Ĥèतावनाः- झारखÖड राÏय क े देवघर एवं बासुकȧनाथ (दुमका) क े बाबा बैƭनाथधाम एवं बासुकȧनाथ धाम तीथ[ ¢ेğ
सǑहत Įावणी मेला क े ǒवकास, ǒविनयमन और Ĥबंधन हेतु Ĥािधकार का गठन करने क े िलए अिधिनयम ।
झारखÖड राÏय क े देवघर एवं बासुकȧनाथ (दुमका) मɅ धािम[क एवं सांèकृितक मेला ‘‘Įावणी मेला’’ का आयोजन Ĥित वष[
होता है ǔजसमɅ èथानीय लोगɉ क े साथ-साथ देश एवं ǒवदेश से भी लाखɉ कȧ संÉया मɅ लोग भाग लेते हɇ। इसक े अितǐरƠ सालɉ
भर बड़ȣ संÉया मɅ तीथ[ याğी भी इन तीथ[ èथलɉ क े ħमण पर आते हɇ। राÏय सरकार Ʈारा यह आवæयकता महसूस कȧ गयी है
Ǒक ǑहÛदȣ मास Įावण (जुलाई-अगèत) मɅ Ĥित वष[ राÏय मɅ आयोǔजत बाबा बैƭनाथ धाम एवं बासुकȧनाथ धाम तीथ[ ¢ेğ
सǑहत Įावणी मेला क े ǒवकास, ǒविनयमन एवं Ĥबंधन हेतु एक Ĥािधकार का गठन Ǒकया जाय, ǔजसमɅ सरकारȣ एवं गैर-
सरकारȣ सदèयɉ कȧ भागीदारȣ हो।

झारखÖड ǒवधानसभा Ʈारा भारत क े गणतंğ क े िछयासठवɅ वष[ मɅ अिधिनयिमत Ǒकया जाता है ।
अÚयाय-1
1. संǔ¢Ư नाम, ǒवèतार एवं Ĥारàभ -
(1) यह अिधिनयम बाबा बैƭनाथधाम-बासुकȧनाथ तीथ[ ¢ेğ ǒवकास Ĥािधकार अिधिनयम, 2015 कहा जा सक े गा।
(2) इसका ǒवèतार मंǑदर Ĥांगण सǑहत सàपूण[ बाबा बैƭनाथधाम ¢ेğ, बासुकȧनाथधाम मंǑदर Ĥांगण, देवघर तथा
दुमका (बासुकȧनाथ) ǔजला का मेला ¢ेğ तथा कोई अÛय ¢ेğ जो झारखÖड सरकार Ʈारा अिधसूिचत Ǒकया जाय, मɅ
होगा।
(3) यह उस तारȣख से Ĥवृƣ होगा जो राÏय सरकार राजपğ मɅ अिधसूचना Ʈारा इस िनिमƣ िनयम करे।
2. पǐरभाषाएँ - जबतक Ǒक ǒवषय या संदभ[ मɅ कोई ǒवǾƨ बात न हो इस अिधिनयम मɅ -
(क) ‘‘तीथ[ ¢ेğ’ से अिभĤेत है बाबा बैƭनाथधाम मंǑदर Ĥागंण, बासुकȧनाथ धाम मंǑदर Ĥांगण, अÛय ¢ेğ एवं
èथल जहाँ तीथ[ याǒğयɉ का आगमन, ठहराव, ħमण हो तथा मेला सǑहत ऐसे ¢ेğ जहाँ धािम[क, सांèकृितक,
पारàपǐरक संèकार तथा अÛय ǑĐया कलाप Ǒकया जाय।
(ख) ‘‘मेला’’ से अिभĤेत Įावणी मेला से है ǔजÛहɅ राÏय सरकार बाबा बैƭनाथधाम-बासुकȧनाथ तीथ[ ¢ेğ
ǒवकास Ĥािधकार अिधिनयम Ʈारा Ĥबंधन मɅ लाने क े िलए अिधसूिचत करɅ
(ग) ‘‘Ĥािधकार’’ से अिभĤेत है इस अिधिनयम कȧ धारा-3 क े अधीन गǑठत बाबा बैƭनाथधाम-बासुकȧनाथ
तीथ[ ¢ेğ ǒवकास Ĥािधकार;
(घ) ‘‘तीथ[याğी’’ क े अंतग[त वह åयǒƠ आता है जो तीथ[èथल कȧ याğा, अÛय उƧेæय क े अितǐरƠ ऐसे
अनुƵानɉ का पालन करने क े िलए करे जो तीथ[याğी Ʈारा सामाÛयतया पालन Ǒकया जाता है;
(ङ) “मुÉयमंğी“ से अिभĤेत है झारखÖड राÏय क े मुÉयमंğी;
(च) “मंğी“ से अिभĤेत है राÏय सरकार क े मंǒğपǐरषद क े सदèय;
(छ) ‘‘आयुƠ’’ से अिभĤेत है संथाल परगना (दुमका) क े ĤमÖडलीय आयुƠ;
(ज) ‘‘सिचव’’ से अिभĤेत है राÏय सरकार Ʈारा सàयक Ǿप से िनयुƠ Ǒकसी ǒवभाग का Ĥधान सिचव/सिचव;
(झ) ‘‘उपायुƠ’’ से अिभĤेत है राÏय सरकार Ʈारा सàयक Ǿप से िनयुƠ ǔजला दंडािधकारȣ-सह-उपायुƠ;
(ञ) ‘‘पुिलस अधी¢क’’ से अिभĤेत है राÏय सरकार Ʈारा सàयक Ǿप से िनयुƠ ǔजला का पुिलस अधी¢क;
(ट) ‘‘अपर ǔजला दÖडािधकारȣ’’ से अिभĤेत है भारतीय Ĥशासिनक सेवा/राÏय Ĥशासिनक सेवा क े
पदािधकारȣ जो झारखÖड सरकार क े Ʈारा CrPC क े अÛतग[त अपर ǔजला दÖडािधकारȣ क े कत[åयɉ का
िनव[हन करने हेतु Ĥािधकृत Ǒकये गये हो;
(ठ) ‘‘अपर पुिलस अधी¢क’’ से अिभĤेत है भारतीय पुिलस सेवा/राÏय पुिलस सेवा क े पदािधकारȣ जो
झारखÖड सरकार क े Ʈारा अपर पुिलस अधी¢क क े कत[åयɉ का िनव[हन करने हेतु Ĥािधकृत Ǒकये गये हो;
(ड) ‘‘अनुमंडल पदािधकारȣ’’ से अिभĤेत है राÏय सरकार Ʈारा सàयक Ǿप से िनयुƠ अनुमÖडल क े िलये
अनुमÖडल पदािधकारȣ;
(ठ) सांसद से अिभĤेत है लोकसभा क े िनवा[िचत सदèय जो Ǒकसी खास संसदȣय ¢ेğ का Ĥितिनिध×व करते हɇ;
(ण) ǒवधायक से अिभĤेत है संबंिधत ǒवधानसभा ¢ेğ क े िनवा[िचत ǒवधायक;
(त) ‘‘ǒवǑहत’’ से अिभĤेत है इस अिधिनयम क े अधीन बनाई गई िनयमावली Ʈारा ǒवǑहत;
(थ) ‘‘ǒविनयमावली’’ से अिभĤेत है इस अिधिनयम क े अधीन Ĥािधकार Ʈारा बनाई गई ǒविनयमावली;
(द) ‘‘िनयमावली’’ से अिभĤेत है इस अिधिनयम क े अधीन राÏय सरकार Ʈारा बनाई गई िनयमावली।

Ĥािधकार का गठन
3. Ĥािधकार का गठन -
(I) इस अिधिनयम क े Ĥयोजनाथ[ राÏय सरकार बाबा बैƭनाथधाम-बासुकȧनाथ तीथ[ ¢ेğ ǒवकास Ĥािधकार
नामक एक Ĥािधकार का गठन, ऐसी तारȣख क े Ĥभाव से करेगी, जो राÏय सरकार इस िनिमƣ राजपğ मɅ
अिधसूचना Ʈारा िनयत करे।
(II) Ĥािधकार िनàनिलǔखत सदèयɉ को िमलाकर गǑठत Ǒकया जाएगाः-
(क) मुÉयमंğी - अÚय¢
(ख) पय[टन, कला संèकृित, खेलक ू द एवं युवा काय[ ǒवभाग/मंğालय का Ĥभारȣ मंğी - उपाÚय¢
(ग) मुÉय सिचव - उपाÚय¢
(घ) सिचव, योजना-सह-ǒवƣ ǒवभाग - सदèय
(ङ) सिचव, गृह, कारा एवं आपदा Ĥबंधन ǒवभाग - सदèय
(च) सिचव, èवाèØय ǒवभाग - सदèय
(छ) पुिलस महािनदेशक - सदèय
(ज) आयुƠ, संथाल परगना - सदèय-सह-मुÉय काय[कारȣ पदािधकारȣ
(झ) उपायुƠ, देवघर - सदèय
(ञ) उपायुƠ, दुमका - सदèय
(ट) पुिलस उप महािनरȣ¢क, संथाल परगना - सदèय
(ठ) महापौर, देवघर नगर िनगम - सदèय
(ड) बासुकȧनाथ नगर पंचायत का Ĥमुख - सदèय
(ढ) सिचव, पय[टन, कला संèकृित, खेलक ू द एवं युवा काय[ ǒवभाग-सदèय सिचव
(ण) बाबा बैƭनाथ धाम मंǑदर तथा बासुकȧनाथ मंǑदर ¢ेğ क े सांसद - सदèय
(त) बाबा बैƭनाथ धाम मंǑदर तथा बासुकȧनाथ मंǑदर ¢ेğ क े ǒवधायक - सदèय
(थ) झारखÖड ǑहÛदू धम[ Ěèट बोड[ क े अÚय¢ या उनक े Ĥितिनिध - सदèय
(द) पंडा धम[ रǔ¢णी सभा (देवघर ǔèथत) क े Ĥमुख तथा एक अÛय Ĥितिनिध - सदèय
(ध) बासुकȧनाथ धाम ǔèथत पंडा (पुजाǐरयɉ) क े Ǒकसी संगठन का Ĥितिनिध - सदèय
(न) दो गणमाÛय गैर सरकारȣ åयǒƠ, जो बाबा बैƭनाथ धाम तथा बासुकȧनाथ धाम तीथ[ ¢ेğ क े ǒवकास
मɅ अिभǾची रखते हɉ, तीन वष[ क े िलए राÏय सरकार क े Ʈारा मनोनीत Ǒकए जायɅगे - सदèय
(III) यǑद क ं Ǒडका 3(II) या क ं Ǒडका 21 मɅ वǔण[त अÚय¢ या कोई अÛय सदèय ǑहÛदू धम[ का नहȣं हो तो राÏय
सरकार Ǒकसी ऐसे Ĥिसƨ åयǒƠ जो ǑहÛदू धम[ मानता हो, समान èतर क े पद पर हो तथा समान Ĥकार का
कत[åय का िनव[हन कर रहा हो, को उसक े èथान पर नािमत कर सकती है।
(IV) बाबा बैƭनाथ धाम-बासुǑकनाथ तीथ[ ¢ेğ ǒवकास Ĥिधकार (सं¢ेप मɅ Ĥािधकार) ǒविनयमावली Ʈारा, यथा
अवधाǐरत रȣित से तथा Ĥयोजन क े िलए, ऐसे Ǒकसी åयǒƠ को सहयुƠ कर सक े गा, ǔजसकȧ सहायता और
परामश[ इस अिधिनयम क े ǑकÛहȣं उपबंधɉ का अनुपालन करने मɅ वह लेना चाहता हो तथा इस Ĥकार सहयुƠ
åयǒƠ को Ĥािधकार कȧ वैसी चचा[ मɅ भाग लेने का अिधकार होगा जो उस Ĥयोजन क े सुसंगत हो ǔजसक े िलए
उसे सहयुƠ Ǒकया गया हो, लेǑकन वह मतदान करने का हकदार नहȣं होगा।
(V) Ĥिधकार तीथ[ ¢ेğ मɅ, ǒवशेषकर Įƨालुओं एवं आगंतुकɉ क े कãयाण, बचाव, सुर¢ा एवं उनक े िलए सुǒवधाओं
क े संदभ[ मɅ, ǒवकास तथा मेला ǒवशेष से ĤाƯ होने वाले राजèव मɅ अिभवृǒƨ सǑहत संसाधनɉ, ǒवƣीय Ĥबंधन

सुर¢ा एवं मेला क े मह×व तथा उपयोिगता क े अÛय ǒवषयɉ आǑद को संबǒƨ[त करने क े िलए नीित, िनदȶश,
काया[Ûवयन, नये-नये तरȣकɉ एवं वाƻĮोत से आगÛतुकɉ क े कãयाण एवं सुǒवधा ǒवषयक मसलɉ पर समय-
समय पर ǒवचार-ǒवमश[ कर पहल कर सक े गा तथा ĤमÖडलीय एवं ǔजला èतरȣय Ĥशासिनक एवं मेला
Ĥबंधन åयवèथा क े संबƨ सभी ǒवभागɉ क े पदािधकाǐरयɉ को तदनुसार परामश[ एवं िनदेश दे सक े गा।
(VI) Ĥािधकार क े मुÉयालय देवघर (संथाल परगना) मɅ होगा।
4. Ĥािधकार क े अÚय¢ एवं उपाÚय¢ कȧ शǒƠयां का कृ×य -
(1) Ĥािधकार का अÚय¢ Ĥािधकार कȧ बैठक कȧ अÚय¢ता करने क े अितǐरƠ Ĥािधकार कȧ ऐसी शǒƠयɉ एवं
कृ×यɉ का Ĥयोग एवं िनव[हन करɅगे जो उÛहɅ Ĥािधकार Ʈारा Ĥ×यायोǔजत Ǒकया जाय और यथाǒवǑहत शǒƠयɉ
का Ĥयोग एवं कृ×यɉ का पालन करेगा। आपातकालीन पǐरǔèथितयɉ मɅ अÚय¢ Ĥािधकार क े उƭेæयɉ क े
आलोक मɅ कोई भी िनण[य ले सक े गा लेǑकन इस Ĥकार क े िनण[य पर Ĥािधकार का ǒवमशȾपरांत अिभपुǒƴ
करा िलया जाएगा।
(2) Ĥािधकार का उपाÚय¢ ऐसी शǒƠयɉ एवं कृ×यɉ का Ĥयोग एवं िनव[हन करेगा जो उसे ǒवǑहत Ǒकये जाय या
अÚय¢ Ʈारा उसे Ĥ×यायोǔजत Ǒकया जाय।
5. सदèयɉ को पद से हटाया जाना - राÏय सरकार वैसे Ǒकसी सदèय को Ĥािधकार से हटा सक े गी जो उसकȧ राय मɅ -
(क) काय[ करने से इÛकार करता हो;
(ख) काय[ करने मɅ असमथ[ हो;
(ग) अपने पद का इस Ĥकार दुǾपयोग करता हो ǔजससे Ǒक लोक या सरकारȣ Ǒहत मɅ उसका पद पर बना रहना
हािनकारक हो; या
(घ) सदèय क े Ǿप मɅ बना रहना अÛयथा अनुपयुƠ हो;
6. Ĥािधकार का मुÉय काय[कारȣ पदािधकारȣ तथा अपर ǔजला दÖडािधकारȣ, अपर पुिलस अधी¢क एवं अÛय
पदािधकारȣ -
(I) सरकार Ʈारा अिधसूिचत एक अपर ǔजला दÖडािधकारȣ हɉगे जो मुÉय काय[कारȣ पदािधकारȣ को सहयोग
करɅगɅ तथा ǔजला दÖडािधकारȣ क े अधीन काय[रत रहɅगे। साथ हȣ मुÉय काय[कारȣ पदािधकारȣ क े िनदȶशानुसार
Ĥािधकार क े मामलɉ का िनçपादन करɅगे।
(II) सरकार क े Ʈारा अिधसूिचत एक अपर पुिलस अधी¢क होगा जो पुिलस अधी¢क क े अधीन काय[रत रहɅगे।
(III) तीथ[ ¢ेğ हेतु सरकार जैसा åयावहाǐरक महसूस करɅ, अनुमÖडल एवं पुिलस èटेशन को एक ǒवशेष अविध हेतु
अिधसूिचत कर सकती है, यǑद Ĥािधकार मेला अविध हेतु इसका समथ[न करɅ और इसक े अितǐरƠ अपर
अनुमÖडल दÖडािधकारȣ एवं अनुमÖडल पुिलस अिधकारȣ को ĤितिनयुƠ करेगी।
7. Ĥािधकार कȧ बैठक Ʌ -
(I) Ĥािधकार कȧ बैठक साल मɅ कम-से-कम दो बार आयोǔजत होगी, ǔजसमɅ से Įावणी मेला क े आयोजन से तीन
माह पूव[ कम-से-कम एक बैठक अवæय आयोǔजत होगी।
(II) Ĥािधकार Įावणी मेला क े आयोजन क े उƧेæय से Ǒकसी भी समय बैठक कर सकती है अथवा आवæयकता
पड़ने पर अÚय¢ कȧ इÍछानुसार Ǒकसी भी समय बुलाई जा सक े गी।

Ĥािधकार कȧ शǒƠयां एवं कृ×य
8. Ĥािधकार कȧ शǒƠयां एवं कृ×य -
(I) Ĥािधकार तीथ[ ¢ेğ क े साथ साथ मंǑदर Ĥांगण क े भी समुिचत काय[-संचालन, ǒवकास, ǒविनयमन और
Ĥबंधन क े साथ Įƨालुओं एवं पय[टकɉ क े कãयाण, सुर¢ा एवं सुǒवधाओं क े संबंध मɅ िनण[य ले सक े गी।
(II) Ĥािधकार राजèव İोतɉ को संबǒƨ[त करने क े िलए नीित िनधा[रण करने, अनुशंसा करने, िनिध कȧ åयवèथा,
अनुदान, बाƻ İोत, सरकार अथवा İोतɉ से करने क े िलए िनदȶिशत कर सक े गा।
(III) Ĥवेश एवं Toll शुãक लगाना- Ĥािधकार सुख-सुǒवधाओं का उपबंध करेगा और सरकार क े अनुमोदन से
Ĥािधकार को Ǒकसी एक अविध क े िलये, समय-समय पर राÏय मेला Ĥािधकार Ʈारा ǒविनǑद[ƴ Ǒकये जानेवाले
यंğ-चािलत पǐरवहन, आवास-गृहɉ तथा खुदरा दुकानदारɉ, मनोरंजन (िथयेटर, सक[स आǑद) काय[Đमɉ,
ǒव£ापनɉ एवं ऐसी मदɉ, ǔजसे Ĥािधकार उिचत समझे, पर Ĥवेश शुãक और अिधभार अिधरोǒपत करने कȧ
शǒƠ होगी और जो िभÛन-िभÛन कायɟ या èथानɉ क े िलए एक हȣ या िभÛन हो सकती है। इसक े साथ हȣ उƠ
¢ेğ मɅ Ĥवेश करने वाले हर वाहन, पशु या कोई åयǒƠ जो सामान को åयापार हेतु लाता है या ǒवĐ े ता हो पर भी
टॉल (Toll) शािमल है। साथ हȣ इस ¢ेğ क े अÛदर ǒवĐय होने वाली पशुओं का िनबंधन शुãक शािमल है।
(IV) सुख सुǒवधाएँ उपलÞध कराने कȧ शǒƠ - Ĥािधकार मेला सǑहत तीथ[ ¢ेğ से संबंिधत पय[टकɉ, तीथ[ याǒğयɉ,
अÛय åयǒƠयɉ या सिमितयɉ, åयǒƠयɉ क े समुह को मूलभूत सुǒवधाएँ उपलÞध करायेगा तथा इस हेतु
ǔजàमेदार भी होगा एवं इन सुǒवधाओं हेतु Ĥािधकार शुãक अिधरोǒपत कर सक े गा।
(V) Ĥािधकार Įƨालुओं, गरȣब, िनःसहाय एवं तीथ[ ¢ेğ से संबंिधत अÛय ऐसे लोगɉ हेतु परोपकारȣ काय[Đमɉ का
उƣरदािय×वतापूव[क आयोजन कर सकती है।
(VI) Ĥािधकार क े पास अनुमÖडल एवं ǔजला èतर क े Ĥशासिनक पदािधकाǐरयɉ क े साथ तीथ[ ¢ेğ क े ǒवकास,
Ĥशासन एवं Ĥबंधन मɅ जुड़े सभी ǒवभागɉ क े पदािधकाǐरयɉ को सलाह देने एवं िनदȶिशत करने कȧ शǒƠ होगी।
(VII) Ĥािधकार क े पास तीथ[ ¢ेğ क े िलए माèटर Üलान तैयार कर सक े गा एवं तीथ[ संबंधी काय[कलापɉ क े साथ-साथ
मनुçयɉ तथा पशुओं क े िलए नुकसानदेह होने वाले खतरनाक कृ×यɉ को रोकने क े िलए Ĥितबंध अिधरोǒपत
करने हेतु नीित बना सक े गा।
(VIII) लाईसɅस देने का अिधकार-Ĥािधकार Ǒकसी åयǒƠ या åयǒƠयɉ क े समूह को िनधा[ǐरत शुãक क े भुगतान क े
उपराÛत ǒवǑहत िनयमɉ क े अÛतग[त तीथ[ ¢ेğ मɅ कोई भी रोजगार, åयवसाय या आजीǒवका चलाने हेतु
लाईसɅस िनग[त कर सकता है।
9. मेला Ĥािधकार कȧ ǒवशेष शǒƠयाँ - Ĥािधकार, Įावणी मेला क े सांèकृितक, सामाǔजक और धािम[क मह×व को Úयान
मɅ रखते हुये अथवा इस संबंध मɅ अÛय İोतɉ से ĤाƯ सूचना पर, Ĥािधकार क े अधीन नये ¢ेğ अथवा Įƨालुओं से
संबंिधत कायɟ अथवा Ĥािधकार क े अÛतग[त अÛय कायɟ को सǔÛनǑहत करने कȧ अनुशंसा राÏय सरकार को कर
सक े गी।
10. िनयंğण एवं माग[दश[न - मेला अविध क े दौरान अथवा Ĥािधकार क े काय[ ¢ेğ क े अंतग[त ǑĐयाकलापɉ हेतु मेला क े
Ĥबंधन सǑहत तीथ[ ¢ेğ क े ǒवकास से संबƨ राÏय सरकार क े सभी ǒवभागɉ, ĤमÖडलɉ, ǔजला तथा अÛय ¢ेğीय èतर क े
पदािधकारȣगण एवं किम[यɉ क े साथ-साथ èथानीय िनकायɉ क े अिधकाǐरयɉ एवं कमȸ Ĥािधकार क े Ǒदशा िनदेश मɅ
काय[ करɅगे।

11. कार[वाई करने हेतु अनुशंसा - Ĥािधकार को मेले क े Ĥबंधन सǑहत तीथ[ ¢ेğ क े ǒवकास से संबƨ राÏय सरकार क े Ǒकसी
पदािधकारȣ या कम[चारȣ क े ǒवǾƨ इस िनिमƣ राÏय सरकार Ʈारा बनाये गये Ĥचिलत अिधिनयम और िनयमावली क े
अनुसार कार[वाई करने कȧ अनुशंसा कȧ शǒƠ होगी।
12. िनयम बनाने कȧ शǒƠ -
(1) Ĥािधकार इस अिधिनयम क े उƭेæयɉ को पूण[ करने हेतु िनयम बना सकता है, तथा जो ǒवशेष कर -
(I) Ĥािधकार मɅ ĤितिनयुƠ कम[चाǐरयɉ को काय[ आवंटन
(II) तीथ[ ¢ेğ मɅ सफाई åयवèथा
(III) मेले का सफल आयोजन
(2) Ĥािधकार क े Ʈारा बनाये गये िनयम राÏय सरकार क े Ʈारा मूãयांǑकत होने क े उपराÛत लागू Ǒकया जायेगा।
अÚयाय-4
मुÉय काय[कारȣ पदािधकारȣ, अपर ǔजला दÖडािधकारȣ एवं अपर पुिलस अधी¢क कȧ शǒƠयां एवं काय[
13. मुÉय काय[कारȣ पदािधकारȣ (CEO) - मेला सǑहत तीथ[ ¢ेğ क े Ĥबंधन हेतु राÏय सरकार CrPC 1973 क े तहत्
पǐरभाǒषत ǔजला दÖडािधकारȣ कȧ शǒƠयɉ क े साथ-साथ अÛय शǒƠयɉ को मुÉय काय[कारȣ पदािधकारȣ को Ĥ×योǔजत
करेगी।
14. मुÉय काय[कारȣ पदािधकारȣ (CEO) Ĥािधकार Ʈारा Ǒदये गये कायɟ एवं दािय×वɉ का िनवा[ह करेगा।
15. अÛय कायȾ क े अितǐरƠ मुÉय काय[कारȣ पदािधकारȣ (CEO) क े पास िनàन शǒƠयाँ एवं काय[ Ĥदƣ हɉगे -
(क) ǒविध åयवèथा क े िनयंğण पर नज़र रखना और उस पर िनयंğण बनाये रखने क े िलए हर संभव आवæयक
सुर¢ा×मक कदम उठाना। साथ हȣ साथ ǔजला उपायुƠ, पुिलस अधी¢क एवं संबंिधत Ĥ¢ेğɉ क े पुिलस
उपमहािनरȣ¢क (DIG) कȧ सलाह पर दÖडािधकारȣ एवं पुिलस बल कȧ ĤितिनयुƠ करना।
(ख) तीथ[ ¢ेğ क े अंदर वाहनɉ, जानवरɉ एवं Ǒकसी åयǒƠ Ʈारा åयापार हेतु लाये जाने वाले सामानɉ पर Ĥवेश शुãक
(Toll) अिधरोǒपत करना तथा साथ हȣ Ĥािधकार से ǒवमशȾपराÛत मेला ¢ेğ क े अंदर åयापाǐरक, åयवसाियक
गितǒविधयɉ क े िनबंधन पर शुãक अिधरोǒपत करना।
(ग) Ĥािधकार मɅ ǒवमशȾपराÛत एवं पाǐरत होने क े उपराÛत हȣ तीथ[ ¢ेğ क े अंदर मेले से Ĥ×य¢ अथवा परो¢ Ǿप
से संबंिधत ǒविभÛन कायɟ क े िलए अèथायी तौर पर सरकारȣ जगह उपलÞध कराना ǔजसमɅ िनàन Ĥकार क े
काय[ शािमल हɉगे:-
(I) तीथ[ ¢ेğ से संबंिधत धािम[क संèथाऐं एवं संगठन।
(II) समाǔजक तथा अÛय Ĥकार क े संघ एवं संèथाएं।
(III) काया[लय संबंधी।
(IV) बजार èथल।
(V) शौचालय, मुğालय एवं क ू ड़े क े ढेर।
(VI) èनानागार।
(VII) ǒवĮाम एवं मनोरंजन ।
(VIII) अÛय Ĥदश[नी एवं Ĥदश[न हेतु।

(घ) èथानीय गैर सरकारȣ संगठन, जन Ĥितिनिधयɉ, सरकारȣ पदािधकाǐरयɉ, èथानीय Ĥािधकार एवं राÏय
सरकार क े बीच समÛवय èथाǒपत करना।
(ङ) आग लगने कȧ ǔèथित मɅ Ǒकसी भी िनमा[ण को हटाने, ǔजससे Ĥभाǒवत åयǒƠ या संèथा को Ûयूनतम हािन
हो, का अिधकार।
(च) अिधिनयम मɅ ǒविनǑद[ƴ Ǒकसी Ĥकार क े जुमा[ने को लागू करना।
(छ) तीथ[ ¢ेğ मɅ अÛय पदािधकाǐरयɉ को Ǒकसी भी अविध क े िलए कोई या ऐसी शǒƠ Ĥ×यायोǔजत करना जो
सरकार Ʈारा ǒवशेष उƭेæयɉ हेतु अिधसूिचत हो।
16. उपधारा 12(1) क े अधीन बनाये गये िनयमɉ क े अनुसार, मुÉय काय[कारȣ पदािधकारȣ (CEO) भगदड़ तथा आग लग
जाने क े ǔèथित मɅ समुिचत Ǒदशा िनदȶश दे सक े गा ǒवशेष कर िनàन उƭेæयɉ क े िलए:-
(I) तीथ[ ¢ेğ मɅ बने भवन एवं संरचनाओं तथा लाये गये सामानɉ कȧ सुर¢ा सुिनǔƱत करना।
(II) तीथ[ ¢ेğ मɅ बने झोपǑड़यɉ एवं अÛय संरचनाओं कȧ उँचाई सीमा एवं िनमा[ण ¢ेğ तथा संरचनाओं क े मÚय क े
दूरȣ िनधा[ǐरत करने संबंधी शतȾ को सुिनǔƱत करना।
(III) तीथ[ ¢ेğ या अÛयğ मɅ बालू एवं जल पेटȣ कȧ आपूित[ संबंधी।
(IV) खाना बनाने या Ǒकसी अÛय उƧेæय से आग क े उपयोग पर Ĥितबंध।
17. मुÉय काय[कारȣ पदािधकारȣ (CEO) Ǒकसी भी अनािधकृत िनमा[ण जो तीथ[ ¢ेğ क े माèटर Üलॉन क े अनुǾप न हो, हटा
सकते है तथा उƠ हटाने क े काय[ मɅ खच[ हुए रािश कȧ वसूली अनािधकृत िनमा[ण करने वाले åयǒƠ से कȧ जायेगी, जो
बकाया भूिम राजèव क े Ǿप मɅ होगी।
18. मुÉय काय[कारȣ पदािधकारȣ (CEO) या अÛय पदािधकारȣ ǔजसे मुÉय काय[कारȣ पदािधकारȣ Ʈारा यह शǒƠ
Ĥ×यायोǔजत हो इस अिधिनयम कȧ धारा 23 क े तहत् åयǒƠयɉ को दǔÖडत कर सक े गा।
19. अपर पुिलस अधी¢क कȧ शǒƠयाँ एवं कत[åय - अपर पुिलस अधी¢क कȧ िनàन शǒƠयाँ एवं कत[åय हɉगे:-
(क) संबंिधत ǔजला पुिलस अधी¢क क े माग[दश[न मɅ काय[ करना।
(ख) मेला सǑहत Ĥािधकार क े काय[कलापɉ मɅ, जो वह सहायता योÊय आवæयक समझे, मुÉय काय[कारȣ
पदािधकारȣ को सहायता Ĥदान करना।
(ग) Ĥािधकार क े िनण[यɉ को लागू करना।
(घ) तीथ[ ¢ेğ मɅ ǒविध åयवèथा बनाये रखने हेतु ǔजला दÖडािधकारȣ से ǒवमश[ कर तीथ[ ¢ेğ मɅ पुिलस सब
Ǒडǒवजन, èथानीय पुिलस èटेशन क े सृजन क े संबंध मɅ Ĥािधकार को परामश[ देना, जबकȧ िनयिमत
अपरािधक अनुसंधान क े मामले मूल पुिलस èटेशन क े अÛतग[त रहɅगे।
(ङ) èथानीय Ĥशासन एवं Ĥािधकार से समÛवय èथाǒपत करना।
20. अपर ǔजला दÖडािधकारȣ कȧ शǒƠयाँ एवं कत[åय - अपर ǔजला दÖडािधकारȣ कȧ िनàन शǒƠयाँ एवं कत[åय हɉगे:-
(क) मेला ¢ेğ सǑहत तीथ[ ¢ेğ मɅ ǔजला दÖडािधकारȣ क े माग[दश[न मɅ काय[ करना।
(ख) मुÉय काय[कारȣ पदािधकारȣ क े काय[कलापɉ, जो वह सहायता योÊय आवæयक समझे, मɅ सहायता Ĥदान
करɅगे।
(ग) Ĥािधकार क े िनण[यɉ को लागू करना।

(घ) तीथ[ ¢ेğ मɅ ǒविध åयवèथा बनाये रखने हेतु ǔजला दÖडािधकारȣ से ǒवमश[ कर पुिलस सब Ǒडǒवजन, èथानीय
पुिलस èटेशन क े सृजन क े संबंध मɅ Ĥािधकार को परामश[ देना, जबकȧ िनयिमत अपरािधक अनुसंधान क े
मामले मूल पुिलस èटेशन क े अÛतग[त रहɅगे।
(ङ) èथानीय Ĥशासन एवं Ĥािधकार से समÛवय èथाǒपत करना।
अÚयाय-5
काय[कारȣ पǐरषद का गठन
21. मुÉय काय[कारȣ पदािधकारȣ (CEO) कȧ अÚय¢ता मɅ एक काय[कारȣ पǐरषद होगा जो Ĥािधकार Ʈारा िलये गये िनण[यɉ
को काया[ǔÛवत एवं लागू करेगा।
1. काय[कारȣ पǐरषद िनàनिलǔखत सदèयɉ को िमलाकर गǑठत Ǒकया जायेगा:-
(I) ĤमÖडलीय आयुƠ, संथाल परगना, दुमका-सह-मुÉय काय[कारȣ पदािधकारȣ - अÚय¢
(II) पुिलस उपमहािनरȣ¢क, संथाल परगना, दुमका - सदèय
(III) उपायुƠ, देवघर - सदèय
(IV) उपायुƠ, दुमका - सदèय
(V) पुिलस अधी¢क, देवघर - सदèय
(VI) पुिलस अधी¢क, दुमका - सदèय
(VII) काय[पालक अिभयंता, देवघर - सदèय
(भवन िनमा[ण, पथ िनमा[ण, पेयजल एवं èवÍछता,
उजा[, Ēामीण अिभयंğण ǒवभाग)
(VIII) नगर आयुƠ, देवघर नगर िनगम - सदèय
(IX) मुÉय काय[कारȣ पदािधकारȣ, बासुकȧनाथ नगर पंचायत - सदèय
(X) िसǒवल सज[न, देवघर - सदèय
2. यǑद आवæयकता हो तो Ĥािधकार अÛय दो सदèयɉ को मनोिनत कर सकता है।
22. काय[कारȣ पǐरषɮ कȧ काय[ एवं शǒƠयाँ - काय[कारȣ पǐरषɮ क े िनàनिलǔखत काय[ एवं शǒƠयाँ हɉगी
(I) Ĥािधकार क े िनदेश एवं िनण[यɉ को लागू करवाना।
(II) ǒविभÛन ǒवभागɉ क े बीच समÛवय èथाǒपत करना।
(III) तीथ[ ¢ेğ से संबंिधत ǒवषयɉ एवं समèयाओं क े संबंध मɅ Ĥािधकार को परामश[ एवं Ĥèताव देना।
(IV) तीथ[ ¢ेğ मɅ पǐरयोजनाओं का वाèतǒवक Ǿप मɅ काया[Ûवयन कराना या Ǒकसी अÛय ǒवभाग क े èवीकृत एवं
काया[ǔÛवत योजनाओं को सहायता Ĥदान करना।
अÚयाय - 6
Ĥकȧण[
23. सजा - कोई भी åयǒƠ जो
(क) अनिधकृत संरचना का िनमा[ण करता हो, या
(ख) अनिधकृत èथान को शौचालय, मूğालय एवं गंदगी फ े कने हेतु उपयोग करता हो, या

(ग) धारा 8 (Viii) क े Ĥावधानɉ क े अÛतग[त ĤाƯ लाईसɅस क े बीना कोई åयवसाय, åयापार अथवा वृǒƣ का
संचालन करे अथवा अÛय काय[कलाप जो इस लाईसɅस का उãलंघन करता हो, या
(घ) अिधिनयम Ʈारा बनाये गये िनयमɉ क े अÛतग[त ǑकÛहȣ Ĥावधानɉ का उãलंघन करता हो, या
(ङ) इस अिधिनयम क े अÛतग[त Ǒकसी भी िलǔखत आदेश या िनदȶश का उãलंघन करता हो,
क े अपराध िसǒƨ पर Ǿपये 1,000.00 तक क े जुमा[ने से दǔÖडत Ǒकया जा सकता है। जुमा[ने से दǔÖडत
करने क े उपराÛत यǑद उãलंघन Ǒफर Ǒकया जाता है तो पुनः Ǿपये 1,000.00 तक क े जुमा[ने से दǔÖडत Ǒकया
जायेगा। यǑद पुनः उãलंघन जारȣ रहता हो तो Ĥथम बार दोषी पाये जाने क े Ǒदन से Ǿपये 100.00 Ĥित Ǒदन
कȧ दर से जुमा[ने कȧ रािश लगाई जा सक े गी।
(च) जहाँ कहȣं भी कोई åयǒƠ, क ं पनी, åयवसाियक संèथान, संगठन या कोई अÛय िनकाय इस अिधिनयम क े
Ĥावधानɉ क े उãलंघन का ǔजàमेदार होगा, उससे Ĥािधकार (बाबा बैƭनाथधाम-बासुकȧनाथ तीथ[ ¢ेğ ǒवकास
Ĥािधकार) Ʈारा इस अिधिनयम क े Ĥयोजन हेतु िनयुƠ/नािमत अिधकारȣ Ʈारा दÖड वसूला जा सकता है।
(छ) यǑद कोई åयǒƠ स¢म Ĥािधकार या इस अिधिनयम क े Ĥयोजन हेतु स¢म Ĥािधकार Ʈारा िनयुƠ/नािमत
अिधकारȣ Ʈारा Ǒकये गये जुमा[ने को िनधा[ǐरत समय क े अंदर जमा करने मɅ असफल होता है तो स¢म
Ĥािधकार Ʈारा ǒबहार एवं उǑड़सा पǔÞलक ǑडमाÖड ǐरकवरȣ अिधिनयम, 1914 क े अÛतग[त वसूली जाएगी।
(ज) अपील -
(I) स¢म Ĥािधकार या इस अिधिनयम क े Ĥयोजन हेतु स¢म Ĥािधकार Ʈारा िनयुƠ/नािमत अिधकारȣ
Ʈारा Ǒदये गये आदेश क े ǒवǾƨ इस अिधिनयम क े अंतग[त अपीलीय Ĥािधकार, जो ĤमÖडलीय
आयुƠ, संथाल परगना, झारखÖड हɉगे, क े सम¢ Ǒकया जा सकता है, ǔजसका िनण[य अंितम होगा।
(II) आदेश ĤाƯ होने क े 30 Ǒदनɉ क े अंदर अपील करना अिनवाय[ होगा। आदेश ĤािƯ क े 30 Ǒदनɉ क े
उपराÛत ĤाƯ अपील क े संबंध मɅ यǑद अपीलीय Ĥािधकार को ऐसा Ĥतीत हो Ǒक Ǒकसी ǒवशेष कारण
से (अèवèथता या कोई अÛय पǐरǔèथित ǔजसमɅ अपील करना संभव नहȣं हो सका हो) 30 Ǒदनɉ क े
अÛदर अपील नहȣं Ǒकया जा सका है तो ऐसी ǔèथित मɅ 30 Ǒदनɉ क े उपरांत भी अपील èवीकार Ǒकया
जा सक े गा।
(III) Ǒकसी भी पǐरǔèथित मɅ आदेश ĤाƯ होने क े 90 Ǒदनɉ उपरांत ĤाƯ अपील को èवीकार नहȣं Ǒकया जा
सक े गा।
24. Ĥािधकार क े कृ×य -
(1) इस अिधिनयमक े पूव[वतȸ उपबंधɉ पर Ĥितक ुल Ĥभाव डाले ǒबना Ĥािधकार, इस अिधिनयमक े अधीन अपने
कायɟ एवं कृ×यɉ क े िनव[हन करने मɅ नीित ǒवषयक ऐसे िनदेशɉ Ʈारा आबƨ होगा जैसा Ǒक राÏय सरकार उसे
समय-समय पर िलǔखत Ǿप मɅ दɅ।
(2) Ĥािधकार क े साथ साथ काय[कारȣ पǐरषद पर राÏय सरकार का िनण[य अंितम एवं बाÚयकारȣ होगा।
25. शǒƠयɉ का Ĥ×यायोजन - Ĥािधकार, िलǔखत आदेश Ʈारा, आदेश मɅ यथाǒविनǑद[ƴ शƣȾ और सीमाओं क े अधीन,
Ĥािधकार क े अÚय¢ या उपाÚय¢ या मुÉय काय[कारȣ पदािधकारȣ या Ǒकसी अÛय सदèय को इस अिधिनयम क े
अधीन अपनी ऐसी शǒƠयɉ और कृ×यɉ को Ĥ×यायोǔजत कर सक े गा जो वह आवæयक समझे।
26. आदेशɉ का अिभĤमाणन - Ĥािधकार क े सभी आदेश एवं ǒविनƱय अÚय¢ क े हèता¢र से अथवा इस िनिमƣ Ĥािधकार
Ʈारा Ĥािधकृत Ǒकसी अÛय सदèय क े हèता¢र से स×याǒपत Ǒकये जायɅगे।

27. नेक नीयत से कȧ गई कार[वाई हेतु संर¢ण - इस अिधिनयम क े अÛतग[त सƫावना से Ǒकये गये कृ×यɉ क े ǒवǾƨ कोई
कार[वाई नहȣं कȧ जा सक े गी।
28. Ĥािधकार का अवĐमण -
(I) यǑद Ǒकसी समय राÏय सरकार कȧ यह राय हो Ǒकः-
(क) Ǒकसी गंभीर आपाितक ǔèथित क े कारण Ĥािधकार इस अिधिनयम क े उपबंधɉ क े Ʈारा या उसक े
अधीन उस पर अिधरोǒपत कृ×यɉ एवं कƣ[åयɉ का िनçपादन करने मɅ असमथ[ है; या
(ख) पǐरǔèथितयाँ ऐसी हɇ ǔजनक े कारण लोकǑहत मɅ ऐसा करना आवæयक है तो राÏय सरकार राजपğ मɅ
अिधसूचना Ʈारा Ĥािधकार को अवĐिमत कर सक े गी।
(II) Ĥािधकार को अवĐिमत करने क े िलये उप-धारा i( ) क े अधीन अिधसूचना Ĥकािशत हो जाने पर Ĥािधकार क े
सभी सदèय Ĥािधकार को अǒवĐिमत Ǒकये जाने कȧ तारȣख से अपना पद खाली कर दɅगे;
(III) उप-धारा क े अधीन Ĥािधकार का पुन[गठन Ǒकए जाने तक, इस अिधिनयम क े उपबंधɉ Ʈारा या Ĥािधकार Ʈारा
उसकȧ ओर से Ĥयोग कȧ जानेवाली और िनçपाǑदत Ǒकये जानेवाली सभी शǒƠयɉ का एवं कृ×यɉ और कƣ[åयɉ
का, राÏय सरकार Ʈारा यथा िनदेिशत åयǒƠ या åयǒƠयɉ Ʈारा Ĥयोग और िनçपाǑदत Ǒकया जायेगा।
(IV) उप-धारा (1) क े अधीन जारȣ अिधसूचना मɅ ǒविनǑद[ƴ अवĐमण अविध कȧ समािƯ पर राÏय-सरकार;
(क) अवĐमण कȧ अविध उतनी बढ़ा सक े गी ǔजतनी वह आवæयक समझे; या
(ख) अवĐमण Ǒकये जाने क े एक वष[ क े भीतर Ĥािधकार का पुन[गठन कर सक े गी।
29. िनयमावली बनाने कȧ शǒƠ - Ĥािधकार सरकार कȧ पूव[ अनुमित से राजपğ मɅ अिधसूचना Ʈारा इस अिधिनयमक े
संगत इस अिधिनयम क े Ĥयोजनɉ को पूरा करने क े िलये िनयमावली बना सक े गी।
30. Ĥािधकार का Ĥशासी ǒवभाग - Ĥािधकार का Ĥशासी ǒवभाग पय[टन, कला संèकृित, खेलक ू द एवं युवा काय[ ǒवभाग,
झारखÖड, राँची होगा।
31. Ĥािधकार का Ĥशासी åयवèथा - Ĥािधकार क े मंğालय संबंधी दैिनक काय[-कलापɉ क े संचालन हेतु पय[टन, कला
संèकृित, खेलक ूद एवं युवा काय[ ǒवभाग, झारखÖड, राँची तथा Ĥमंडलीय आयुƠ, संथाल परगना का काया[लय
िनयुǒƠ/ĤितिनयुǒƠ क े Ʈारा सहायता उपलÞध करायेगा।
अÚयाय-7
ǒवƣ, लेखा और अंक े ¢ण
32. तीथ[ ¢ेğ ǒवकास िनिध का गठन - तीथ[ ¢ेğ ǒवकास और Ĥबंधन िनिध (SADMF) क े नाम से एक िनिध का गठन
Ǒकया जायेगा और उसमɅ िनàनांǑकत जमा Ǒकये जायɅगे:-
(I) राÏय या क े Ûġ सरकार Ʈारा Ĥािधकार को Ǒदया गया कोई अनुदान और ऋण;
(II) इस अिधिनयम क े अधीन Ĥािधकार को ĤाƯ शुãक और अिधभार;
(III) राÏय सरकार Ʈारा यथा ǒविनǔƱत अÛय İोतɉ से Ĥािधकार Ʈारा ĤाƯ सभी रकम;
(IV) क े Ûġ सरकार एवं राÏय सरकार क े Ǒदशा-िनदȶशɉ क े अनुसार ĤाƯ दान कȧ रािश।

(V) तीथ[ ¢ेğ क े ǒवकास हेतु Ǒकसी भी संèथा, समूह अथवा åयǒƠ से ĤाƯ दान कȧ रािश।
33. Ĥािधकार का बɇक खाता - वसूल Ǒकया गया अिधभार और Ĥवेश शुãक अिधमानतः या Ǒकसी राƶीयकृत बɇक मɅ अलग
खाता मɅ जमा Ǒकया जायेगा।
34. अिधभार एवं Ĥवेश शुãक संĒहण कȧ रȣित - अिधिनयम कȧ धारा-8(iii) क े अधीन उƥृǑहत अिधभार और Ĥवेश शुãक
का संĒहण एवं Ĥबंधन इस अिधिनयम क े अंतग[त बनाए िनयमɉ एंव ǒविनयमɉ Ʈारा यथा ǒविनǔƱत रȣित से Ǒकया
जायेगा।
35. तीथ[ ¢ेğ ǒवकास एवं Ĥबंधन िनिध का उपयोग -
(1) तीथ[ ¢ेğ ǒवकास एवं Ĥबंधन िनिध का (SADMF) का उपयोग इस अिधिनयम कȧ धारा-8 क े अधीन अपने
कायȾ क े िनçपादन मɅ Ĥािधकार क े खचȶ को पूरा करने क े िलये Ǒकया जायेगा।
(2) तीथ[ ¢ेğ ǒवकास एवं Ĥबंधन िनिध (SADMF) का उपयोग Ĥािधकार Ʈारा Ĥािधकृत उƧेæयɉ और Ĥयोजनɉ क े
िलए होने वाले खच[ को पूरा करने क े िलये Ǒकया जायेगा।
36. बजट कȧ तैयारȣ - Ĥािधकार हर ǒवƣीय वष[ मɅ िनधा[ǐरत समय एवं Ĥपğ मɅ, अगले ǒवƣीय वष[ क े िलये अपना बजट

DEVELOPMENT AUTHORITY ACT, 2015

An Act to promulgate The Baba Baidhyanath Dham - Basukinath Shrine Area Development
Authority Act 2015
Shrawani Mela is a religious and cultural fair and is held every year in Deoghar and
Basukinath (Dumka) in the State of Jharkhand wherein along with local people, lakhs of pilgrims from
within the country as well as from abroad, participate. Apart from that a large number of pilgrims v isit
this combined shrine area throughout the year. It has been felt by the State Government that an authority
should be constituted for development, regulation and management of Shrine area of Baba Baidyanath
Dham and Basukinath Dham including Shrawani Mela held in the month of Shrawan (mostly in the
month of July-August) with participation of officials as well as non-official members.
BE it enacted by the Legislative Assembly of the State of Jharkhand in the Sixty sixth Year of the
Republic of India, as follows:-
CHAPTER-1
1. Short title, extent and commencement –
i. This Act may be called the Baba Baidyanath Dham – Basukinath Shrine Area
Development Authority Act, 2015.
ii. It shall extend to the whole Baba Baidyanath Dham Area including temple complex,
Basukinath Dham temple complex, mela area of the districts of Deoghar and Dumka
(Basukinath) and any other area notified by the Government of the State of Jharkhand.
iii. It shall come into force on such date as the State Government may, by notification in the
official gazette, appoint in this behalf.
2. Definition - In this Act, unless there is something repugnant to the subject or context:-
a) Shrine Area: means the Baba Baidyanath Dham temple complex, Basukinath Dham

temple complex, other area and locations where pilgrims come, stay, visit and profess
religious, cultural, traditional sanskara or any related activities including Mela area.
b) Mela: means Shrawani Mela notified by State govt. for management through the Baba
Baidyanath Dham – Basukinath Shrine Area Development Authority Act.
c) Authority: means Baba Baidyanath Dham – Basukinath Shrine Area Development
Authority constituted under section-3 of the Act.
d) Pilgrim: includes the person, who visits a place of pilgrimage with the object, among
others, of performing such rites as are usually performed by pilgrims.
e) Chief Minister: means the Chief Minister of Jharkhand.
f) Minister: means a member of State Cabinet.
g) Commissioner: means the Divisional Commissioner of Santhal Pargana (Dumka).
h) Secretary: means Principal Secretary/Secretary of a Department of the State Government:
i) Deputy Com missioner: means District Magistrate -cum-Deputy Commissioner of the
District.
j) Superintendent of Police: means Superintendent of Police of the District.
k) Additional District Magistrate: means an officer of Indian Administrative Service/ State
Administrative Service authorised by the state government to perform the duties of
Additional District Magistrate under CrPC.
l) Additional Superintendent of Police: means an officer of Indian Police Service/State
Police Service authorised by the state government to perfor m the duties of Additional
Superintendent of Police.
m) Sub-Divisional Officer: means an officer duly appointed by the State Government for the
Sub-Division
n) Member of Parliament: means Duly elected Member of Lok Sabha, representing a
particular Lok Sabha constituency.
o) Member of Legislative Assembly: means duly elected Member of a Legislative
Assembly constituency.
p) Prescribed: means prescribed by rules made under this Act.
q) Regulation: means regulation made by the Authority under this Act.
r) Rules: means rules made by the Authority under this Act.

CONSTITUTION OF AUTHORIY
3. Constitution of Authority-
i. With effect from such date as the State Government may, by notification in the official
Gazette, appoint in this behalf, there shall be constituted, for th e purpose of this Act, an
Authority, to be called Baba Baidyanath Dham – Basukinath Shrine Area Development
Authority.
ii. The Authority shall be constituted with the following members:-
A. Chief Minister – Chairman
B. Minister holding the Charge of Tourism, Art Culture, Sports and Youth Affairs Department /
Ministry – Vice Chairman
C. Chief Secretary – Vice Chairman
D. Secretary, Finance and Planning – Member
E. Secretary, Home, Prisons and Disaster Management – Member
F. Secretary, Health - Member
G. Director General of Police - Member
H. Commissioner, Santhal Pargana – Member cum CEO of Authority
I. Deputy Commissioner, Deoghar – Member
J. Deputy Commissioner, Dumka – Member
K. Deputy Inspector General of Police, Santhal Pargana – Member
L. Mayor, Deoghar Municipal Corporation – Member
M. Head of Basukinath Nagar Panchayat - Member
N. Secretary, Tourism, Art Culture, Sports and Youth Affairs Department – Member

O. Members of Parliament of Lok sabha Constituency where Baba Baidyanath and Basukinath
Temple are situated – Members
P. Members of Legislative Assembly where Baba Baidyanath and Basukinath Temple are
situated – Members
Q. Chairman, Jharkhand Hindu Religious Trust Board, or his representative - Member
R. Head of Panda Dharma-rakshini Sabha (located at Deoghar) and one more representative –
Members
S. One representative of any existing society of Panda (priests) of Basukinath Dham - Member
T. Two eminent and distinguished Non -Government Persons, who evince interest in
development of Shrine area of Baba baidyanath and Basukinath area, to be nomin ated by
State Government, for three years. - Members

iii. If the Chairman or Any of the other members mentioned in section 3(ii) or in section 21 be
not a Hindu, the state government may nominate any eminent person professing Hindu
religion, holding similar status and discharging similar duties.
iv. The Baba Baidyanath Dham – Basukinath Shrine Area Development Authority ("Authority"
in brief) may associate with itself in such manner and for such purposes as may be determined
by regulations, any person whose assistance or advice it may desire in complying with any of
the provisions of the Act and a person so associated shall have the right to take part in the
discussion of the Authority relevant to the purpose for which he has been associated but sh all
not be entitled to vote.
v. The Authority shall be responsible for development of the Shrine area with particular reference to
the welfare, safety, security and provision of facilities to pilgrims and visitors and may from time
to time deliberate and take initiative on, welfare of and facility to pilgrims and visitors, policy,
direction, implementation; ways to augment resources including revenue from Mela and Temple,
Outsourcing, Financial management, Security and other matters of importance and utility f or
Mela and temple and advise and direct the Divisional and district level administrative officers as
well as officers of all departments related to administration and management of Temple and Mela.
vi. The Headquarter of the Authority shall be located at Deoghar (Santhal Pargana).
4. Powers and functions of the Chairman and Vice-Chairman of the Authority-
I. The chairman of the authority shall, in addition to presiding over the meetings of the
authority, exercise and discharge such power and function of the auth ority which are
delegated to him by the authority. In case of any emerging requirement, the Chairman
shall be competent to take any decision on the issues related to the purpose of the
Authority, but the same shall be discussed and ratified by the authority.
II. The Vice -Chairman of the authority shall exercise and discharge such powers and
functions as may be prescribed or as may be delegated to him by the chairman.
5. Removal of members from their office - The State Government may remove from the authority
any member who in its opinion-
a) refuses to act ;
b) has become incapable to act ;
c) has so abused his office as to render his continuance in office detrimental to the public or
Government interest; or
d) is otherwise unsuitable to continue as a member .

6. Chief Executive Officer and Additional District magistrate, Additional Superintendent of
Police & Other officers –
i. There may be Additional District Magistrate duly notified by the Government who will
assist CEO and work under district Magistrate and also manage the aff airs of authority
under the guidance of CEO.
ii. There shall be one Additional Superintendent of Police, duly notified by the Government
who will be working under the Superintendent of police.
iii. For the Shrine area, the government may further notify Sub -Division & Police stations,
recommended by Authority for any such period, which the government feels expedient to
do so, and also depute additional sub divisional magistrates and additional sub divisional
police officers for such period.
7. Meetings of the Committees - (1) The Authority shall meet at least twice during the year,
provided that at least one meeting must be held three months prior to the commencement of
Shrawani Mela.
(2) The Authority may meet at any time and convene meetings keeping in view the
commencement of Shrawani mela and / or as and when desired by the Chairman.
CHAPTER III
POWERS AND FUNCTIONS OF THE AUTHORITY
8. Powers and Functions of the Authority-
I. The Authority may take decision as the case may be, for proper functioning, development,
regulation and management of Shrine Area, with particular reference to the welfare,
safety, security and provision of facilities to pilgrims and visitors.
II. The Authority may direct and decide policy for the augmentation of revenue sources,
arrangement of fund, by grants, outsourcing, Government or other sources.
III. Impose entry & Toll fees - The Authority shall have powers to impose an entry fee and
surcharge for the any period, on mechanical transport, lodging houses, retail shopkeepers'
advertisements, entertainment programmes (theatre, Circus etc) and such items as the
authority deems fit, to be specified by the Authority from time to time, and may or may
not be same for various activities or locations. It also includes tolls on any vehicle or
animal entering into o r any person bringing goods or sale into such area. It also includes
fees on registration of animals sold within such area.
IV. Power to provide amenities: The Authority shall be responsible and shall provide
amenities to the visitors, pilgrims, persons or ass ociations, group of persons, associated

with Shrine area including mela and shall have the power to impose user fee for the same.
V. The Authority may undertake charitable functions for the benefit of pilgrims, poor and
destitute and any other such people related to affairs of Shrine Area.
VI. The Authority shall have powers to advise and direct the Divisional and district level
administrative officers as well as officers of all departments related with development,
administration and management of Shrine Area.
VII. The Authority shall prepare, for the Shrine area, any master plan and make regulations for
imposition of restrictions on such activities, which may be detrimental to the conduct of
pilgrim affairs as well as danger to human beings and animals.
VIII. Power to License - The authority, may, by rule, prescribe fees on payment of which any
condition subject to which any person or class of persons may be licensed to ply any
profession, trade or calling in the Shrine Area.
9. Special Powers of the Authority- The Authority shall have powers to make recommendations to
the State Government for bringing any new area or activities related to pilgrimage, or any such
functions under its authority, considering its cultural, social and religious importance or on the
basis of receipt of information in this regard from other sources.
10. Control and Guidance - During mela period or implementation of activities falling under the
jurisdiction of Authority, Divisional, district and other field level officers and employees of all
departments of the State Government as well as officers and personnels of local bodies associated
with development of Shrine Area including management of mela, will act under the guidance of
Authority.
11. Recommendation for taking action - The Authority shall have powers to recommend action
against any officer or employee of the State Government associated with the development of
Shrine area including management of mela, according to the prevailing Act and Rules made by
the State Government, in this regard.
12. Powers to mak e Rules : (1) The Authority may make rules generally for carrying out the
purposes of this Act, and in particular for :
i. The work distribution of employees deputed to the Authority
ii. Sanitation in Shrine area,
iii. Smooth conduct of Mela

(2) The rules made by the Authority shall be applicable after its ratification by the state
government.
CHAPTER IV
POWER AND FUNCTION OF CHIEF EXECUTIVE OFFICER & ADDITIONAL DISTRICT
MAGISTRATES AND ADDITIONAL SUPERINTENDENT OF POLICE
13. The Chief Executive Officer (CEO) - The State Government shall confer the power of District
Magistrate defined under Cr.P.C. 1973 for Shrine area as well as other powers to CEO to regulate
the Shrine Area including the mela.
14. The CEO shall function and discharge all the duties conferred upon him by the authority.
15. The CEO shall have, apart from any other function, following powers and duties:
a) To take stock of Law & Order situation and make proper arrangements for requisite
precautionary measures as well as deputations of magistrate & police force in
consultation of DC, SP as well as DIG of the concerning Jurisdiction.
b) To impose toll on any vehicle or animal entering into, or any person bringing goods
for sale into such area and to impose any other fee on registration of commercial
activities within Shrine area, after consulting the Authority.
c) To temporarily allot any government space for various purposes directly or indirectly
related to the affairs of the Shrine area, falling under Shrine area in the manner, duly
discussed and passed by the authority. This shall include following activities:
i. Religious societies with which the Shrine area is connected.
ii. Social and other societies and organisation.
iii. Officials
iv. Market places
v. Latrines, urinals and rubbish heaps
vi. Bathing Places
vii. Recreation and entertainment and
viii. Any other Exhibitions and demonstration
d) To liaison with Local non -governmental organizations, public representatives,
government officials, local authorities and state government.
e) To demolish any structure in case of an outbreak of fire in a manner so that the loss to

the affected person or organization is minimum.
f) To implement any penalty prescribed in the Act.
g) To delegate any or such powers to the other officers, duly notified for the purpose
specified, by the government for any period, in Shrine area.
16. Subject to the rules made under sub -section 12(i), the CEO may give appropriate directions
against the outbreak or spread of fire, and particularly for the following purposes :
i. Providing for the safety of buildings and structures put up in the Shrin e area, and of
articles brought in the shrine area.
ii. Prescribing conditions subject to which huts and other structure may be constructed
including limits to the height of such huts or a structure and the area on which they are to
be built and distances between them.
iii. Providing for the supply of sand and jars of water at each point or elsewhere, and
iv. Restricting the use of fires, for cooking or for any other purpose.
17. The Chief Executive Officer may remove any unauthorised construction which is not in
consonance with master plan of the Shrine area, and the cost of such removal may be recovered
from the person making such construction, as an arrear of land revenue.
18. The CEO or the officers to whom this power is duly delegated by CEO, shall have powers to
penalise the person as per Sec 23 of the Act.
19. Powers and Functions of Additional Superintendent of Police (ASP) : The Additional SP shall
have following powers and duties:
a) To act under the guidance of SP of the district.
b) To assist the CEO for any affair, which h e feels expedient to be assisted, for conduct of
affairs of Authority including mela.
c) To implement the decisions of Authority..
d) To suggest to Authority for creation of Police sub -divisions, local police stations, in
Shrine area, in consultation with Distri ct Magistrate, for the purpose of Law and Order
Maintenance, whereas the regular criminal investigation affairs shall remain with the
original police station.

e) To coordinate with the local administration and the authority.
20. Powers and Functions of Additiona l District Magistrate: - The Additional District magistrate
has following power and duties.
a) To act under the guidance of District magistrate in the Shrine area including mela area.
b) To assist the CEO for any affair, which he feels expedient to be assisted.
c) To implement the decisions of Authority.
d) To suggest to Authority for creation of Police sub -divisions, local police stations, in Shrine area,
in consultation with District Magistrate, for the purpose of Law and Order Maintenance,
whereas the regular criminal investigation affairs shall remain with the original police station.
e) To coordinate with the local administration and the authority.
CHAPTER V
FORMATION OF EXECUTIVE COUNCIL
21. There shall be an executive council for the execution and implementation of the decision taken by
the authority under the Chairmanship of CEO.
(1) The executive council consists of following members.
i. Divisional Commissioner, Santhal Pargana (Dumka) –cum-CEO- Chairman
ii. DIG, Santhal Pargana (Dumka) - Member
iii. Deputy Commissioner, Deoghar - Member
iv. Deputy Commissioner, Dumka - Member
v. Superintendent of Police, Deoghar - Member
vi. Superintendent of Police, Dumka - Member
vii. Executive Engineer Deoghar –
(Building, Road Construction Department,
Drinking Water & Sanitation, Electricity,
Rural Engineering Department) - Member
viii. Municipal Commssioner, Deoghar Municipal
Corporation - Member
ix. Chief Executive Officer, Basukinath Nagar Panchayat - Member
x. Civil Surgeon, Deoghar - Member
(2) The Authority if so desire, may nominate two additional members.
22. Powers and functions of Executive Council: The Executive Council shall have the following

powers and functions:
i. To implement the directives & decisions of Authority
ii. To coordinate between the various departments
iii. To advice & suggest the Authority on the matters and subjects related to Shrine Area.
iv. Actual implementation of the projects or assist the schemes sanctioned and implemented by
any other department in Shrine Area.
CHAPTER VI
MISCELLANEOUS
23. Penalties-Any Person who-
(a) Makes any unauthorised construction, or
(b) Uses any unauthorized place as latrine, urinal or rubbish dump, or
(c) Plies any profession, trade or calling without a licence obtained under the provisions of
section 8(viii) or commits a breach of the conditions of such licence, or
(d) Contravenes any of the provisions of the Act of any rules made under the Act, or
(e) disobeys any order or direction in writing lawfully under this Act,
