क) ”7gफyphूननवचा7gफyphि71लत बचाव 7gफyphूपनणाल7gफyphल4ि ” से अ7gफyphि71भ7gफyphूपनेत है, ऐसी 7gफyphूपनणाल7gफyphल4ि िजसम7gफyphलिू य7gफyph466द भवन म7gफyphलिू 7gफyph467बजल7gफyphल4ि चल7gफyphल4ि जाती है तो
7gफyphि71ल7gफyphूूूट अपने 7gफyph47ईनकटतम सतह पर 7gफyphल11क कर खुल जायेगा ;
ख) ”ए7gफyphूननक े लेटर “ से अ7gफyphि71भ7gफyphूपनेत है सवा7gफyph46लरय7gफyphलि6 को ऊपर या नीचे ले जाने या ले आने के 7gफyphि71लए 7gफyph467बजल7gफyphल4ि पर 7gफyph47ईनरंतर

ए7gफyphूननक े लेटर अ7gफyphि76ध7gफyphूनूठापन 7gफyphूननथल आता है;
ड0) “ 7gफyphि71ल7gफyphूूूट ” से अ7gफyphि71भ7gफyphूपनेत है, 7gफyph467बजल7gफyphल4ि से चलने वाल7gफyphल4ि ऊपर या नीचे ले जाने या ले आने क े 7gफyphि71लए 7gफyphि74पंजरानुमा यं7gफyphूिि
7gफyphूपनणाल7gफyphल4ि , वा7gफyphूननतव म7gफyphलिू िजसका उपयोग सवार7gफyphल4ि या माल या द7gफyphलि6न7gफyphलि6 को ढोने क े 7gफyphि71लए 7gफyphि7नकया जाता है;

करता है;
7gफyphूननप7gफyphूनूट7gफyphल4िकरण:2 इस ख7gफyphू1लड क े 7gफyphूपनयोजनाथ7gफyph11ई 7gफyphि71ल7gफyphूूूट 7gफyphूपनचालक भी सवार7gफyphल4ि माना जायेगा।
ठ) “7gफyph467बजल7gफyphल4ि “ म7gफyphलिू 7gफyphि74व7gफyph6ूनयुत , जल 7gफyphि74व7gफyph6ूनयुत , पवन 7gफyphि74व7gफyph6ूनयुत या यां7gफyph4677gफyphूििक7gफyphल66 7gफyphि74व7gफyph6ूनयुत आ7gफyph466द अथवा इनका कोई संयोजन

1) 7gफyphि71ल7gफyphूूूट या ए7gफyphूननक े लेटर क े अ7gफyphि76ध7gफyphूनूठापन क े प7gफyphून1चात उसका मा7gफyphि71लक एक माह क े भीतर ऐसी 7gफyphि71ल7gफyphूूूट या ए7gफyphूननक े लेटर
क े 7gफyph47ईनबंधन हेतु यथा 7gफyphि74व7gफyph466हत शु7gफyphूूिक क े साथ 7gफyphि74व7gफyph466हत फारम म7gफyphलिू आवेदन करेगा। शु7gफyphूूिक अ7gफyphूपन7gफyph47ईतदेय होगा ;
2) सभी तरह से प ूण7gफyph11ई आवेदन 7gफyphूपना7gफyphूू1त होने पर 7gफyph47ईनर7gफyphल4ि7gफyph16नक 30 7gफyph466दन7gफyphलि6 क े भीतर 7gफyphि71ल7gफyphूूूट या ए7gफyphूननक े लेटर क7gफyphल66 सं7gफyphूईूया
नीयत करते हुए इ7gफyphूूईह7gफyphलिू 7gफyph47ईनबं7gफyphि76धत करेगा ;

या ए7gफyphूननक े लेटर क े वा7gफyphि74ष7gफyph11ईक रख2रखाव क7gफyphल66 सं7gफyphि74वदा या क7gफyphल66 गई कोई अ7gफyphूूईय 7gफyphूनईयव7gफyphूननथा क7gफyphल66 7gफyphूपन7gफyph47ईत 7gफyphूपन7gफyphू16येक वष7gफyph11ई 7gफyph47ईनर7gफyphल4ि7gफyph16नक
को देगा।

7gफyphि74व7gफyph466हत फारम म7gफyphलिू एवं र7gफyphल4ि7gफyph47ईत से सभी वा7gफyphि74ष7gफyph11ईक सुर7gफyph16ना 7gफyphूपनमाण प7gफyphूिि देगा ;
5. /glyph:ददवचा/glyph8िँलत बचाव /glyph:बदणाल/glyph548:-
7gफyph467बजल7gफyphल4ि चल7gफyphल4ि जाने क7gफyphल66 दशा म7gफyphलिू 7gफyphि71ल7gफyphूूूट म7gफyphलिू फ ं से सवा7gफyph46लरय7gफyphलि6 को बचाने हेतु उसका मा7gफyphि71लक 7gफyphूननवचा7gफyphि71लत बचाव

ए7gफyphूननक े लेटर का 7gफyph47ईनर7gफyphल4ि7gफyph16नण तीन वष7gफyph6ईि म7gफyphलिू एक बार 7gफyphि7नकया जायेगा। ऐसे 7gफyph47ईनर7gफyphल4ि7gफyph16नण क े 7gफyphि71लए 7gफyphि7नकसी अ7gफyphूूईय 7gफyphि74व7gफyph6ूनयुत
अ7gफyphि76ध7gफyphूनूठापन जाँच शु7gफyphूूिक क े अ7gफyph47ईत7gफyph46लर7gफyphूई1त 7gफyphि74व7gफyph466हत शु7gफyphूूिक 7gफyphि71लया जायेगा।

क7gफyphल66 ता7gफyph46लरख से पुव7gफyph11ई प7gफyph46लरसर7gफyphलि6 म7gफyphलिू 7gफyphि71ल7gफyphूूूट या ए7gफyphूननक े लेटर का अ7gफyphि76ध7gफyphूनूठापन 7gफyphि7नकया है वह इसक े 7gफyphूपनभावी होने क े दो माह
क7gफyphल66 अव7gफyphि76ध क े भीतर ऐसे 7gफyphि71ल7gफyphूूूट या ए7gफyphूननक े लेटर क े 7gफyph47ईनबंधन क े 7gफyphि71लए आवेदन करेगा ;
2) ऐसे आवेदन पर धारा24 क7gफyphल66 उपधारा2(2), (3) एवं (4) क े उपबंध लागू ह7gफyphलि6गे;
10. /glyph4िषनर/glyph548/glyphँुदण के /glyph8िँलए /glyph8िदकसी भवन म/glyph58: /glyph:बदवेश करने का अ/glyph8िुधकार:-

ए7gफyphूननक े लेटर7gफyphलि6 क7gफyphल66 यथा आव7gफyphून1यक मर7gफyphूूलमत या प7gफyph46लरवत7gफyph11ईन कराने का 7gफyph47ईनदेश दे सकता है अथवा वह उसका उपयोग
तब तक रोक सकता है, जबतक 7gफyphि7नक उसका समाधान न हो जाय 7gफyphि7नक ऐसी मर7gफyphूूलमत या प7gफyph46लरवत7gफyph11ईन करा 7gफyphि71लये गये
ह7gफyphलि4 या असुर7gफyphि7प7gफyph16नत अव7gफyphूननथा दूर कर ल7gफyphल4ि गई है।
12. सील करना:-
1) कोई 7gफyphि71ल7gफyphूूूट या ए7gफyphूननक े लेटर िजसक े संबंध म7gफyphलिू धारा211 क े अधीन कोई 7gफyph47ईनद7gफyphल67श 7gफyph47ईनग7gफyph11ईत 7gफyphि7नकया गया है, उसका
7gफyph47ईनर7gफyphल4ि7gफyph16नक क े समाधान होने तक पालन नह7gफyphल4िं 7gफyphि7नकया गया है, ऐसे 7gफyphि71ल7gफyphूूूट या ए7gफyphूननक े लेटर को य7gफyph466द उसी अव7gफyphूननथा म7gफyphलिू
चलता हुआ पाया जाता है, तो 7gफyph47ईनर7gफyphल4ि7gफyph16नक 7gफyph6ूनवारा उसे सील करने का आदेश 7gफyph466दया जा सकता है;
2) उपधारा2(1) क े अधीन 7gफyphि7नकये गये आदेश क े 7gफyphि74व7gफyphल117gफyph4ूल कोई अपील मु7gफyphूईूय 7gफyphि74व7gफyph6ूनयुत 7gफyph47ईनर7gफyphल4ि7gफyph16नक , ऊजा7gफyph11ई 7gफyphि74वभाग , झारख7gफyphू1लड

ऐसे 7gफyphि71ल7gफyphूूूट या ए7gफyphूननक े लेटर का अ7gफyphि76ध7gफyphूनूठापन पूरा होने क े प7gफyphून1चात मा7gफyphि71लक को तृतीय प7gफyph16न बीमा सु7gफyph47ईनि7gफyphून1चत

करने वाले 7gफyph47ईनर7gफyphल4ि7gफyph16नक को यथा 7gफyphि74व7gफyph466हत फारम म7gफyphलिू देगा और 7gफyph47ईनर7gफyphल4ि7gफyph16नक क7gफyphल66 7gफyphि71ल7gफyphि7ूखत अनुम7gफyph47ईत क े 7gफyph467बना इसे पुनः
चालु नह7gफyphल4िं करेगा ;
15. समवत/glyph5ुब दा/glyph4िषय/glyph:ँुव:-
ऐसे 7gफyphि71ल7gफyphूूूट या ए7gफyphूननक े लेटर क े 7gफyphि7नकसी सुर7gफyph16ना उपबंध क े ठ7gफyphल4पक से काय7gफyph11ई नह7gफyphल4िं करने क े चलते दुघ7gफyph11ईटना होने क7gफyphल66

16. बंद होने क/glyph5ुु सूचना देना:-
य7gफyph466द 7gफyphि7नकसी भवन म7gफyphलिू जहाँ 7gफyphि71ल7gफyphूूूट या ए7gफyphूननक े लेटर अ7gफyphि76ध7gफyphूनूठा7gफyphि74पत 7gफyphि7नकये गये ह7gफyphलि4, वह काय7gफyph11ई नह7gफyphल4िं करता है तो मा7gफyphि71लक
7gफyph6ूनवारा इसक7gफyphल66 सूचना एक माह क7gफyphल66 अव7gफyphि76ध क े भीतर 7gफyph47ईनर7gफyphल4ि7gफyph16नक को द7gफyphल4ि जायेगी।

7gफyphि71लया जायेगा तथा मा7gफyphि71लक धारा24 क े अधीन नया 7gफyph47ईनबंधन क े 7gफyphि71लए आवेदन करेगा।
18. /glyph8िँश/glyph8िुथल करने क/glyph5ुु शि/glyph:षँत:-
सरकार 7gफyphि71ल7gफyphि7ूखत आदेश 7gफyph6ूनवारा इस अ7gफyphि76ध7gफyph47ईनयम या एतदधीन बनाये गये 7gफyph47ईनयम7gफyphलि6 क े 7gफyphि7नकसी उपबंध को ऐसी
शत7gफyph11ई क े अ7gफyphू1पयधीन , जो वह उ7gफyphि76चत समझे 7gफyphि71श7gफyphि76थल कर सकती है।
19. शि/glyph:षँतय/glyph58ु का /glyph:बद/glyph:ँुयायोजन:-
सरकार इस अ7gफyphि76ध7gफyph47ईनयम 7gफyph6ूनवारा या इसक े अधीन 7gफyphूपनदत शि7gफyphूई1तय7gफyphलि6 को 7gफyphि7नकसी ऐसे पदा7gफyphि76धकार7gफyphल4ि को 7gफyphूपन7gफyphू16यायोिजत
कर सकती है, िजसे वह उ7gफyphि76चत समझे।
20. शाि/glyph:ददत:-
जो कोई इस अ7gफyphि76ध7gफyph47ईनयम या एतदधीन बनाये गये 7gफyph47ईनयम7gफyphलि6 क े 7gफyphि7नकसी उपबंध का उ7gफyphूूिलंघन करता है, तो वह
दोष 7gफyphि71स7gफyphि747gफyph4ूल होने पर तीन माह तक का कारावास या पचास हजार 7gफyphल11पये तक का जुमा7gफyph11ईना या दोन7gफyphलि6 से द7gफyphू1लडनीय
होगा तथा लगातार उ7gफyphूूिलंघन करने पर 7gफyphूपनथम बार ऐसे उ7gफyphूूिलंघन क े 7gफyphि71लए दोष 7gफyphि71स7gफyphि747gफyph4ूल क े प7gफyphून1चात जार7gफyphल4ि उ7gफyphूूिलंघन
क े दौरान 7gफyphूपन7gफyph47ईत7gफyph466दन एक हजार 7gफyphल11पये तक का अ7gफyph47ईत7gफyph46लर7gफyphूई1त जुमा7gफyph11ईना लगेगा।
21. अपराध का सं/glyphँुिान:-
इस अ7gफyphि76ध7gफyph47ईनयम क े अधीन 7gफyph47ईनयु7gफyphूई1त 7gफyph47ईनर7gफyphल4ि7gफyph16नक 7gफyph6ूनवारा 7gफyphि7नकये गये प7gफyph46लरवाद क े अलावे कोई भी 7gफyphूूईयायालय इस

ञ) कोई अ7gफyphूूईय मामला जो 7gफyphि74व7gफyph466हत 7gफyphि7नकया जानेवाला हो या 7gफyphि74व7gफyph466हत 7gफyphि7नकया जा सक े;
3) इस अ7gफyphि76ध7gफyph47ईनयम क े अधीन बनाया गया 7gफyphूपन7gफyphू16येक 7gफyph47ईनयम बनाये जाने क े तुरंत बाद रा7gफyphूईिय 7gफyphि74वधानमंडल क े सम7gफyph16न
रखा जायेगा , जब वह स7gफyphूिि म7gफyphलिू हो , य7gफyph466द सदन सहमत हो जाता है 7gफyphि7नक 7gफyph47ईनयम म7gफyphलिू उपांतरण 7gफyphि7नकया जाय अथवा

An Act to provide for the regulation of the constru ction, installation, maintenance and safe working o f lifts
and escalators and all machinery and apparatus pertaining thereto in the State of Jharkhand.
Be it enacted by the Legislature of the State of Jha rkhand in the Sixty Seventh year of the
Republic of India as follows :-
Short title,
extent and
commencement
1 (1) This Act may be called as The Jharkhand Lift a nd Escalators Act, 2017.
(2) It extends to the whole State of Jharkhand.
(3) It shall come into force on such date, as the Go vernment may, by
notification in the Official Gazette.
Definitions. 2 In this Act unless the context otherwise required, -
(a) “automatic rescue device” means a device which , in case of power
failure in the building, enables the lift to land and stop at the nearest
landing floor and open the landing and lift cage doors simultaneously;
(b) “escalator” means a moving inclined continuous stairway or runway
used for raising or lowering passengers, which work on power;
(c) “Government” means the Government of the State of Jharkhand;
(d) “Inspector” means the Electrical Inspector app ointed by State
Government under Sub Section (1) of Section 162 of t he Electricity Act,
2003 (Central Act 36 of 2003), who has Territorial Jurisdiction over the
place of installation of a lift or an escalator;
(e) “lift” means a hoisting and lowering mechanism e quipped with a cage
which moves in an upward and downward direction, and wo rk on
power and is designed or is actually used to carry pass engers or goods,
or both;
(f) “lift cage” means a car or a cage of a lift use d for the conveyance of
passengers or goods, or both;
(g) “lift installation” includes a lift cage, a lift way, a lift way enclosure, and
an operating mechanism of the lift and ropes, cables , wires, safety
provisions and plant and machinery connected with t he operation of
the lift;
(h) “ lift way” means a shaft or hoist way in which the lift cage travels;
(i) “lift way enclosure” includes any substantial st ructure surrounding or
enclosing the lift way;
(j) “owner” means an owner or occupier or office be arer of a society or an

association, or a tenant, of the whole or part of a premises, who has
applied for registration;
(k) “passenger” means any person who uses the lift or escalator for the
purpose of his conveyance;
Explanation.- For the purpose of this clause, a lift operator sh all also be
treated as a passenger;
(l) “power” includes electrical, hydraulic, pneumatic or mechanical power,
etc. or a combination of any of these;
(m) “premises” means any structure, whether tempora ry or permanent,
where a lift or escalator is installed;
(n) “prescribed” means prescribed by rules made under this Act;
(o) “registration” means assignment of a number to a lift or escalator by the
Inspector under section 4 of this Act.
(p) “section” means a section of this Act;
(q) “State” means the State of Jharkhand.
Appointment of
officers and
officials.
3 (1) The Government shall, by notification in the Official Gazette, appoint a
Chief Electrical Inspector and as many Inspectors ot her officers and
officials, as may be necessary, having such qualifi cations as may be
prescribed, for the purpose of performing the funct ions assigned to
them by or under this Act.
(2) The Chief Electrical Inspector shall have gener al superintendence and
control over the Inspectors and other officers and of ficials in the State
and may issue necessary directions for carrying out the purpose of this
Act.
Registration. 4 (1) Every owner shall, within a period of one mont h after the completion of
the installation of a lift or an escalator, apply f or registration for such
lift or escalator, in such form and manner along with such fee as may be
prescribed. The fee shall be non-refundable.
(2) On receipt of an application, complete in all r espects, the Inspector shall
register the lift or escalator, by assigning a number to it within a period
of thirty days.
(3) Every owner of a lift or escalator, shall submi t every year a copy of
annual lift or escalator maintenance contract or any other arrangement
made for maintenance of lifts and escalators to the Inspector in token of
having the contract or arrangement made with any lif t or escalator
maintenance company for the smooth and safe running of the lift or
escalator.
(4) Every owner of a lift or escalator shall also f urnish all annual safety
certificates in such form and manner as may be presc ribed for the
smooth and safe running of the lift or escalator.
Automatic
rescue device.
5 The owner shall make arrangement to provide for an automatic rescue
device to rescue the travelling passengers trapped i n the lift in the event of
breakdown of power supply by bringing and stopping th e lift at the nearest
landing floor and keeping the landing and lift cage door open.
Alternate power
supply system.
6 The owner shall make arrangements to provide for a lternative automatic
power supply system to ensure the functioning of th e lift in the event of
breakdown of power supply within a period of thirty seconds.
Inspection. 7 Every lift and escalator which has been registered shall be inspected once in
a period of three years by the Inspector or by an of ficer or an agency

authorized by the Government on its behalf. A fee as may be prescribed shall
be charged for such inspection, in addition to any ot her electrical
installation testing fees.
Code of practice. 8 (1) Save as otherwise provided in this Act, the r elevant code of practice of
the Bureau of Indian Standards (including National Bu ilding Code and
National Electrical Code), if any, may be followed to carry out the
purposes of this Act and in the event of any inconsi stency, the
provisions of this Act and the rules made there under shall prevail.
(2) The material and apparatus used shall confirm to the relevant
specifications of the Bureau of Indian Standards where such
specifications have already been laid down.
(3) The number of lifts or escalators to be insta lled in a premises and the
spacing between them shall be governed as per the re levant code of
practice of Bureau of Indian Standards and the National Building Code.
Registration of
existing lifts and
escalators.
9 (1) Notwithstanding anything contained in sectio n 4, every owner who has
installed a lift or an escalator in premises before the date of the
commencement of the Act, shall within a period of tw o months from
such commencement, apply for a registration of such lift or escalator.
(2) The provisions of sub-sections (2), (3) and (4 ) of section 4 shall, apply
to such application.
Right to enter
any building for
inspection.
10 An inspector at all reasonable hours, with such assistants, if any, being
persons in the service of the Government, as he thi nks fit, may enter any
premises in which a lift or an escalator is install ed or in connection with
which an application for registration has been rece ived, for the purpose of
inspection the lift or escalator or their installation or the site thereof.
Lifts or
escalators in an
unsafe
condition.
11 If, upon an inspection as it is carried out under section 7, the Inspector finds
that any lift or escalator in any building is in an unsafe condition, he may
direct the owner requiring such repairs or alterations to be made to such lift
or escalators, as he may deem necessary, within the period specified by him
and may also forbid the use of such lift or escalator until such repairs or
alterations are carried out or such unsafe condition is removed to his
satisfaction.
Sealing. 12. (1) Any lift or escalator in respect of which a direction is issued under
section 11 has not been carried out to the satisfact ion of the Inspector,
such lift or escalator, in case the same is found b eing used may be
ordered to be sealed by the Inspector.
(2) An appeal against an order under sub-section (1) shall lie to the Chief
Electrical Inspector, Energy Department, Jharkhand, whose decision
shall be final.
Insurance. 13 The owner shall, after the completion of the ins tallation of such lift or
escalator, ensure third party insurance mandatory so as to cover the risk of
passengers using such lift or escalators.
Log book and
reporting.
14 (1) The owner shall, maintain a log book for ea ch lift and escalator and
enter therein the details of operation, break-down (other than failure in
electrical supply) and accident, if any. This log boo k may be inspected
by the Inspector as and when he desires.
(2) Whenever any accident occurs in the process o f operation of any lift or

escalator causing injury to any person, the owner shall, within a period
of twenty-four hours of the accident, give intimation with full details of
accident, in such form as may be prescribed, to the I nspector the
working of such lift or escalator, shall not be res umed except, with the
written permission of the Inspector.
Concurrent
liability.
15 The lift or escalator installation or maintenanc e company, as the case may
be, may also be prosecuted and held liable for punishment under this Act in
case an accident occurs in the lift or escalator, du e to malfunctioning of any
of the safety provisions of the lift or escalator, if attributable to such lift or
escalator installation or maintenance company.
Intimation
about closure.
16 If any building where lift or escalator is insta lled gets decommissioned,
intimation about this shall be given by the owner t o the Inspector within a
period of one month.
Life span. 17 A lift or escalator installed in the premises sha ll be replaced by the owner of
the lift or escalator, after the period of twenty ye ars of its installation. Such
replacement shall be completed within the twenty-fir st year of the
installation of the lift or escalator, and the owner shall apply for a fresh
registration under section 4.
Power to relax. 18 The Government may, by order in writing, direct th at any of the provisions
of this Act or the rules made thereunder shall be re laxed subject to such
conditions as it may be fit.
Delegation of
powers.
19 The Government may, delegate any of its powers co nferred on it by or under
this Act, to such officer as it may deem fit.
Penalty. 20 Whoever contravene any of the provisions of this Act, or the rules made
thereunder shall, on conviction be punishable with imprisonment for a term
which may extend to three months, or with fine which may extend to fifty
thousand rupees, or both, and in the case of a continuing contravention with
an additional fine which may extend to one thousand rup ees for every day
during which such contravention continues after conv iction for the first
such contravention.
Cognizance of
offence.
21 No Court shall take cognizance of any offence un der this Act except on
complaint made by the Inspector, appointed under the Act.
Protection for
action taken in
good faith.
22 No suit, prosecution or other legal proceedings shall lie against any person
in respect of anything which is done in good faith or intended to be done in
pursuance of the provisions of this Act, or of the rules made thereunder.
Power to make
rules.
23 (1) The Government may, by notification in the Gazette, make rules for the
purpose of this Act.
(2) In particular and without prejudice to the gene rality of the foregoing
power, such rules may provide for all or any of the following matters,
namely :-
(a) Specifications for lifts and escalators;
(b) The manner in which erection plans of lift and escal ators shall be
submitted;

(c) The manner in which lifts and escalators may be tested;
(d) The form of application of permission for the erect ion of lift and
escalators and license for working such lifts and escalators;
(e) The form of report of completion to be sent under s ub-section (4)
of section 1;
(f) The term and conditions and restrictions subject to which, and the
form in which, the license may be granted for the wo rking of lifts
and escalators and the fees to be paid in respect of such licence;
(g) The manner in which and the terms subject to which t he lifts and
escalators shall be worked;
(h) The manner in which notice of accidents shall be given;
(i) The form of notice of accidents to be given under section 14 (2);
(j) The form and manner to file appeal; and
(k) Any other matter which is to be, or may be prescribed.
(3) Every rules made under this Act shall be laid, as soon as may be, after it
is made, before the House of the State Legislature, while it is in session,
if the House agrees in making any modification in the rule or the House
agrees that the rule should not be made, the rule sha ll thereafter have
effect only in such modified form, or be of no effect, as the case may be;
so, however, that any such modification or annulment shall be without
prejudice to the validity of anything previously done under that rule.
Savings. 24 Nothing contained in this Act shall affect the pr ovisions of the Electricity
Act, 2003 (36 of 2003) or the rules made thereunder.
