1) The Slate Government may, be notification, mak^ rules for
trrying out the purposes of this Act. '?m ■ '
(2) In particular and without prejudice to the generality of the foregoing power

(a) the time within which the body of. a deceased person may be-claimed;

THE MADHYA PRADESH ANATOMY RULES, 1966
N otification No. 5580-1593-XVII-Med. IV, dated 24th December, 1966.—In
exercise of the pow ers conferred by Section 10 of the Madhya PradesbAnatomy Act, ‘
1954 (N o. 15 of 1954), the State Government hereby makes th* following rules,
nam ely:—
1. These rules may be called The Madhya Pradesh Anatomy Rules, 1966.
2. In these rules, unless the context otherwise requires,—
(a) “Act” means the Madhya Pradesh Anatomy Act, 1954.
(b) “Unclaimed deaa body” means the body of a deceased person which
is not claimed by any of his near relatives or by any person of his
caste, creed and religion within 72 hours of his death.
3. (I) Every officer and servant of the Police, Medical and Public Health
Department, every officer and servant in the Service of a local authority and every
village officer and servant who comes to know of the death of any person in the service
of a local authorlv and every village officer and servant in any public place in any
area in which he has no permanent place of residence shall report the fact to the officer-
in-charge of the nearest Police Station with the least practicable delay.
(2) On receipt of the report under subrrule (1) the officer-in-charge of the Police
Station shall immediately make arrangement for the removal of the dead body to the
hospital for preservation from decay and also report the fact to the authorised officer.
(3) Notwithstanding anything contained in sub-rule (2), it shall be the duty of
the Patel or Sarpanch of the village in or near which the dead body may be found to
arrange for the removal of the dead body to the nearest hospital for preservation from
decay and also to report the fact to the officer-in-charge of the nearest Police Station.
(4) The bills for the cost of removal of the dead body to the hospital shall be
sent to the officer-in-charge of the hospital concerned which shall be paid by him. The
said officer shall also inform the authorised officer of the dead’ body having been
brought to the hospital in his charge and of its preservation.
4. (1) Where a person dies in a hospital or in a person the officcr-in*charge of
such hospital or prison shall immediately report the fact to the nearest relative
mentioned in the records of the patient or prisoner. If the said relative does not claim
the body within 72 hours, the dead boey shall be disposed off in the_manner laid down
in Section 5 ot the Act.

(2) lending receipt of the claim, if any, in pursuance of sub-rule (1) the dead
[y shall be removed to the hospital or the teaching medical institution, as the case
be, for preservation from decay.
(3) If^such body is not claimed within the period specified in sub-rule (l) the
authorised officer shall proceed to dispose of the body in the manner laid down in
Section 5 of the Act. . •
(4) If any of the approved institutions docs not require the dead f ody for the
anoatomicJ examination and dissection, the authorised officer concerned shall deliver
it to the rightful claimant or if no such claim is forthcoming, dispose of the dead body
by cremation or burial, as the case may be.

5. JThe person intending to dedicate his dead body for the purpose of anatomical j
exami nation ~and dutscction shall inform of his:intention in w ritingto theAuthorised
officer ot the district concerned. The authorised officer shall maintain a record ot^ail
such dedications in the form appended to these rules. . i
6. (1) Any matter under Section 3 of the Act relating to any doubt or dispute in
respect of a dead body shall be .warred to the officer appointed thereunder, by an \
application in writing and shall be delivered personally to the said officer. ■
(2) On receipt of the application under sub-rule (1) the officer appointed under \
Section 3 ^f the Act shall immediately fix a date for hearing within two days of the j
receipt of such reference and inform the parties accordingly.
(3) After hearing the parties concerned, the officer appointed by the State .
Government under Section 3 of the Act may make such further enquiry as he may. i
think proper and fit to dispose of the case and shall give his decision on the date of j
hearing and his decision shall be final and conclusive. ;
7. The authorised officer shall make arrangement for the preservation of unclaimed . J
dead hodies in ir r mouituarv coHer so as to preserve it from decay until —
(a) a decision has bem taken under Section 3 of the Act; or
(b) it is handed over to his relative, friend or servant; or
(c) it is handed over to a medical institution for anatomical examination [
or dessection. ■ ■ I
8 / Nothing contained in these rules shall apply to cases where death has taken,
place under supicious circumstances and the body is requited for medico-legal
examination. In such case, if die Police have not taken possession of it themselves,
the body shall be handed over to the Police. -

e Provided that anything done or any action taken under any of-jhe rules so
j repealed shall, unless such thing or action inconsistent with any of the provisions of
o these rules, be deemed to have been done or taken under the corresponding provisions
