BIHAR AGRICULTURE MARKET YARD LAND TRANSFER ACT, 2017
AN
ACT
TO PROVIDE FOR THE TRANSFER OF LAND OF THE AGRICULT URE MARKET
YARD, PATNA CITY LAND FOR THE PURPOSE OF CONSTRUCTI ON OF MULTIPURPOSE
PRAKASH KENDRA AND GARDEN BASED ON THE LIFE OF SHRE E GURU GOBIND
SINGH JEE MAHARAJ
Preamble .—Whereas, it is necessary and expedient to constru ct the multipurpose Prakash
Kendra and Garden on the occasion of 350
th jubilee of the tenth Sikh Guru Shree Guru Govind Singh
Jee Maharaj based on his enlightened life and glorious historical event for the state, and;
Whereas, the certain land of Agriculture Department has been earmarked for the
construction of multipurpose Prakash Kendra and gar den, the transfer of which to the Tourism
Department is also necessary,
Now, therefore, be it enacted by the legislature of the State of Bihar in the sixty eighth year
of the Republic of India as follows:-
1. Short title, extent and commencement .— (1) This Act may be called the Bihar
Agriculture Market Yard Land Transfer Act, 2017.
(2) It shall extent to the land transfer for Shree Guru Govind Singh Multipurpose
Prakash Kendra and Garden.
(3) It shall come into force at once.
2. Definations. In this Act unless there is anything repugnant to the subject or context-
(i) "Act" means The Bihar Agriculture Market Yard Land Transfer Act, 2017;
(ii) "Schedule" means schedule annexed to this Act;
(iii) "Government" means the State Government of Bihar;
(iv) "Agriculture Department" means the Agriculture Department of the
Government of Bihar;
(v) "Tourism Department" means the Tourism Department of the Government of
Bihar;
(vi) "Market Yard" means Market Yard under Agriculture Department of t he State
of Bihar.
3. Transfer of Market Yard Land.— The State Government may permanently transfer
such land of Bihar Agriculture Produce Market Yard, Patna City which have been vested in the State
Government by the Bihar Agricultural Produce (Repea l) Act, 2006 and which is mentioned in the
schedule annexed to this Act to the Tourism Departm ent for the construction of multipurpose
Prakash Kendra and Garden based on the life of Shree Guru Govind Singh.
4. Repeal and Savings.— (1) The Bihar Agriculture Market Yard Land Transfer
Ordinance, 2017 (Bihar Ordinance No.-2, 2017) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken in exercise of any
power conferred by or under the said ordinance shal l be deemed to have been done or taken in
exercise of the powers conferred by or under this A ct as if this Act was come into force on the day
on which such thing was done or action taken.
