In this Act, unless, the context otherwise requires :.....:.. • 
_ "Principal Act" means. the Chhattisgarh Nirashrit<?n · Avam Nirdhan Vyaktiyon Ki 
Sahayata Adhiiliyam, 1970 (No. 12 ofl 970). ·

For sub-clause (ii) of clause (a) of Section 2 _of the Prindpal Ac~ the following 
sub-clause shall be substituted, namely :-
"Person with disability" suffering from not less than forty percent ~f any dis­
. abil·ity as certified by a medical authority. 
After sub-~lause (ii) of clauSt? (a) of Section. 2 _of the Prinr.ipal Act, the follow-
ing sul>-clause shall be inserted, namely.:- .. 
"(iii) a widow or a divorcee or a woman subjected to cruelty fulfilling such 
requirements including that of residence in a local area as may be 
prescrit>:e4; · · · · 
(iv) Ch!ldren affected by naxal violence." 
. For sub-clause (a-i) (ii) of Section 2, the following sub-clause shall be substi-
tuted, namely~- · 
"members belonging to family, ofbelo~ poverty line as notified by the State· 
Government from time to time."

"husband, wife and their tninor children," the words "husband, wife, their mi­
nor children and unmarrie4 daughter" shall be. substituted.

(3) For sub.dause (i) artd (ii) of clause (d) of Section 3, the following shall be _­
substituted, namely;_:. 
"'(i) cremation of an indigent person or any member of his family; 
{ii) - special schemes for fhe benefit of girls belonging to families of 
below poverty li_ne as notified by the State Government from time to 
time." 
For sub-section (2-A) of Section 4 of the Principal Act, the following ~ub-sections shall · 
be substituted, namely :~ 
- - "(2-A) The Collector shall apportion and deposit tweoty percent of the amount of 
collectiori made by a market committee, into the Stale Destitute Fund, and the 
amount collected in such fund shall be utilised for any district in such manner 
as may be prescribed, and the-Commissioner/Director, Panchayat and Social 
Welfare Chhattisgarh shall operate and maintain proper account of such fund, 
and the account of such fund shall be audited-by the Director, Local Fund 
Audit, Chhattisgarh. 
(2~AA) All mori~ys of the -Stale Destitute Fund shall Ix; deposited in a co-operative 
bank or any Bank specified in the first Schedule to-the Banking Companies 
"(Acquisition and Transfer of Undertakings) Act, 1970 (No: 5 of 1970), as a 
cotre.c;ponding new "bank or in post offic~ saving bank: 
· (2-A~) The amount .remaining after apportionm~nt uncie~ sub-section (2) ai:td (2-A) 
shall be utilised for "the. purpose of setting up and maintaining homes· for 
destitutes and indigent persons in the area falling wi~in the jurisdiction of the 
market committee concerned: 
. .Provided that the State Governmenf may, having regard to "the need of 
such .home$ in any other areas, order the utilisation.of not exceeding ten _per• · 
cent of the remaining. amount.for setting.up .and .maintaining homes for destitutes 
and-indigent person~ in such other area outside the jurisdiction Qf the market 
com:mittec-co~erne<t. 
In the first ·provis'o to sub-section (i) of S~tion 7 .of the.Principal Act, the words "or 
adivasi. pancbayat" shall 1:>e · omitted. 
ln s.ub-sectipn (2) of Sectio11 9 of the Principal Act :-:-

THE CHHATTISGARH NIRASHRITON AVAM NIRDHAN VYAKTIYON Kl 
SAHAYATA ( SANSHODHAN) ADHINIYAM, 2017. 
An Act further to amend the Chhattisgarh Nirashriton Avam Nirdhan Vyaktiyon 
Ki Sahayata Adhiniyam , 1970 (No. 12 of 1970). 
Be it enacted by the Chhattisgarh Legislature in the Sixty-eighth Year of the Republic of 
India, as follows :-
S h ort ti tl e , ex tent I. (I) This Act may be called the Chhattisgarh Nirashriton Avam Nirdhan Vyaktiyon 
Ki Sahayata (Sanshodhan) Adhiniyam, 20 17. and comme ncement. 
Amendment of 2. 
Section 2. 
(2) It extends to the whole State of Chhattisgarh . 
(3) It shall come into force from the date of its publication in the Official Gazette. 
In the Chhattisgarh Nirashriton Avam Nirdhan Vyaktiyon Ki Sahayata Adhiniyam, 1970 
(No. 12 of 1970), (hereinafter referred to as the Principal Act), in Section 2, in clause 
(a),-
(a) In sub-clause (iv), for punctuation full stop( .), the punctuation semi-colon (;) 
shall be substituted; 
(b) after sub-clause (iv), the following shall be added, namely:-
·'(v) Person suffering from HIV A ids; 
(vi) Person suffering from leprosy and recovered from leprosy; 
(vii) Person suffering from mental illness and recovered from mental 
illness; 
(viii) Third Gender person; 
(ix) Dwarf."
