Article 309 of the Constitution of India, the Gover nor of Bihar, in order to regulate the
recruitment and service conditions of the Bihar Art and Culture Service, hereby frames the
following rules:-

Chapter-1
Preliminary
1. Short title, extent and commencement
(i) These rules may be called as the Bihar State Art and Culture Service Rules 2014.
(ii) It shall extent to the whole of the state of Bihar,
(iii) It will be enforced with immediate effect.
2. Definitions: In these rules, unless otherwise requires in the context
(i) ''State Government'' means the Government of Bihar.
(ii) ''Governor" means the Governor of Bihar.
(iii) " Department" means the Department of Art, Culture and Youth.
(iv) ''Commission'' means the Bihar Public Service Commission.
(v) "Member" means a person appointed in the Bihar Art and Culture Service.
(vi) "Service" means Bihar Art and Culture Service.
(vii) "Appointing Authority" means the Government of Bihar.
(viii) "Controlling Authority" means the Department of Art, Culture and Youth.
(ix) "Probationary officer” means the new recruited offi cer under training appointed
against the permanent post to the basic grade of th e Bihar Art and Culture
Service.
(x) "Seniority list” means the seniority list to be pre pared for the Bihar Art and Culture
Service under the Directorate of Cultural Affairs.
3. Constitution of the service
(i) This service shall be the state service under the a dministrative control of the
Department of Art, Culture and Youth.
(ii) The description of the different grades of this service is given in the Annexure-I.
(iii) The state government may determine the work force, designation and pay scale of
different grades of this service from time to time by issuing notification.
(iv) The officers already appointed and working to the p osts mentioned in the schedule
shall be considered automatically as members of thi s service from the date of
commencement of these rules.
Chapter-2
Recruitment
4. Source of recruitment:
If not otherwise provided, the direct recruitment s hall be made as per the
provisions of chapter-3 of the rules.
5. Reservation:
For the appointment and promotion in this service, provisions for promotion
shall be made effective in accordance with the reservation rules enacted from time to time.
6. Determination of vacancies and intimation to the commission:-
The administrative department shall determine the n umber of vacancies to be filled up
by the direct appointment every year on the 1
st of April and shall send the requisition by 30 th
of April. If any action to send requisition or to f ill up the post by direct appointment is not
taken there after also year wise calculation of the of the post to be fill up by direct

Chapter-3
Direct Recruitment
7. Source of the direct recruitment:
The basic grade of this service shall be filled 100% through direct recruitment.
8. Qualifications for the direct recruitment:
(i) Age of the candidate - The minimum age shall be 21 years and the maximum age
shall be the same as may be determined from time to time by the General
Administrative Department of the State Government.
(ii) Minimum educational qualification of the candidates :- Graduation from any
recognised university, in addition to the post grad uation Diploma in Dramatic
Arts or P.G. in Theatre/Dramatics, post-graduation or equivalent degree in
dance/music/fine arts/art history.
9. Basis of selection:
The posts of the basic category of this service sha ll be filled by the
Commission by organising competitive examination co nducted from time to time. For the
appointment into the basic grade of this service a candidate shall have to undertake the
written preliminary examination and main examinatio n and interview fixed by the
commission.
10. Subject and syllabus of examination
The subject and syllabus for the examination to be conducted by the
commission and the essential and desirable eligibilities as per the subject shall be decided by
the department in consultation with the commission.
11. Medical examination
Each candidate selected for the appointment shall h ave to undergo the medical
examination before a Medical Board constituted by t he state government. Those candidates
who will fail to satisfy the medical board, with re gard to his physical fitness as required by
effective execution of the duties supposed to be un dertaken by him shall not be appointed.
The Medical Board will itself formulate objective criterion for the purpose.
12. Recommendation of the candidates by the commission
(i) The Commission shall prepare a merit list of the candidates on the basis of the marks
obtained in the written examination and the intervi ew. Out of the list so prepared
the commission shall recommend only such number of candidates as requisitioned
against the vacancy. Only in the case of any candid ate not joining the service that
the name of the other candidates from the list can be recommended as per the
order of the merit list.
(ii) The merit list received from the commission to the department shall be valid up to a
period of one year since the date of its receipt in the department.
13. Seniority:-
The seniority of the employees appointed by direct recruitment shall be

14. Probation period and confirmation:
(1) Every officer appointed against the basic post shal l remain on probation up to the
period of 2 years from the date of his joining.

(2) The government may terminate the appointment of any officer recruited in this
service during his probation period or at the time if the officer is found not fit for
the appointment of its expiry for other reasons.
(3) Syllabus of the training shall be decided by the Administrative Department.
(4) The confirmation, annual increment and promotion admissible to the new recruit into
the service can be given to him only after the comp letion of the stipulated training
and passing the departmental examination.
(5) The Departmental Examination shall be organised by the Central Examination
Committee (Board of Revenue).
Chapter-4
Promotion
15. Kalawadhi for promotion:-
The “kalawadhi” of different post shall be fixed fr om time to time as per the
guidelines issued by the General Administration Department.
16. The departmental promotion committee:-
On the recommendation of the Departmental Promotion Committee, the
promotion shall be considered. The Departmental Pro motion Committee shall be constituted
as per the resolutions/circulars issued from time t o time by the General Administrative
Department. For the promotion to the highest pay sc ale, the Departmental Promotion
Committee shall be chaired by the Chairman of the B ihar Public Service Commission or a
member nominated by him.
Chapter-5
General/ Miscellaneous
17. Contract with regard to the scope of work:-
(i) Member of this service can be posted anywhere in the state of Bihar or outside it.
(ii) The government shall have power to appoint or depute any member of this service to
any non-cadre post which would being accordance with his qualification.
18. Training:-
Any member of this service may be sent for the trai ning for a stipulated period
in or outside the state.
The service condition, salary, allowance, leaves, p ension and other conditions of
this service shall be fixed as per the Bihar Service Code and Bihar Pension Rules.
19. Other service conditions:-
Other conditions and disciplinary actions, leave , admissible pension benefits,
etc. for these service which are not covered by t hese rules or which are not notified
separately for these services shall be governed by the provisions of the relevant rules for the
offices of the state government.
20. Repeal and saving:-
(i) All concerned & relevant circulars/decisions shall be repeal on the date on which
these rules comes in force.
(ii) Beside such repeal anything done or any action take n under those rules, any work or
action done under this rule shall be deemed to have been done or taken in exercise of
power conferred by or under those rules as if those rules were in force on the day on
which such thing or action was done or taken.
