औƭोिगक ǒवकास क े Ĥो×साहन क े उƧेæय से ǒविभÛन अनु£िƯयɉ , अनुमितयɉ एवं èवीकृितयɉ को
×वǐरत एवम् समयबƨ मंजूरȣ Ĥदान करने , नए िनवेशɉ को सुगम एवं सरल करने हेतु ĤǑĐया×मक
आवæयकताओं को कम करते हुए ǒविनयामक ढाँचे को सरल बनाने सहज åयापार åयवèथा मɅ सुधार लाने
क े िलए एवम् झारखÖड राÏय मɅ िनवेशकोनुक ू ल वातावरण उपलÞध करने हेतु एक ǒवधेयक एवम् यह
ǒवधेयक भारत गणराÏय क े 66वɅ वष[ मɅ िनàनवत् ǽप से झारखÖड ǒवधान सभा Ʈारा अिधिनयिमत
होता है:-

संǔ¢Ư शीष[क, सीमा एवं Ĥारंभ
(1) यह अिधिनयम “झारखंड िसंगल ǒवंडो ÈलीयरɅस अिधिनयम, 2015“ क े नाम से जाना जाएगा।
(2) यह अिधिनयम पूरे झारखÖड राÏय मɅ Ĥभावी होगा।
(3) यह अिधिनयम झारखंड सरकार क े राजपğ मɅ अिधसूचना कȧ ितिथ से Ĥभावी होगा।
2. जब तक संदभ[ अÛयथा न हो, इस अिधिनयम मɅ
(1) “एजɅसी“, का अिभĤाय झारखंड ओैƭोिगक संरचना ǒवकास िनगम (JIIDCO) है।
(2) Governing Body (शासी िनकाय ) का अिभĤाय धारा-4 क े तहत् गǑठत सिमित है।
(3) “अपीलीय Ĥािधकार“ से अिभĤाय धारा- 25 क े अंतग[त शǒƠ ĤाƯ सिमित है।
(4) “लागू अिधिनयमɉ“ से अिभĤाय है,
(क) ǒबहार दुकान एवम् वाǔणǔÏयक संèथान अिधिनयम, 1953
(ख) क े Ûġȣय ǒबĐȧ कर अिधिनयम , 1956
(ग) मातृ×व लाभ अिधिनयम, 1961
(घ) बोनस भुगतान अिधिनयम , 1965
(ड.) अनुबÛध Įम (रेगुलेशन व् एबोिलशन) अिधिनयम, 1970
(च) ĒेÍयुǑट अिधिनयम, 1972
(छ) समान पाǐरĮािमक अिधिनयम, 1976
(ज) झारखंड वैãयु एडेड कर अिधिनयम, 2005
(झ) जल (Ĥदूषण िनयंğण एवं िनषेध ) अिधिनयम, 1974
(ञ) वायु (Ĥदूषण िनयंğण एवं िनषेध ) अिधिनयम, 1981
(ट) पया[वरण (संर¢ण) अिधिनयम, 1986
(ठ) बॉयलर अिधिनयम, 1923
(ड) वेतन भुगतान (payment of wages) अिधिनयम, 1936
(ढ) कारखाना अिधिनयम, 1948
(ण) Ûयूनतम वेतन अिधिनयम, 1948
(त) ǒबहार ǒवƭुत अिधिनयम, 1948
(थ) झारखंड मनोरंजन कर अिधिनयम, 2012
या उƣरािधकारȣ/संशोिधत अिधिनयम या राÏय सरकार Ʈारा अिधसूिचत कोई अÛय सुसंगत /Ĥासंिगक
अिधिनयम।
(5) “स¢म Ĥािधकार “ से अिभĤाय है सरकार का कोई ǒवभाग या एजɅसी , èथानीय Ĥािधकार , वैधािनक
िनकाय, राÏय èवािम×वाधीन िनगम , पंचायती राज संèथाएं , नगरȣय èथानीय िनकाय या Ǒकसी अिधिनयम
या सरकार क े Ĥशासिनक िनयंğण क े अंतग[त गǑठत या èथाǒपत कोई अÛय Ĥािधकार या एजɅसी ǔजसक े
पास राÏय मɅ एक (åयापाǐरक) ĤितƵान èथाǒपत करने अथवा संचािलत करने क े िलए अनुमित Ĥदान या
जारȣ करने कȧ शǒƠ एवं जवाबदेहȣ है।
(6) “मंजूरȣ“ का अिभĤाय है झारखंड राÏय मɅ उƭम /ĤितƵान èथाǒपत करने क े संबंध मɅ Ǒकसी स¢म
Ĥािधकार Ʈारा अनापǒƣ Ĥमाण -पğ, आवंटन, सहमित, èवीकृित, अनुमित, िनबंधन, नामांकन, अनु£िƯ

जारȣ/Ĥदान करना एवम् इसक े अÛतग[त सǔàमिलत हɉगे वैसे सारे अनुमित , जो Ĥचिलत अिधिनयमɉ क े
अÛतग[त आवæयक हɇ।
(7) “ǒवभाग“ से अिभĤाय है, झारखंड सरकार का ǒवभाग।
(8) “ǔजला काय[कारणी सिमित“ से अिभĤाय है धारा-12 क े तहत् गǑठत सिमित।
(9) “ǔजला èतरȣय नोडल एजɅसी“ का अिभĤाय है, धारा- 14 क े तहत िनǑद[ƴ एजɅसी।
(10) “उƭमी“ से ता×पय[ है , एक åयǒƠ या åयǒƠयɉ का िनकाय /समूह या एक कàपनी , जो (Ǒकसी एक)
उƭम मɅ अिधकांश िनवेश या िनयंğण मɅ Ǿिच रखता है या रखने का Ĥèताव करता हो और जो िनवेश का
Ĥèताव
लाता हो।
(11) “सरकार“ से अिभĤाय है, झारखंड सरकार।
(12 ) "High Powered Committe" से अिभĤेत है, धारा- 6 क े तहत गǑठत सिमित।
(13) “औƭोिगक नीित“ से ता×पय[ है , झारखंड औƭोिगक नीित या झारखÖड सरकार Ʈारा अÛय ¢ेğ ǒवशेष
नीित अथवा क े Ûġ या राÏय (झारखÖड) सरकार कȧ वैसी योजनाएँ ǔजÛहɅ औƭोिगक संवƨ[न हेतु समय -
समय पर अिधसूिचत Ǒकया गया हो।
(14) “ अिधसूचना“ का ता×पय[ है , झारखंड राजप ğ मɅ Ĥकािशत अिधसूचना एवं अिधसूिचत शÞद का
पǐरĤेêयानुǽप अिभĤाय
(15) “ǒवǑहत“ से अिभĤेत है, इस अिधिनयम क े तहत Ĥावधािनत िनयम तथा इस अिधिनयम को लागू करने
हेतु Ĥचिलत अिधिनयमɉ क े तहत बनाए गए िनयम
(16) "Web Portal"से आशय है, एजɅसी Ʈारा संधाǐरत वेब पोट[ल।
3. Notification of Agency (एजेÛसी का अिधसूचना)
झारखÖड सरकार, राÏय मɅ नए िनवेशɉ क े िलए Single Window तथा औƭोिगक सरलीकरण को सिचवालय
समथ[न Ĥदान करने हेतु “झारखंड औƭोिगक आधारभूत संरचना ǒवकास िनगम “ (ǔजडको) को अिधसूिचत
करेगा।
4. Governing Body (शासी िनकाय)
(1) इस अिधिनयम क े उƧेæयɉ क े िलए एक Governing Body (शासी िनकाय) का गठन Ǒकया जाएगा।
(2) धारा- 4.1 क े तहत गǑठत Governing Body (शासी िनकाय) मɅ अÚय¢ एवं िनàन सूिचत सदèय हɉगे:-

(क) माननीय मुÉयमंğी अÚय¢
(ख). उƭोग मंğी उपाÚय¢

(ग) ǒवƣ मंğी सदèय
(घ) राजèव, िनबंधन एवं
भूिम सुधार मंğी सदèय
(ड.) मुÉय सिचव सदèय
(च) Ĥधान सिचव/सिचव, उƭोग सदèय सिचव
(छ) राÏय सरकार Ʈारा मनोनीत
अÛय नािमत, यǑद कोई हो सदèय
(3) अपने कायɟ क े समुिचत एवं Ĥभावी िनव[हन हेतु, यǑद आवæयक हो तो Governing Body (शासी िनकाय)
Ǒकसी दो ǒवशेष£ सदèय को सहयोǔजत कर सकता है।
5. Governing Body (शासी िनकाय) क े काय[
राÏय सरकार क े समĒ िनयंğ और पय[वे¢णाधीन रहते हुए Governing Body (शासी िनकाय) इस
अिधिनयम क े तहत समĒ नीित माग[दश[न एवं Ǒदशा-िनदȶश Ĥदान करेगा।
(1) Governing Body (शासी िनकाय) अपने Ĥभावी काय[ संचालन क े िलए आवæयक Single Window मंजूरȣ
एवं उƭोग सरलीकरण हेतु रणनीित Ǒदशा और माग[दश[न तय करने क े िलए ǔजàमेदार होगा।
(2) Governing Body (शासी िनकाय) Ʈारा पाǐरत आदेश एवं िलए गए िनण[य सभी सरकारȣ ǒवभाग ,
Ĥािधकार तथा एजɅसी क े िलए अंितम एवं माÛय होगा एवं ऐसे ǒवभाग, Ĥािधकार और एजɅसी िनधा[ǐरत
समय-सीमा क े अंदर अपेǔ¢त मंजूरȣ एवं अनुमित जारȣ करɅगे , बशतȶ िनवेशक /आवेदक Ʈारा Ĥचिलत
अिधिनयमɉ क े सुसंगत Ĥावधानɉ एवं राÏय/क े Ûġ सरकार क े िनयमɉ का अनुपालन Ǒकया जायेगा।
(3) इस िनयम क े Ĥभावी ǑĐयाÛवयन क े िलए Governing Body (शासी िनकाय) "High Empowered
committee" एवं "Single Window" मंजूरȣ सिमित को अपने काय[/शǒƠ Ĥदान कर या वापस ले सकती है।
(4) Governing Body (शासी िनकाय) कȧ बैठक Ʌ अपने कायɟ को पूण[ करने क े िनिमƣ आवæयकता अनुǾप
आहूत कȧ जाएगी , ǑकÛतु "High Empowered committee" एवं "Single Window" मंजूरȣ सिमित क े काय[
Ĥदश[न कȧ समी¢ा एवं जहां आवæयक हो, वहाँ आवæयक अनुशंसा Ĥदान करने हेतु हर वष[ कम से कम दो
बार िनकाय कȧ बैठक Ʌ उस जगह आहूत कȧ जाएगी जो िनकाय क े अÚय¢ Ʈारा िनधा[ǐरत कȧ जाएगी।
(5) Governing Body (शासी िनकाय) "High Empowered committee" तथा राÏय सरकार Ʈारा िनǑद[ƴ
मामलɉ पर ǒवचार कर उिचत िनण[य ले सकता है।
(6) Governing Body (शासी िनकाय) वृहत एवं अित वृहत उƭोगɉ क े िलए यथा ǒवǑहत ǒवƣीय उ×Ĥेरण
(Incentives) पैक े ज क े अनुमोदन को अनुशंिसत करेगा।
6. High Empowered committee उÍच èतरȣय सिमित
(1) इस अिधिनयम क े उƧेæय से एक उÍचशǒƠ ĤाƯ सिमित का गठन Ǒकया जाएगा।
(2) धारा 6.1 क े तहत् गǑठत उÍच शǒƠ ĤाƯ सिमित मɅ अÚय¢ एवं िनàन सूिचत सदèय हɉगे:

(क) मुÉय सिचव अÚय¢
(ख्). ǒवकास आयुƠ सदèय
(ग) Ĥधान सिचव/सिचव, उƭोग सदèय
(घ) Ĥधान सिचव/सिचव, योजना-सह-ǒवƣ ǒवभाग सदèय
(ड.) िनदेशक, उƭोग सदèय-सिचव
(3) यǑद ऐसा करना आवæयक हो तो"High Empowered committee" सàबंिधत Ĥशासी सिचव अथवा
अÛय Ǒकसी ǒवभागीय पदािधकारȣ को ǒवशेष आमंǒğत सदèय क े Ǿप मɅ आमंǒğत कर सकती है।
7. Functions of High Powered Committee (उÍच èतरȣय सिमित क े काय[):-
(1) उƭोग सरलीकरण एवं Single Window मंजूरȣ हेतु उÍच शǒƠ ĤाƯ सिमित Ʈारा एकल ǔखड़कȧ मंजूरȣ
सिमित, एजɅसी, ǔजला èतरȣय नोडल एजɅसी एवं ǔजला काय[कारणी सिमित क े कायɟ का िनयिमत Ǿप से
िनरȣ¢ण पय[वे¢ण एवं समी¢ा कȧ जाएगी।
(2) सिमित शासी िनकाय या राÏय सरकार Ʈारा सɋपे गए अÛय कायɟ को भी सàपÛन करेगी।
(3) इस अिधिनयम क े Ĥभावी ǑĐयाÛवयन क े िलए सिमित इस अिधिनयम अथवा शासी िनकाय Ʈारा Ĥदƣ
शǒƠ/कायɟ क े तहत् single window मंजूरȣ सिमित और ǔजला काय[कारणी सिमित को अपने काय[ शǒƠयाँ
Ĥदान कर या वापस ले सकती है।
(4) Single Window मंजूरȣ सिमित एवं ǔजला काय[कारणी सिमित क े काय[ Ĥदश[न कȧ समी¢ा एवं जहाँ
आवæयक हो, वहाँ आवæयक अनुशंसा Ĥदान करने हेतु कम से कम हर ितमाहȣ मɅ एक बार उÍच शǒƠ
ĤाƯ सिमित कȧ बैठक उस जगह आहूत कȧ जाएगी ǔजसे सिमित क े अÚय¢ Ʈारा िनधा[ǐरत कȧ जाएगी।
(5) Single Window मंजूरȣ सिमित क े अनुशंसा पर उÍच शǒƠ ĤाƯ सिमित बड़ȣ पǐरयोजनाओं क े िलए
ǒवƣीय Ĥो×साहन पैक े ज कȧ èवीकृित देगा। उÍच शǒƠ ĤाƯ सिमित सभी वृहत एवं अित वृहत
पǐरयोजनाओं क े िलए ǒवƣीय Ĥो×साहन पैक े ज कȧ अनुशंसा शासी िनकाय को करेगा।
(6) High Empowered committee, Single Window मंजूरȣ सिमित क े CEO Ʈारा िनǑद[ƴ मामलɉ पर ǒवचार
कर उिचत िनण[य ले सकती है।
(7) यǑद आवæयक हो तो Ǒकसी भी मुƧा /मामला/Ĥèताव को अपनी अनुशंसाओं एवं सुझावɉ क े साथ
सिमित शासी िनकाय को िनǑद[ƴ/संसूिचत करेगी।
(8) सिमित, राÏय मɅ िनवेश और अÛय संबंिधत गितǒविधयɉ क े संवƨ[न क े िलए ǔजàमेदार होगी।
(9) High Empowered committee संबंिधत ǒवभाग को ǒविभÛन Ĥचिलत अिधिनयमɉ क े तहत दȣ जाने वाली
हर सेवा क े िलए समय-सीमा कȧ अनुशंसा करेगी।

(10) High Empowered committee संबंिधत ǒवभाग क े िलए लागू ǒविभÛन Ĥचिलत अिधिनयमɉ क े तहत
èव-Ĥमाणन, डȣàड मंजूरȣ, िनरȣ¢णɉ एवं तीसरे प¢ Ʈारा िनरȣ¢णɉ क े युǒƠकरण कȧ अनुशंसा करेगी।
8. Single Window Clearance Committee (एकल ǔखड़कȧ मंजूरȣ सिमित)
(1) इस अिधिनयम क े उƧेæयɉ क े िलए एकल ǔखड़कȧ मंजूरȣ सिमित का गठन Ǒकया जाएगा।
(2) धारा 8.1 क े तहत् गǑठत एकल ǔखड़कȧ मंजूरȣ सिमित मɅ मुÉय काय[कारȣ पदािधकारȣ (CEO) एवं िनàन
सूिचत सदèय हɉगे:-

वन, पया[वरण एवं जलवायु पǐरवत[न सदèय
(छ) Ĥधान सिचव/सिचव,
उजा[ सदèय
(ज) Ĥधान सिचव/सिचव,
जल संसाधन सदèय
(झ) Ĥधान सिचव/सिचव,
खनन एवं भूत×व सदèय
(ञ) अÚय¢
झारखÖड राÏय Ĥदूषण िनयंğण पष[ɮ सदèय
(ट) िनदेशक, उƭोग सदèय, संयोजक
(3) Ĥधान सिचव, उƭोग ǒवभाग, Single Window मंजूरȣ सिमित क े अÚय¢ हɉगे। आवæयकतानुसार Single
Window मंजूरȣ सिमित Ǒकसी ǒवभागीय सिचव अथवा अÛय Ǒकसी ǒवभागीय पदािधकारȣ को ǒवशेष
आमंǒğत सदèय क े ǽप मɅ आमंǒğत कर सकती है।
9. Functions of Single Window Clearance Committee (एकल ǔखड़कȧ मंजूरȣ सिमित) क े काय[ः-
राÏय सरकार समĒ िनयंğण एवं पय[वे¢णाधीन रहते हुए
(1) Single Window मंजूरȣ सिमित, उƭम èथापना तथा उƭम संचालन कȧ शुǽआत जैसा Ǒक राÏय सरकार
Ʈारा अिधसूिचत है, क े िलए मंजूǐरयɉ (को Ĥदान करने) कȧ शǒƠ का Ĥयोग करेगी।

(2) Urban Local bodies तथा Panchayati Raj Institutions सǑहत अÛय वैधािनक िनकायɉ मɅ िन Ǒहत शǒƠयɉ
को छोड़कर राÏय सरकार उिचत अिधसूचना क े माÚयम से यǑद ऐसा आवæयक हो तो, ǑकÛहȣं अÛय शǒƠयɉ
को इसको (सिमित को) हèतांतǐरत कर सकती है।
(3) SWCC Ʈारा शǒƠयɉ का हèतांतरण मंजूǐरयɉ एवं èवीकृितयɉ कȧ अवèथा तक Ǒकया जा सकता है।
तदोपरांत सभी मंजूǐरयɉ एवं èवीकृितयाँ संबंिधत उिचत Ĥािधकार Ʈारा जारȣ Ǒकए जायɅगे।
(4) MSME पǐरयोजनाओं हेतु ǒवƣीय Ĥो×साहन (Incentives) का अनुमोदन सिमित Ʈारा Ǒकया जाएगा तथा
MSME क े अितǐरƠ पǐरयोजनाओं क े िलए अनुमोदन हेतु सिमित, उÍच शǒƠ ĤाƯ सिमित को अनु शंसा
भेजेगी।
10. Officers/Employees of the Agency (एजɅसी क े पदािधकारȣ/कम[चारȣ):-
(1) ǒविभÛन ǒवभागɉ क े पदािधकाǐरयɉ को संबंिधत Ĥशासी ǒवभाग/संगठन Ʈारा ĤितिनयुǒƠ क े
आधार पर एजɅसी मɅ िनयुƠ Ǒकया जाएगा, इनमɅ शािमल हɇ:-
(क) झारखÖड राÏय Ĥ दूषण िनयंğण पष[द का एक पदािधकारȣ , जो मुÉय अिभयंता क े पद से नीचे का
ना हो।
(ख) नगर ǒवकास एवं आवास ǒवभाग का एक पदािधकारȣ , जो मुÉय नगर Üलानर क े पद से नीचे का
ना हो।
(ग) Įम ǒवभाग का एक पदािधकारȣ, जो संयुƠ ĮमायुƠ क े पद से नीचे का ना हो।
(घ) वाǔणÏय-कर ǒवभाग का एक पदािधकारȣ, जो संयुƠ वाǔणÏयकर आयुƠ क े पद से नीचे का ना हो।
(ड.) वन, पया[वरण एवं जलवायु पǐरवत[न ǒवभाग का एक पदािधकारȣ, जो मुÉय वन संर¢क क े पद से नीचे
का ना हो।
(च) झारखÖड ǒबजली ǒवतरण िनगम िलिमटेड का एक पदािधकारȣ , जो मुÉय अिभयंता क े पद से नीचे का
ना हो।
(छ) राजèव, िनबंधन एवं भूिम सुधार ǒवभाग का एक पदािधकारȣ जो , िनदेशक, भूिम अज[न क े पद से नीचे
का ना हो।
(ज) खनन् ǒवभाग का एक पदािधकारȣ, जो अपर िनदेशक, खनन् क े पद से नीचे का ना हो।
(2) यǑद ǒवभाग/संगठन उप-धारा-1 मɅ वǔण[त Įेणी/पद क े पदािधकारȣ देने मɅ असमथ[ हो तो, ĤितिनयुƠ
पदािधकारȣ, एजɅसी मɅ अपनी ĤितिनयुǒƠ तक , उप-धारा-1 मɅ वǔण[त पद क े पदािधकारȣ क े समान माने
जायɅगे, परÛतु इससे वे Ǒकसी अितǐरƠ ǒवƣीय लाभ क े अिधकारȣ नहȣं हɉगे।
(3) सभी िनयामक ǒवभाग , जो अनुमोदन/मंजूरȣ Ĥदान करते हɇ , उƭम èथापना और उƭम संचालन शुǽ
करने क े िलए सारȣ नई पǐरयोजनाओं को समय-सीमा क े अंदर èवीकृित Ĥदान करने क े िलए JIIDCO मɅ
ĤितिनयुƠ अपने वरȣय पदािधकारȣ को अिधसूचना Ʈारा सशƠ करɅगे। ऐसी अिधसूचना जारȣ होने तक
ĤितिनयुƠ पदािध कारȣ समय -सीमा क े भीतर ऐसी मंजूǐरयɉ क े आवेदनɉ क े िनèतारण क े िलए
ǔजàमेदार हɉगे।

(4) SWCC का मुÉय काय[कारȣ अिधकारȣ एजɅसी मɅ ĤितिनयुƠ पदािधकारȣ क े ऊपर पय[वे¢ण एवं िनयंğण
कȧ शǒƠ का Ĥयोग करेगा , परÛतु धारा-1 मɅ वǔण[त पदािधकारȣ ǔजनकȧ सेवाएँ ĤितिनयुǒƠ क े आधार पर
एजɅसी मɅ पदèथापन कȧ गई अपने मूल ǒवभाग /संगठन मɅ अपने संवग[ क े संबƨ िनयम और ǒविनयम
Ʈारा शािसत हɉगे।
(5) एजɅसी, अनुबÛध या आउटसोिसɍग क े माÚयम से इस अिधिनयम क े तहत् उƣरदािय×व िनव[हन हेतु अÛय
किम[यɉ कȧ आवæयकता को पूरȣ करेगी।
11. मुÉय काय[कारȣ अिधकारȣ (CEO) क े काय[:-
(1) CEO उƭोग ǒवभाग क े Ĥधान सिचव/सिचव क े Ĥभार मɅ भी हɉगे।
(2) CEO समय-समय पर राÏय मɅ लगाए जाने वाली औƭोिगक एवं अÛय पǐरयोजनाओं क े संबंध मɅ Ǒकसी
उƭमी से ĤाƯ Ĥèतावɉ कȧ परȣ¢ा उन पर ǒवचार एवं उन पर कार[वाई करɅगे।
(3) Governing Body (शासी िनकाय) "High Empowered Committee" एवं समय-समय पर राÏय सरकार Ʈारा
अिधसूचना Ʈारा Ǒदये गए शǒƠयɉ/कायɟ का Ĥयोग CEO Ʈारा Ǒकया जाएगा।
(4) CEO राÏय मɅ िनवेश अÛय संबंिधत गित ǒविधयɉ को Ĥो×साहन देने क े िलए सभी Ĥयासɉ का
समÛवय करेगा।
(5) CEO सभी दèतावेजɉ , अनुमोदनɉ एवं SWCC Ʈारा जारȣ िनदेशɉ या अनुदानɉ क े आवंटन पर हèता¢र
करने क े िलए स¢म अिधकारȣ (Ĥािधकार) होगा।
(6) CEO Ǒकसी मामला/मुƧा/Ĥèताव को अपनी अनुशं साओं एवं सुझावɉ , यǑद वह आवæयक समझɅ को ,
"High Empowered Committee" को िनǑद[ƴ करेगा।
(7) CEO ǒविभÛन पǐरयोजनाओं मɅ SWCC Ʈारा Ǒदये गए अनुमोदन कȧ समी¢ा एवं अनुĮवण करेगा।
(8) CEO, Governing Body (शासी िनकाय) एवं "High Empowered Committee" (उÍच शǒƠ ĤाƯ सिमित)
क े िलए मािसक, ितमाहȣ एवं अध[वाǒष[क Ĥगित ǐरपोट[ बनाने एवं Ĥèतुित क े िलए ǔजàमेदार होगा।
(9) CEO िनवेश Ĥèतावɉ को धरातल पर लागू करने क े िलए एवं अनुमोदन/मंजूरȣ देने क े िलए JIIDCO मɅ
ĤितिनयुƠ ǒवभागɉ क े ǒविभÛन अिधकाǐरयɉ क े माÚयम से सभी ǒवभागɉ से समÛवय करेगा।
(10) CEO िनवेश Ĥèतावɉ को धरातल पर लागू करने क े िलए एवं अनुमोदन/मंजूरȣ Ĥदान करने क े िलए
सभी ǒवभाग/Ĥािधकार/काया[लय ǔजÛहɉने अपने पदािधकाǐरयɉ को JIIDCO मɅ ĤितिनयुƠ नहȣं Ǒकया से
समÛवय करेगा।
(11) CEO राÏय मɅ उƭोग लगाने हेतु उƭािमयɉ को सभी तरह क े आवæयक सहायता Ĥदान करेगा।
(12) CEO, JIIDCO Ʈारा अनुरǔ¢त एवं संचािलत, Single Window मंजूरȣ क े वेब-पोट[ल क े कायɟ कȧ अनुĮवण,
समी¢ा एवं मूãयांकन करेगा।

12. ǔजला काय[कारणी सिमित (Distric Empowered Committee)
(1) राÏय सरकार अिधसूचना Ʈारा ǔजला èतर पर एक सिमित का गठन कर सकता है जो ’’ǔजला
काय[काǐरणी सिमित (DEC)’’ कहȣ जाएगी।
2) धारा 12.1 क े तहत गǑठत ǔजला काय[काǐरणी सिमित मɅ अÚय¢ एवं िनàनसूिचत सदèय होगɅ-

13. ǔजला काय[काǐरणी सिमित क े काय[ (Functions of District Executive Committee)
(1) इस अिधिनयम क े Ĥभावी ǑĐयाÛवयन हेतु, ǔजला काय[काǐरणी सिमित िनयिमत Ǿप से ǔजला èतरȣय
नोडल एजɅसी क े काम-काज का अनुĮवण, पय[वे¢ण एवं समी¢ा करेगा।
(2) धारा-7 क े तहत यह सिमित "High Empowered Committee" (उÍच शǒƠ ĤाƯ सिमित) Ʈारा सौपे गये
अÛय कायɟ का सàपादन करेगी।
(3) इस अिधिनयम क े Ĥभावी ǑĐयाÛवयन क े िलए सिमित इस अिधिनयम अथवा उÍच शǒƠ ĤाƯ सिमित
Ʈारा Ĥदत शǒƠ/कायɟ क े तहत ǔजला èतरȣय नोडल एजɅसी को काय[/शǒƠयाँ Ĥदान कर या वापस ले
सकती है।
(4) अपने (ǔजला काय[कारणी सिमित क े) कायɟ (काय[ Ĥदश[न) कȧ समी¢ा एवं जहाँ आवæयक हो , वहाँ
आवæयक अनुशंसा Ĥदान करने हेतु कम -से-कम महȣने मɅ एक बार ǔजला काय[कारणी सिमित कȧ बैठक
उस जगह आहूत कȧ जाएगी ǔजसे सिमित क े अÚय¢ Ʈारा िनधा[ǐरत कȧ जाएगी।
(5) ǔजला काय[कारणी सिमित, ǔजला èतरȣय नोडल एजेÛसी Ʈारा िनǑद[ƴ मामलɉ पर ǒवचार कर उिचत
िनण[य ले सकती है।

(6) यǑद ऐसा आवæयक हो तो Ǒकसी भी मामला /मुƧा/Ĥèताव को अपनी अनुशंसाओं एवं सुझावɉ क े साथ,
सिमित, उƭोग ǒवभाग को भेजेगी।
(7). ǔजला काय[कारणी सिमित का ए क सदèय åयǒƠगत Ǿप से इसकȧ बैठक मɅ Ǒहèसा लेगा और यǑद
वह बैठक मɅ उपǔèथत होने मɅ असमथ[ है तो वे एक वरȣय अिधकारȣ को बैठक मɅ उिचत िनण[य लेने हेतु
िलǔखत Ĥािधकार पğ देकर ĤितिनयुƠ करेगा।
(8) सिमित ǔजला मɅ उƭोगɉ क े Ĥो×साहन एवं अÛय गितǒविधयɉ क े िलए ǔजàमेदार होगी।
(9) ǔजला काय[काǐरणी सिमित , Ĥगित ǐरपोट[ बनाने एवं उसे ǔजला योजना सिमित को सɋपने क े िलए
ǔजàमेदार होगी।
14. ǔजला èतरȣय नोडल एजɅसी (District Level Nodal Agency)
ǔजला उƭोग क े Ûġ एजɅसी एवं ǔजला काय[कारणी सिमित का ǔजला èतरȣय नोडल एजɅसी होगा।
15.ǔजला èतरȣय नोडल एजɅसी क े काय[(Functions of District Level Nodal Agency)
(1) यह ǔजले मɅ िनवेश Ĥो×साहन गितǒविधयɉ मɅ सहायता Ĥदान करेगी।
(2) यह ǔजले मɅ उƭिमयɉ को िनवेश एवं उनकȧ पǐरयोजनाओं या औƭोिगक इकाईयɉ कȧ èथा पना मɅ
सहायता एवं माग[दश[न Ĥदान करेगा।
(3) यह उƭिमयɉ को आवेदन Ĥपğ उपलÞध कराने एवं उƭिमयɉ से भरा हुआ Ĥपğ ĤाƯ करने जहाँ कहȣं भी
अिधकृत हो सǑहत ǒवǒवध मंजूǐरयɉ क े िलए माग[दश[न Ĥदान करेगा और ǒवभागɉ एवं Ĥािधकारɉ से
आवæयक मंजूरȣ को िनयत समय मɅ उƭिमयɉ क े िलए सुगम करेगा।
(4) यह काय[कारणी सिमित एवम् ǔजला काय[कारणी सिमित Ʈारा सɋपी गयी और राÏय सरकार Ʈारा समय-
समय पर अिधसूचना क े माÚयम से Ĥ×यायोǔजत शǒƠ/कायɟ का Ĥयोग करेगा।
16. अनुमाÛय मंजूǐरयाँ (Eligible Clearances)
(1) सभी Ĥèताǒवत या मौजुद िनवेश , ǔजसमɅ एक या अिधक Ĥचिलत /लागू अिधिनयमɉ क े अंतग[त मंजूरȣ
कȧ आवæयकता हो, एकल ǔखड़कȧ मंजूरȣ वेब-पोट[ल क े माÚयम से सुǒवधा ĤािƯ क े पाğ हɉगे जब कभी वेब-
पोट[ल पर संबंिधत Ĥचिलत अिधिनयम क े तहत मंजूरȣ कȧ सुǒवधा होगी।
(2) उप-धारा-1 मɅ सुगिमत मंजूǐरयɉ क े अितǐरƠ सभी मंजूǐरयɉ क े मामलɉ मɅ संबंध मɅ एजɅसी मे िनयुƠ
अिधकारȣ स¢म पदािधकारȣ Ʈारा िनयम समय-सीमा क े भीतर मंजूरȣ Ĥदान करने कȧ कार[वाई करेगा।
17. समझौता £ापन (Memorandum of Understanding)
(1) SWCC क े CEO औƭोिगक नीित क े तहत वृहत उƭोगɉ क े िलए एवं वैसे मामले ǔजनमɅ सरकार क े Ʈारा
ǒवशेष िनदȶश ĤाƯ हुआ हो, क े समझौता £ापन (MOU) पर हèता¢र करɅगे।

(2) वृहत उƭोग क े िनिमत समझौता £ापन पर SWCC क े CEO उÍच शǒƠ ĤाƯ सिमित क े पूवा[नुमित क े
पƱात् हèता¢र करɅगे।
18. वेब-पोट[ल (Web Portal)
ǒविभÛन Ĥचिलत /लागू अिधिनयमɉ एवं समय -समय पर अिधसूिचत औƭोिगक नीित क े तहत् सभी
मंजूǐरयɉ क े Single Window मंजूरȣ हेतु वेब-पोट[ल का अनुर¢ण एवं संचालन करेगी।
19. एकȧकृत आवेदन Ĥपğ (CAF)
(1) Ĥचिलत अिधिनयमɉ एवं समय -समय पर अिधसूिचत औƭोिगक नीित क े तहत् िनधा[ǐरत वत[मान
आवेदन Ĥपğ कȧ जगह एक एकȧकृत आवेदन Ĥपğ सशुãक जारȣ Ǒकया जायेगा। सभी स¢म Ĥािधकार ऐसे
Ĥपğ (Combined Application Form) को कार[वाई हेतु èवीकार करक े आवæयक मंजूरȣ Ĥदान करɅगे।
(2) बशतȶ Ǒक जहाँ कोई आवेदन Ĥपğ एवं शुãक ऐसी मंजूǐरयɉ क े िलए क े Ûġȣय अिधिनयमɉ मɅ Ĥावधािनत
हो, आवेदन उसी Ĥपğ मɅ एवं उसी शुãक क े साथ जमा Ǒकया जाएगा ǔजस शुãक क े साथ जमा Ǒकया
जाना है।
20. èव-Ĥमाणन (Self-Certification)
(1) Ĥ×येक उƭमी को पूरȣ तरह से तैयार CAF को जमा करने क े समय ǒवǑहत Ĥपğ मɅ èवĤमाणन
Ĥèतुत करना होगा और उसक े बाद स¢म Ĥािधकार क े सम¢ ǒवǑहत समय-सीमा क े भीतर èवĤमाǔणत
करना होगा Ǒक वह Ĥचिलत अिधिनयमɉ क े लागू Ĥावधानɉ एवं उसक े तहत् बने िनयमɉ का अनुपालन
करेगा।
(2) उƭमी Ʈारा उप-धारा-1 क े तहत Ĥèतुत èव-Ĥमाणन को स¢म Ĥािधकार Ʈारा उƭिमयɉ को अनुदान एवं
मंजूरȣ Ĥदान करने एवं अÛय लाभ देने क े उƧेæय से èवीकार Ǒकया जायेगा।
21. िनरȣ¢णɉ कȧ युǒƠयुƠता (Rationalisation of Inspections)
(1) Ĥचिलत अिधिनयमɉ एवं ǒवǒवध èतर क े Ĥािधकारɉ क े िनयमɉ क े Ĥावधानɉ क े तहत् िनरȣ¢ण ĮमायुƠ
काया[लय एवं झारखÖड राÏय Ĥदूषण िनयंğण पष[द और अÛय Ʈारा वष[ मɅ एक बार Ǒकया जायेगा।
(2) ǒवभाग जोǔखम आधाǐरत मूãयांकन , जैसा Ǒक अपने-अपने िनयमɉ/उप िनयमɉ मɅ ǒवǑहत है क े आधार
पर िनरȣ¢ण करेगा , परÛतु ǒवशेष िशकायत क े ǒवǽƨ िनरȣ¢ण ǒवभागीय Ĥमुख कȧ िलǔखत अनुमित क े
पƱात् Ǒकया जा सकता है।
22. तृतीय प¢ का िनरȣ¢ण (Third Party Inspections)
Ĥचिलत अिधिनयमɉ या ǒविभÛन राÏय Ĥािधकारɉ क े िनयमɉ क े Ĥावधानɉ क े तहत् िनरȣ¢ण जहाँ
लागू होता हो , स¢म Ĥािधकारो क े Empanelment तृतीय प¢ िनरȣ¢ण एजɅिसयɉ Ʈारा ǒवǑहत Ǒकया जा
सकता है। तृतीय प¢ िनरȣ¢ण ǐरपोट[ को ऐसे Ĥपğ मɅ जैसा Ǒक ǒवǑहत Ǒकया जा सकता है , मɅ Ĥèतुत
Ǒकया जायेगा।
23. िनèतारण कȧ ĤǑĐया (Procedure of Disposal)
(1) मंजूǐरयɉ क े िलए आवेदनɉ का िनèतारण उस ĤǑĐया का पालन करते हुए Ǒकया जाएगा जैसा Ǒक
ǒवǑहत Ǒकया जा सकता है।

(2) उप-धारा-1 मɅ िनǑद[ƴ आवेदनɉ का िनèतारण िनधा[ǐरत/ǒवǑहत समय अविध क े अÛदर Ǒकया जायेगा।
(3) मंजूǐरयाँ Ĥदान करते समय उपयुƠ Ĥािधकार आवेदक से अितǐरƠ सूचनाओं कȧ मांग कर
सकता है।
(4) बशतȶ Ǒक अितǐरƠ सूचना स¢म Ĥािधकार Ʈारा ऐसी मंजूǐरयɉ क े िलए िनधा[ǐरत समयाविध क े
अंदर मांगा जाएगा।
(5) पुनः बशतȶ Ǒक अितǐरƠ सूचनाएँ क े वल एक बार मांगी जाएगी।
(6) यǑद उपयुƠ Ĥािधकार Ʈारा आवेदक से कोई अितǐरƠ सूचना नहȣं मांगी जाती है तो वह
(Ĥािधकार) िनधा[ǐरत समय-सीमा क े समािƯ क े पहले मंजूǐरयɉ क े संद[भ मɅ आवेदन पर आदेशɉ को
िनग[त करेगा।
(7) मंजूǐरयɉ क े िलए अितǐरƠ सूचना मांगे जाने क े मामले मɅ आवेदन को िनधा[ǐरत समयाविध जो
अितǐरƠ सूचना ĤािƯ ितिथ से िगनी जाएगी क े भीतर िनèतारण Ǒकया जायेगा।
24. डȣàड èवीकृित (Deemed Approval)
स¢म Ĥािधकार Ʈारा िनधा[ǐरत अविध क े भीतर मंजूरȣ नहȣं Ǒदये जाने या अǔÛतम आदेश जारȣ नहȣं Ǒकये
जाने कȧ ǔèथित मɅ राÏय सरकार Ʈारा , अिधसूचना क े माÚयम से अिधसूिचत मंजूǐरयɉ को डȣàड èवीकृित
माना जाएगा।
25. अपील(Appeals)
(1) ǔजला काय[कारणी सिमित , ǔजला èतरȣय नोडल एजɅसी और एजɅसी Ʈारा पǐरयोजना को रƧ Ǒकये
जाने क े िनण[य या कोई अÛय िशकायत से पीǔ़डत उƭमी सिमित क े िनण[य कȧ सूचना ĤािƯ ितिथ
क े 30 Ǒदन क े अÛदर Single Window मंजूरȣ सिमित से जैसा Ǒक ǒवǑहत हो सकता है (Ĥथम
अपील कर सकता है)। Single Window मंजूरȣ सिमित क े आदेश क े ǒवǽƨ अपील उÍच शǒƠ ĤाƯ
सिमित क े पास हɉगे।
(2) High Powered Committee क े आदेश क े ǒवǾƨ Ĥधान सिचव/सिचव, उƭोग क े माÚयम से ǑƮतीय
अपील शासी िनकाय क े सम¢ Ǒकया जाएगा और इस अिधिनयम क े तहत् शासी िनकाय का
िनण[य अंितम और सभी क े िलए बाÚय होगा।
(3) ǒवǑहत ĤǑĐया का पालन करते हुए, अपीलीय Ĥािधकार अपील ĤािƯ क े एक माह क े अÛदर या
सिमित क े आगामी बैठक जो बाद मɅ हो अपील का िनçपादन करेगा।
26. शुãक (Fee)
आवेदकɉ Ʈारा एकȧकृत आवेदन Ĥपğ (CAF) या अÛय Ĥपğ मɅ जो लागू अिधिनयम या िनयमɉ क े तहत्
शुãक जो ǒवǑहत हो क े साथ हो, ऐसे मंजूǐरयɉ क े आवेदन जमा Ǒकए जायɅगे।
27. िनयम बनाने कȧ शǒƠ (Power to make rules)
(1) इस अिधिनयम क े उƧेæयɉ को पूरा करने क े िलए राÏय सरकार क े पास िनयम बनाने कȧ
शǒƠ होगी।

(2) राÏय सरकार अिधसूचना Ʈारा मंजूǐरयɉ से संबंिधत इस अिधिनयम क े Ǒकसी भी Ĥावधान क े
काया[Ûवयन को यǑद यह इसे लोकǑहत मɅ आवæयक समझती हो तो िशिथल कर सकती है।
(3) इस अिधिनयम क े तहत बनाए गए Ĥ×येक िनयम को सğाधीन झारखÖड ǒवधान सभा क े सम¢
तुरंत रखा जाएगा, और यǑद ǒवधान सभा सğाधीन न हो तो िनयम को अिधसूिचत होने कȧ ितिथ
क े तुरंत बाद वाले सğ मɅ रखा जाएगा।
28. अिभभावी Ĥभाव (Overriding Effect)
इस अिधिनयम मɅ अÛयथा Ĥाव धािनत को छोड़कर इस अिधिनयम क े Ĥावधान, राÏय क े कोई अÛय उस
समय लागू कानून (िनयम) मɅ िनǑहत Ǒकसी असंगित क े बावजूद भी Ĥभावी हɉगे।
बशतȶ Ǒक जुमा[ना, दÖड, शु×क और अÛय समान Ĥावधान यǑद Ĥचिलत अिधिनयम क े तहत् कोई हो
तो, लागू अिधिनयम क े Ĥावधानɉ क े अनुसार लगाए जायɅगे और ǒवǑहत तरȣक े से जमा Ǒकए जायɅगे।
29. ग×यारोध क े िनराकरण कȧ शǒƠ (Power to remove difficulties)
(1) इस अिधिनयम क े Ĥावधानɉ को Ĥभावी बनाने क े Đम मɅ Ǒकसी Ĥकार क े ग×यारोध उ×पÛन होते हɇ
तो राÏय सरकार, राजपğ मɅ Ĥकािशत आदेश Ʈारा ऐसे Ĥावधान, जो इस अिधिनयम क े Ĥावधानɉ से
ǒवसंगत न हो, व जो ग×यारोध को दूर करने क े िलए आवæयक Ĥतीत हो, कर सक ेगी।
30. अथ[दÖड (Penalty)
(1) Ǒकसी एजेÛसी या ǒवभाग या उपयुƠ Ĥािधकार Ʈारा Ǒदये गए èव -Ĥमाणन कȧ शतɏ या
ǔजàमेदाǐरयɉ का पालन करने मɅ असफल रहने कȧ ǔèथित मɅ उƭमी को Ĥथम दोष पर पÛġह
हजार Ǿपये तक और दूसरे दोष या उसक े बाद क े Ĥ×येक दोषɉ पर पÍचीस हजार Ǿपये तक क े
दÖड का सामना करना होगा।
(2) उपयुƠ Ĥािधकार, लागू अिधिनयम क े तहत ǒवǑहत िनयम क े अनुसार कानून क े तहत् उपयु[Ơ उप-
धारा (1) को Ĥभावी बनाने क े िलए स¢म होगा।
(3) अथ[दÖड अिधरोǒपत करनेवाला स¢म Ĥािधकार एजɅसी को संसूिचत करने क े साथ संबंिधत उƭमी
को अथ[दÖड क े संबंध मɅ संसूिचत करेगा। संसूचन जारȣ होने कȧ ितिथ से तीस Ǒदन क े अÛदर,
उƭमी को ऐसे अिधरोǒपत रािश को एजɅसी क े पास जमा करना होगा।
(4) राÏय सरकार समय -समय पर अिधसूचना क े माÚयम से अथ[दÖड कȧ रािश को पǐरवित[त कर
सकती है।
31. सƫाव कृत कार[वाई से अिभर¢ण (Protection of action taken in good faith)
Governing Body (शासी िनकाय) एवं "High Empowered Committee" (उÍच शǒƠ ĤाƯ सिमित ) अथवा
Single Window मंजूरȣ सिमित या ǔजला काय[कारणी सिमित या एजɅसी या ǔजला èतरȣय नोडल एजɅसी से
अÚय¢ या अÛय सदèय या ऐसे सिमित क े कोर कमȸ क े Ʈारा इस अिधिनयम या उसक े तहत् बने Ǒकसी
िनयम क े अÛतग[त सदभाव कृत कार[वाई क े ǒविशƴ को यािचका या ǒविधक काय[वाहȣ नहȣं लायी जा
सक े गी।

JHARKHAND SINGLE WINDOW CLEARANCE ACT, 2015
(Jharkhand Act-10,2016)
An Act to provide for accelerated and time bound grant for various licences, permissions and
approvals to promote of industrial development; to facilitate new investments; to simplify the
regulatory framework by reducing procedural requirements an d rationalisingdocuments, to
improve ease of doing business, and to provide for an investor friendly environment in the State
of Jharkhand; and
Be it enacted by the Jharkhand Legislative Assembly in the 66 thyear of the Republic of India as
follows:
1. Short title, extent and commencement
(1) This Act may be called the “Jharkhand Single Window Clearance Act, 2015”.
(2) It shall extend to whole of the State of Jharkhand.
(3) It shall come into force on such date as the Government of Jharkhand
may, by notification in the official Gazette.

2. In this act, unless the context otherwise requires:
a) “Agency” means the Jharkhand Industrial Infrastructure Development
Corporation (JIIDCO);
b) “Governing Body” means the body constituted under Section 4;
c) “Appellate Authority” means the committee as empowered under section
25;
d) “Applicable Acts” means
a. The Bihar Shops and Commercial Establishment Act, 1953
b. The Central Sales Taxes Act, 1956
c. The Maternity Benefit Act, 1961
d. The Payment of Bonus Act, 1965
e. The Contract Labour (Regulation and Abolition) Act, 1970

Or successor/amended Act or any other relevant Act notified by the
State Government;
e) “Appropriate Authority” m eans any department or agency of the
Government, Local Authority, Statutory Body, State Owned
Corporation,Panchayat Raj Institutions, Urban Local Bodies or any other
authority or Agency constituted or established under any Act or under
administrative control of the Government, which is entrusted with the powers
and responsibilities to grant or issue permissions for setting up or
commencement of operations of an enterprise in the State;
f) “Clearance” means grant or issue of no -objection certificate, allotment,
consents, approvals, permissions, registrations, enrolments, licences and
the like, by any Appropriate Authority in connection with the setting up of an
enterprise in the State of Jharkhand and shall include all such permissions
as are required underany applicable acts;
g) “Department” means a department of the State Government of Jharkhand;
h) “District Executive Committee” means the committee constituted under
Section 12;
i) “District Level Nodal Agency” means the agency specified under Section
14;
j) “Entrepreneur” means a person or body of persons or a company, having or
proposing to have majority investment or controlling interest in an enterprise
and who brings forth a proposal for investment;
k) “Government” means the State Government of Jharkhand;
l) “High Powered Committee” means the committee constituted under Section
6;
m) “Industrial Policy” means Jharkhand industrial policy or other sector specific
policies or schemes of Central or Government of Jharkhand as notified from
time to time for industrial promotion.
n) “Notification” means a notification published in the Jharkhand Gazette and
the word ‘notified’ shall be construed accordingly;
o) “Prescribed” means prescribed by rules made under this Act and rules
made under applicable Acts to implement this Act.
p) “Web Portal” means web portal maintained by the Agency.
3. Notification of Agency
The Government of Jharkhand shall notify the “Jharkhand Industrial
Infrastructure Development Corporation (JIIDCO) to provide secretariat support
to single window clearance a nd industrial facilitation for the new investments in

the State.
4. Governing Body
(1) There shall be constituted a ‘Governing Body’ for the purposes of this Act.
(2)The Governing Body constituted under section 4.1 shall consist of the
Chairman and the following members:

(3) The

5. Fun
ctions of Governing Body
Subject to the overall control and superintendence of the State Government , the
Governing Body shall provide overall policy guidance and direction under this Act.
(1)The Governing Body shall be responsible for setting the strategic
directionsandguidance for the Single Window Clearance and industries
facilitation required for its effective functioning.
(2)The orders passed and decisions taken by the Governing Body shall be final
and binding on all Government Departments, Authorities and Agency and
such Departments, Authorities and Agency shall issue requisite clearance

and permissions within the stipulated time limit, provided that the relevant
provisions of the applicable Acts and Rules of the State Government or
Central Government are complied by the investor/ applicant.
(3)The Governing Body may assign or revoke its functions / powers t o High
Powered Committee and Single Window Clearance Committee for effective
implementation of this Act.
(4)The Governing Body shall meet as often as required to carry out its functions
but it shall meet at least twice in every year at such place, as the Chai rman
of the Governing Body may decide, for performance review of the High
Powered Committee and the Single Window Clearance Committee; and for
providing necessary recommendations where required.
(5)The Governing Body may also consider matters referred by the High
Powered Committee and the State Government, and take appropriate
decisions.
(6)The Governing Body shall grant approval of financial incentive packages for
Mega and Ultra -mega projects on the recommendation of the High -
Powered Committee.
6. High Powered Committee
(1) There shall be constituted a High Powered Committee for the purpose of
this Act.
(2) The High Powered Committee constituted under section 6.1 shall consist of
the Chairman and the following members:

7. Functions of High Powered Committee
(1)The High Powered Committee shall regularl y monitor, supervise and review
the functioning of the Single Window Clearance Committee, Agency, District
Level Nodal Agency and District Executive Committee for industries
facilitation and single window clearance.
(2)It shall carry out such other functions as may be assigned to it by the

Governing Body or the State Government.
(3)The Committee may assign or revoke the functions / powers to the Single
Window Clearance Committeeand District Executive Committee within the
powers / functions assigned under this Act or by the Governing Body for
effective implementation of this Act.
(4)The High Powered Committee shall meet at least once in every quarter at
such place, as the Chairman of the Committee may decide, for performance
review of the Single Window Clearance Commi tteeand District Executive
Committee; and for providing necessary recommendations where required.
(5)The High Powered committee shall grant approval of financial incentive
packages for large projects on the recommendationof Single Window
Clearance Committee. The High Powered Committee shall recommend
financial incentive packages for all Mega and Ultra -mega projects to
governing body.
(6)The High Powered Committee may also consider matters referred to it by the
CEO of Single Window Clearance Committee and take app ropriate
decisions.
(7)It shall further refer any case / issue / proposal to the Governing Body with its
recommendations and suggestions, if considered necessary.
(8)The Committee shall be responsible for promoting investments in the state
and other related activities.
(9)The High Powered Committee shall recommend the time -line for each
service provided under various applicable Acts to the concerned
department.
(10) The High Powered Committee shall recommend self -certification, deemed
clearances, rationalisation of inspe ctions and third party inspections under
various applicable acts wherever applicable to the concerned department.
8. Single Window Clearance Committee
(1) There shall be constituted a Single Window Clearance Committee
(SWCC) for the purpose of this act.
(2) The Sin gle Window Clearance Committee shall consist of the following
composition:

(3) The Principal Secretary, Department of Industries shall be Chairman of this
Single Window Clearance Committee. The Single Window Clearance
Committee may invite the other departmental Secretaries or any other officer of
any department as a special invitee as required.
9. Functions of Single Window Clearance Committee
Subject to overall control and superintendence of the State Government,
(1) The Single Window Clearance Committee shall exercise powers of
clearances for setting up of business and starting of business operations as
notified by State Government.
(2) The State Government may devolve upon it any other powers, if so
required, through appropriate notification except the powers vested with the
statutory bodies includi ng ULBs and PRIs. The SWCC shall pursue the
proposals with regards to ULBs and PRIs directly with them or through the
Deputy Commissioner of the district concerned to facilitate their early
clearance.
(3) The delegations of powers shall be exercised by the S WCC up to the
stage of clearances and approvals. All clearances and approvals,
thereafter, shall be issued by the Appropriate Authority concerned.
(4) Financial incentives for MSME projects shall be approved by this
Committee and other than MSME projects, this committee shall recommend
to the High Powered Committee for approval.
10. Officers/Employees of the Agency
(1) The Officers of various departments shall be placed in the Agency on
deputation/ secondment by concerned administrative department
/organizations, include
a. An Officer not below the rank of a Chief Engineer in the
Jharkhand State Pollution Control Board.
b. An Officer not below the rank of the Chief Town Planner in the
Department of Urban Development and Housing.
c. An Officer not below the rank of JointLabour Commissioner in the
Department of Labour

d. An Officer not below the rank of the Joint Commissioner
Commercial Tax in the Department of Commercial Tax
e. An Officer not below the rank of Chief Conservator of forests in
the Department of Forest, Environment and Climate Change.
f. An Officer not below the rank of Chief Engineer in Jharkhand
BijliVitran Nigam Ltd
g. An Officer not below the rank of Director of Land Acquisition in the
Department of Revenue, Registration and Land Reforms.
h. An officer not below the rank of A dditional Director of Mines from
the Department of Mines and Geology
(2) In case the department/organizations is unable to provide the officers of
the rank mentioned in sub -section-I, the deputed/secondment officer shall
be deemed to be in the rank mentioned in sub-section-I till he remains on
deputation with Agency. However, this will not entitle him any additional
financial benefits on this account.
(3) All regulatory departments who grants approvals/clearances shall
empower their depute/secondment senior offic er in the JIIDCO through
notification to grant approvals within a time -frame for all new projects to
setting-up of business and starting business operations. Till such
notification, the deputed/seconded officers shall be responsible for
disposal of applica tions for such clearances applications within the time -
limit.
(4) The Chief Executive Officer of the SWCC shall exercise the powers of
supervision and control over all the officers on deputation/secondment to
the Agency. However, the Officers as mentioned in sub-section-1whose
services are placed with the Agency on deputation or secondment shall
continue to be governed under the relevant rules and regulations of their
respective cadres in their parent departments/organizations.
(5) The Agency shall provide other s taff requirement to discharge
responsibility under this Act through contact or outsourcing mode.
11. Functions of Chief Executive Officer(CEO):
(1) CEO shall also be the Principal Secretary/Secretary in charge of the
Department of Industries.
(2) The CEO shall examine, consider and process the proposals received
from any entrepreneur relating to industrial and other projects to be set up
in the State from time to time.
(3) The CEO shall exercise all the powers/ functions assigned by the
Governing Body, High Powered Committee and as delegated from time to
time by the State Government by notification
(4) The CEO shall coordinate all efforts for promoting investments in the state
and other related activities.
(5) The CEO shall be the competen t authority to sign all documents,
approvals and sanction of grants or instructions issued by SWCC.
(6) The CEO shall refer any case / issue / proposal to the High Powered
Committee with its recommendations and suggestions, if considered
necessary.
(7) The CEO sh all review and monitor investments in various projects for
which the approvals have been granted by the SWCC.
(8) The CEO shall be responsible for preparation, submission of monthly,
quarterly, half yearly and yearly progress reports to the Governing Body

(9) The CEO shall coordinate with all departments through various officers of
departments deputed or seconded in the JIIDCO to grant
approval/clearances and to implement the investment proposals on
ground.
(10) The CEO shall also coordinate with all departments/authorities/offices who
are not deputed or seconded their officers in the JIIDCO to grant
approval/clearances and to implement the investment proposals on
ground.
(11) The CEO shall provide all necessary assistance to entrepreneurs to set up
industries in the State.
(12) The CEO shall regularly monitor, review and evaluate the functioning of
web-portal of Single Window Clearance maintained and operated by the
JIIDCO.
12. District Executive Committee – DEC
(1) The State Government may by notification constitute committee at
district level called as “District Executive Committee”.
(2) The
District Executive Committee constituted under section 12.1 shall consist
of the Chairman and the following members, namely:-

(1) The District Executive Committee shall regularly monitor, supervise and
review the functioning of the District Level Nodal Agency for the effective
implementation of the Act.
(2) It shall carry out such other functions as may be assigned to it by the High
Powered Committee under section 7.
(3) The Committee may assign or revoke the functions / powers to the District
Level Nodal Agency within the powers / functions assigned by the Act or by
the High Powered Committee for effective implementation of this Act.
(4) The District Executive Committee shall meet at least once in every month at
such place, as the Chairman of the Committee may decide, for performance
review of the District Executive Committee; and for providing necessary
recommendations wherever required.
(5) The District Executive Committee may also consider matters referred to it by
the District Level Nodal Agency and take appropriate decisions.
(6) It shall further refer any case / issue / proposal to the Department of
Industries with its recommendations and sugges tions, if considered
necessary.
(7) A member of the District Executive Committee shall personally attend its
meeting and in case he/she is unable to attend, he/she may depute a
Senior Level Officer with a written authorisation to take appropriate
decisions in the meeting.
